AUGUST 14, 1989
The Southold Town Planning Board held a regular meeting on
Mondayr August 14, 1989 at 7:30 p.m. at the Southold Town Hall,
Main Road, Southold.
Present were:

Mr. Orlowski: Good evening, I would like to call this meeting
to order. First order of business at 7:30 p.m., George
Furse-Public hearing on the final maps dated May 11, 1989.
This minor subdivision is on 3.64 acres located at Fishers
Island. SCTM $t000-9-3-2.
Mr. Orlowski: Everything is in order for a final hearing, we
have proof of publication in the SuffOlk Times and also proof of
publication in the~Fisher~!sland paper. Everything is in order

WHEREAS, a formal application for the approval of a
subdivision entitled George R. Furse located on Fishers Island
was submitted to the Planning Board office on Au~dst 12, 1988;
and
WHEREAS, the Planning Board, as lead agent, made a
determination uDdmr the State Environmental Quality Review Act
of non-significance; and
WHEREAS, a final public hearing was held on said
subdivision application at the Town Hall, Southold, New York on
August 14, 1989 at 7:30 p.m.; and
WHEREAS, the requirements of the Subdivision Re~lations of
the Town of Southold have been met by said subdivision; and
be it therefore RESOLVED that the Southold Town Planning Board
approve the subdivision known as George R. Furse map dated May
11, 1989 and authorize the Chairmmn to endorse said approval.

review the final maps for this affordable housing project. This
minor subdivision is on 2.962 ~res located at Mattituck.

be approved subject to the He~]th Department approval and the
declarations of covenants and restrictions stating that there

WHEREAS, the Planning Board, as lead agent, made a
detezmination under the State Environmental Quality Review Act

need here is the required pavement, thickness and ~he required
50 foot radius of the cul-de-sac and also that the access to
lots one and four is to be over the right- of- way. This could
be in the form of a covenants and restriction.

following reasons:

Mr. Ward: I'll move for a Negative Declaration. Reasons support
this detezmination are:
An Environmental assessment has been s,~mitted, reviewed
and it was determined that no significant adverse effect to the
environment wore likely to occur should the project be
implemented as planned.
There will be no change in the density of the property as
the proposal is fora lot line change only.
The Planning Board has requested that Covenants and
Restrictions be filed stating that (1) clearing and grading
within plot 2 be limited to that necessary for siting and
constructing a house with the intent of preserving as much of
the natural vegetation on the site as possible. L~m4ting
clearing and grading will minimize stof~,water. (2) Erosion
and sediment control measures shall be required during and
i~mLediately after constr~tion on Plot 2 to ~n~ure that
stozmwater runoff will not carry eroded and other deleterious

number two of the report "the right-of way width for the
private road varies from 50 feet which is acceptable under the
Town Code to 25 feet which would require a special exception",
we would waive the right-of-way to 25 feet.

Mr. Ward: I would like to present a resolution to override the
report in regard to the Suffolk County Planning Co~f~f, ission's
report dated July 7, 1989. The Planning Board's resolution of
June 5, 1989 addressed the concerns of the county in thmt the
board required that any further subdivision of the 10.9946 acre
parcel be limited to three lots unless a different access point
is provided. The resolution also stat~ that subdivision of the
larger parcel into more that three lots would constitute a major
subdivision. In either case, further subdivision of the parcel
will require that a road be built to town specifications. With
this resolution a copy should also go to the Suffolk County
Planning C~m~issioner.

public hearing on the preliminary maps. This major subdivision

Mr. 0rlowski: I think that on some of these findings in
Number one which reads: (No lot shall be subdivided or its lot
line changed in any manner at any future date unless authorized
by the Town of Southold Planning Board) - should be changed to
read: No lot line shall be changed in any manner at any future
dated unless authorized by the Town of Southold Planning Board.
We should request an additional covenant stating: There shall
be no further subdivision in perpet~ty.
Number two - I don't think we need any changes.
Number three - I think should be changed as follows: No
driveway or entrance road on Road A shall be located within
one-hundred and thirty feet of the northerly ends of the short
radius curves connecting the easterly and westerly sides of Road
A with the northerly side of Fr~nk~nville Road.
Number four - I don't see any problem.
I would also note that the final map must state that: A
Declaration of Covenants an8 Restrictions has been filed in the
Suffolk County Clerk's office which affects lots in this
subdivision.

County Planning Commission report dated April 10, 1989.

What
Mr. Edwards: Mr. Chairman since there are so many covenants and
restrictions that we are asking I would like to entertain a
motion requesting covenants and restrictions that are on file
numbers 1 through 14E with a note that they draft a declaration
of covenants and restrictions incorporating the above items
which must be s~h~itted to t~e PlAnning Board for review. Note
that the above record of covenants and restrictions which the
board has requested addresses number 1 through three of the
County Planning Commissions report. Number4 and 5 in the
report have already been incorporated in the revised plans which
have been submitted by the applicant.
COVENANTS AND RESTRICTION FOR WALSH PARK:
1. No construction related activities within 300 feet of the
Osprey nest will happen between March 15 and August 1.
2. No building activity or land clearing shall occur within 100
feet of the wetlands.
3. Bi-annual sampling for methane shall be undertaken by the
Walsh Park Benevolent Corporation every two years after
occupancy permits are issued for houses built on the site.
4. No building envelopes or building setback lines shall happen
within the landfill area.
5. Property deeds for lots numbered 8, 9, and 10 will advise
future owners that a former landfill is on the site. All
prospective owners of lots within the subdivision shall be
informed bymeans of an advisory covenant of the location of the
property to the abandoned landfill site.

6. The Fishers Island Water Company shall provide water to the
site.
7. Proposed road to be dedicated to the Town of Southotd.
8. Ail lots to be serviced by on site septic systems.
9. If required, leaching basins to be installed for roof and
driveway run-off. The need for these ba~in~ to be determined at
the time of construction.
10. 15 foot Utility Easement to be deeded to one or more of the
followings:
- Fishers Island Electric Company
- Fishers Island Water Works
- Fishers Island Telep~ Company
11. Off-street parking must be provided - Teams of road
reduction.
12. Clearing and grading within each lot shall be limited to
that necessary for siting and construction a house with the
intent of preserving as much of the natural vegetation on the
site as possible. Limiting clearing and grading will minimize
stoimwater runoff and erosion.
13. There shall be no further subdivision in perpetuity of any
of the lots within this subdivision.
14. The following terms and. conditions shall apply to all land
lying within the wetland and conservation easement area as

April 27, 1989. This minor subdivision is on 1.0.651 acres
located at Sou~ld. SCTM ~1000-54-3-po26. We have proof of
publication in the Long Island Traveler Watchman and the Suffolk
Times. At this time everything is in order for a final hearing
and I'll ask is there are any objection~ to this subd%vision?
Hearing none, are there any endorsements of this subdivision?
Henry Raynor: I represent Mr. a_nd Mrs. Deutsch. The Planning
Board declared themselves lead agency in 1988 and it w~ given a
negative declaration in May of that year. We received sketch
approval in May of 1988 and March of this year we have approval
of Suffolk County Department of Health Serviues for water in the
test holes. The lot configuration has changed at the request of
this board. I would request approval of this subdivision as it
meets all the sections of the subdivision re~]ati~n~. Thank

Mr. Orlowski: I believe those Health Department approvals
were received here in June. Not March.
Mr. Raynor: We have approval in May, but I don't know when it
got back here.

reasons supporting this determination are as follows: The
project has been determined not ~o have a significant effect on
the environment for the following reasons: An Environmental
Assessment has been s,~bm~tted, reviewed and it was detez~ned
that no significant adverse effects to the environment were
likely to occur should the project be impl~,~ented as planned.
The Plannin~ Board has requeste~the following site pl~
revisions: One access along Main Road twenty five feet wide and
located to the East side of the property. Access on Factory

Avenue should be twenty five feet wide with greatest separation
as possible between intersection and curb cut. A clear zone at

has been no correspondence received from the Department of
Health Services in the allotted time, it is assumed that there
are no comments or objections from that agency. Because there

agency. The only other questions we may have is whether we

board is the first stage in a two part zeview which will
eventually als0 go to the Zoning Board of Appeals. My request
tonight is based on what I have heard, that we'll be in a
position to have the revised site plans submitted to your staff
in a week to ten days and I was wondering if you would consider
scheduling this for a public hearing at your September llth
meeting for final site plan?
Mr. Orlowski: At this time I don't believe the board is going
to schedule a hearing on this but if all the changes are in and
done by our next meeting in September, we may be able to act on
it.
Mr. DePetro: I would also like to point out to the board that
in regard to the fuel storage ~nks, the applicant ~s in his
possession all of the pezmits necessary from the Suffolk County
Department of Health. I would like to leave with the board, a
full color rendering, I believe we are going to t~ke back with

Mr. Orlowski: Sidney Olmstead - Board to discuss this
application with the applicant. SCTM ~1000-114-7-14.
Mr. Orlowski: Since Mr. Olmstead is a relative, I will
step out.
Mr. Olmstead: I still feel that you are selectively in taking
state town law interpreting it in such a way, there is nothing
in that law that says there has to be a cul-de-sac. What you
are giving me is not truly a cul-de-sac, but a circle. If
tonight on ShawnDelehanty, one of you stated that you want
to save as much vegetation as possible and here you are making
me rip up to make a traffic circle. I have New York State
Department of Environmental Conservation approvals and Suffolk
County Health approvals for this lot line. Basically I am
drawing lines in the middle of lot with pre-existing houses on
it and I have no more room for expansion. I been to the ZBA
for approval with all, but access and I would like to discuss
this further.
Mr. Ward: What do you see is the problem with doing it.
Mr. Olmstead: I don't know why I have to have a big circle in
there. There isn't going to be any more building or lot
divisions because we can't go any smaller than this, we've got
too many people now. I feel that perhaps we are going to make
it twenty-five feet wide with a couple of nice trees all the way
down to the end. I may even have to move a telephone pole. I
feel a bubble on the end, a small tee would suffice rather than
a circle that size. You're giving me a circle the s~ size as
a subdivision with thirty or forty houses.
Mr. Latham: When an oil truck or a garbage truck comes it it's
difficult to turn around.
Mr. Olmstead: They do it now. If I didn't subdivide this they
would continue on the way they do now. I 'm subdividing to
avoid lawsuits, my brother and I share this.
Mr. Ward: You realize that the center of it doesn't have to be
paved. You can just carry the loop around.
Mr. OlmsteaS: I understand that. It's also very close to one
of my cesspools too.
Mr. Latham: We would like to look at it again.
Mz. Mutlen: I'm concerned about ~mergency vehicles. They are
making the pumpers larger and larger today and I would have to
have a problem because I couldn't get this quick enough. I
would like to take another look and take some measurements an8

get an idea, perhaps we can check it further with the local fire
department too. I'm concerned with safety.
Mr. Ward: I am too.
Mr. Latham: I haven't seen any of these roads really
overbuilt. I used to think when I first got on, that what is
there is nothing. I think that a lot of the roads we have now
are too small. Trucks are getting larger. In the past ten
years they have gotten a lot larger. I w~g for sm~ll roads but
now I don't think wetre making people put large roads in in vain.
Mr. Olmstead: Everything here is existing. This is not a
development where you can plan a circle before you build ~h~
houses or even plant trees.
Mr. Edwards: I like Mr. Mullen's suggestion. I suggest
either getting a fire chief or an officer rather th~n the fire
co~6~,issioner because they' are the fellows that drive the
vehicles.
Mr. Mullen: I am a victim of that problem. I live on a
right-of-way. Four homes and a so called right-of-way that is
perhaps eight feet wide. It scares me..
Mr. Olmstead: I've had cement trucW~ in there when I built
the place. They can get in. I can get him in and with plenty
of room to spare.
Mr. Mullen: The only concern about getting him out, I agree
with you about that, but unlikely he might get another call.
We'll take a look at it.
Mr. Olmstesd: Bear in mind, what you see there is going to be
changed to twenty-five feet and graded.
Mr. Mutlen: Do you have it marked off?
Mr. Olmstead: I do not but I could.
Mr. Ward: Maybe you could flag it and show us what the impact
is that you are concerned about and it you want use red for that
and another color for what is proposed and let us take a look at
it.
Mr. Mullen: Let us know when it is ready.
Mr. Olmstead: When is your next field inspection.
Mr. Mullen: Prior to our next meeting' which is September 11.
