PLANNING BOARD MINUTES
NOVEMBER 3, 1989
The Southold Town Planning Board held a Special Meeting on
Friday November 3, 1989 at 4:20 p.m. at the Southold Town Hall
Main Road, Southold. '
PRESENT WERE:
Bennett Orlowski,Jr., Chairman
Member G. Ritchie Latham
Member Richard Ward
Member Mark McDonald

Mr. Orlowski: I would like to call this-~eeting to order. The
first order of business is Cedarfields- Board to review the
Suffolk County Planning Commission report dated November 1,
1989. Board to review the bond estimate dated November 2, 1989.
And Board to review the final map. SCTM #1000-40-5-1. In
reviewing the Suffolk County Planning Commission's report, we
have to determine Whether t~ override the request for a
Homeowners Association, which is item number 8, and to reco~m~nd
to the Town Board to accept dedication of the open space instead
of forming an association. Does the Board have any pleasure on
that?
Mr. Ward: Mr. Chairman, I opt for a resolution that we override
the County recommendation for a homeowners' association based
upon the fact that this project is an affordable housing project
under the guidelines of Southold's affordable housing program.
But, a provision should be presented here that if, in fact, that

this project does not proceed under affordable guidelines that a
homeowners' association would be required.
Mr. Latham: Second.
Mr. Orlowski: Motion made and seconded. Any questions on the
motion? All those in favor?
Vote of the Board; Ayes: Orlowski, Latham, Ward, McDonald.
Mr. Orlowski: Opposed? So ordered.
On the proposed C & Rs, we have the applicant's own covenants
and restrictions. We also have the Planning Co~£~L,ission's and the
Health Departments. Does the Board have any comments on these?
Mr. Ward: Just an addition, the adherence to the affordable
housing program guidelines of the Town.
Mr. Orlowski: Alright. We also have the bond estimate. On our
engineer's report we have three items: Check the minimum cover
for 15" positive drain; Show manholes for positive system on
profile; and Topsoil and seeding on full extent of right of way.
This might change this bond estimate a little bit, but I think
we can entertain a motion to accept the bond estimate and make a
motion to the Town Board to accept the bond estimate with those
few changes.
Mr. Latham: So moved.
Mr. Ward: Second.
Mr. Orlowski: Motion made and seconded.
Mr. Ward: Just a point of question to the applicant. Just to
make sure that the water and hydrants are part of the deal with
Greenport?
Mr. Bracken: Yes.
Mr. Ward: So they are not in the bond estimate?
Mr. Bracken: No, they are not.
Mr. Ward: O.K.
Mr. Orlowski: You also have Health Department approval on both
portions?
Mr. Bracken: Yes.
Ms. Scopaz: Mr. Chairman can I ask one question? The C & Rs that
you submitted to the Health Department and to the County, if I
am correct, that covers both Cedarfields and Mooresland?

Mr. Bracken: Yes, that is correct. They have not been filed yet.
They have been approved, but we have not filed. Once they are
approved by this Board then we will file.
Ms. Scopaz: With the County?
Mr. Bracken: Yes.
Mr. Orlowski: O.K. We had a motion made to send over to the Town
Board. Motion made and seconded. Any questions on the motion?
All those in favor?
Vote of the Board; Ayes: Orlowski, Latham, Ward, McDonald.
Mr. Orlowski: Opposed? So ordered.
Subject to a few conditions, I think everything is in order to
approve the Cedarfields portion of this project. What is the
pleasure of the Board?
Mr. Ward: I move a motion to grant final approval to Cedarfields
upon satisfaction of all items noted herein:
Receipt of a letter from the Village of Greenport
stating that all terms of the water contract dated
June 15, 1989 have been met.

Receipt of revised grading and drainage plans as per
report from the Town's Engineering Consultant; and
approval of same by the Town's Engineer. Realignment
of Washington Avenue should be shown on these maps as
well as subdivision maps.
Receipt of all required covenants and restrictions by
Suffolk County Planning Commission and Planning Board;
and approval by Town Attorney as to correctness, legal
form and content.
The previously stated Covenants and Restrictions are
to be filed and a notation placed on the subdivision
map of the Liber and Page numbers.
5. Acceptance of the bond estimate by the Town Board.
Submission of bond or letter of credit or its
equivalent and acceptance by the Town Board.

Receipt of revised mylars of the subdivision maps
showing location of well and 200' non-pollution
easement and Health Department stamp.
8. Acceptance of open space by the Town Board.
RESOLVED that the Planning Board authorize the Chairman to
endorse the maps upon satisfactory resolution of the above items.

Mr. McDonald: I second the motion.
Mr. Orlowski: Motion made and seconded. Any questions on the
motion? All those in favor?
Vote of the Board; Ayes: Orlowski, Latham, Ward, McDonald.
Mr. Orlowski: Opposed? So ordered.
Mr. Orlowski: The one other item I have is Herbert ~andel-
Board to set Monday, November 20, 1989 at 8:15 p.m. for a public
hearing on the final map dated May 26, 1989. This set off is on
11.92 acres located at East Marion. SCTM 91000-31-4-15.
Mr. Ward: So moved.
Mr. Latham: Second.
Mr. Orlowski: Motion made and seconded. Any questions on the
motion? All those in favor?
Vote of the Board; Ayes: Orlowski, Latham, Ward, McDonald.
Mr. Orlowski: Opposed? So ordered.
Mr. Orlowski: I have nothing left on my a~enda.
Mr. Ward: Move for adjournment.
Mr. Latham: Second.
