The Southold Town Planning Board held a regular meeting on
Monday, June 19, 1989 at 7:30 p.m. at the Southold Town Hall,
Main Road Southold.
Present were:

Mr. Orlowski: Good evening, I would like to call this meeting
to order. First order of business is Sunbeau Associates -
Before I open the public hearing, I will enterts~n a motion to
reconuaend a revised bond estimate of $99,150 for Sunbeau
Associates to the Town Board for their approval~

amended map dated May 31, 1989. This subdivision is on 30.637
acres located at Mattituck. We have proof of publication in the
Long Island Traveler Watchman and also have proof of publication
in the Suffolk Times. At this time everything is in order for
a public hearing. I'll ask if there are any objections to this
subdivision? Hearing none, are there any endorsements of this

pre nor con but may have information pertaining to this
subdivision that would be of interest to the board? Are there

subdivision map which was approved, ~nd since this is one lot
being transferred out of an approved subdivision, I'll entertain

Mr. Edwards: If you remember ab out last meeting we granted
sketch approval on this parcel based on a letter from the ZBA
which stated that under the new master plan the parcel is zoned
R-40. Under proven inspection we found that it was not, it was
R-80. I would like to move that we recind our two motions of
the meeting of June 5, 1989.

of this situation because t believe approximately a year or so
ago there was another change in that immediate area where
someone had purchased a lot from this applicant and had put a
lot line change in there. I don't believe this is proper for
the area.
Mr. Orlowski: Is anyone representing the applicant h~re?
Mr. Tuthill: I am with Richard Lark's office representing the
applicant.
Mr. Mullen: I believe that not too long ago that this was a lot
owned by Mrs. Pfieff and it was set off with a stipulation to
one side of them and now they are doing something else to it. I
can't quite understand the sit~ation.
Mr. Tuthill: I'm not clear as to.
Mr. Mullen: In other WOrds, approximately a year ago in that
area there wa~ a gentlemen to the oth~r sid~ of her that had
purchased, a lot and they had divided it, now we are doing
further division of this property which is a very fra~ite area.
I~wouldlike to look at it a little closer if you do net m~nd.
Mr. Orlowski: We will set it up for an inspection. This was
already set off and we just want to see where this lot line is.

and
WHEREAS, the Planning Board of the Town of Southold
pursusnt to the State ENvironmental Quality Review Act,

Agency and having issued a negative declaration on September 18,
1988;
WHEREAS, a Public Hearing on such application was held on

the time frame that we will be proceeding in now? We als0 have
a pending application in the Zoning Board of Appeals. Will your

Mr. Orlowski: We just did ~nd we are starting th~ coordinatinn
process and with SEQRA you know as well as I know if there are
no problems within the 30 day period we will move on. You're at
the ZBA right now?
Agent for applicant: We're filed but they are waiting the
outcome of your review before they proceed.
Mr. Orlowski: O.K., well we have to wait for 30 days.
AGent for applicant: The reason t asked the question as t am
sure you are aware, at the request of your staff we had
previously s,,bm~tted a traffic study and if there is any
additional data or supplemental reports which you might require
of them to facilitate the SEQRA Review, just let me know and I
will try and get it to you aN soon as possible.

Mr. Latham: The request should be made for the following items:
(I) ~ne drainage plans, specifically in relation to
parking, and proposed bu~ld~ng, must be revised so ~ to be
consistent with the up-dated site plan received in this office
on April 19, 1989.
(2) All maps must be signed and sealed by the licensed
New York State professional responsible for preparing the plans.
(3) Site grades, grading, and drainage for the parking
areas must beshown. All areas shown as available for parking
must actually be available for parking.
(4) A landscape plan must be submitted for review by the
PlaDn~ng Board. Existing landscaping in ~he westerly front yard

application with the applicant. This minor subdivision is on 3+
acres located at Mattituck.

Mr. Olmsted - If it would please the board, I would like to make
a statmmmnt so that I can get all my views across. I wrote this
this afternoon. I think the County and the Town has lost site
of what I am actually trying to do here. On one large lot I
have three existing houses. One built at the turn of the
century, one mn 1949, one in 1974. We have no intention of
selling or otherwise chan~ging anything, we are merely dividing
the lot so there will be a combinmd ownemship. As you can see
we each own one lOt totally and jointly share the third. It is
very easy to plan development on empty field, not so with an
existing h~mesites. I realize that when you saw the improved
groups drawing on lot two you would probably have thought I was
trying to put something over on you. We intend to r~move the
portion of the improved driveway ~h~t is on lot one mhd connect
lot two to the proposed right-of-way. I note also that you
removed the waterfront privileges from lot n~mmber one because
you m~de the right-of-way so large. Understanding when the ZBA
grants an appeal and approves lot lines, I understand more or
iess they are settled then. I also note that under the Master
Plan I fall under one acre zon4ng. I hame perfect cnnditions
here, one acre lots, wells, great drainage, no run-off into the
creek because of all the fragile sand. In the sand, things
grow very slowly mhd if I have to ~ns~mll a tra~Cic circle h~]f
the size of the Roanoke interchs~ge, I will destroy naturally
seeded trees, Bayberries, Beach Plums and Wild Grapes that have
taken up to thirty years to get a start. There is also a

question of a utility pole in the middle of this thing. The
cesspools are fairly close. If you look on the drawing the lot
nearest Westphalia Road has an odd looking thumb shaped cut from
the creek. That was caused by illegal run-off from Westphalia
Roadsoon after th~ dredging and fill in 1955 or i956. ~ight
now both sides of Westphalia Road still illegally run-off onto
our property, but that is another ~tter which I will discuss
with someone else. If I were to construct a traffic circle as
you suggest, I might have still even more run-off into the creek
and if you noticed Mattituck Creek last week-end, June 10th and
llth, it was as pretty brown and I haven't seen it that brown
since the 1955 hurricane. I do not want to contribute to this
run-off and I hope you feel the same way. This property
been in my f~mily since 1915. It is my roots and I plan to
retire here. I don't cut the beach grass, I don't pollute the
water and we ohide people who do'. I try to make mostly natural
plantings and the trustees require ~t no one shall fertilize
within 100 feet of the water or wetlands. I'll do it, no
problem. I am a native son, not developer with lawyers or
consultants. I have not appeared heze at any time to speed this
thing along even though you've been doing it since February of
1987. I also note that in the State Building Cede Rule 28QA
State and Town provides t~t ~here shall he provided a suitable
access road but no where does it say anything about a
turn-around or circle. We anticipate no problems getting in and
out of our property in ~he future nor did we have any problems
in the past. We also note that we have our approvals from the
Suffolk County Department of Health, the New York State of
Rnvironmental Conservation ~n place for some time. I thank you
for your time.
Mr. Ward: There really is no reason the turn- around has to be
excluded, we can leave it as a right-of-way, One of the
problems with the layout is the fact that the right-of-way is
taking away s~mre footage from the lots. It could be a
right-of-way ra~hmr t~mn a separate parcel and that way it could
just be property on the lot rather than have to be discounted.
Mr. Olmstead: The way I understand it, would jointly own the
right-of- way.
Mr. Ward: I think it might be cleaner just to leave the lot
lines through and have a right-of-way rather than dedicating out
the right-of-way because it would never be expmnded.
Mr. Orlowski: It will be on the board's next work session and
we will get back to you the end of next week.
Mr. Orlowski: Grange (former Church of the Open D~or)- Board
to discuss this proposal with the applicant. This proposal is
located on Beckwith Avenue at Southold.

Mr. Caminiti: I'm appea~ing for Walt G1assner on this Beckwith
property, the old church building of the Open Door and the story
goes back to when the church first assigned to sell the property
and to move. The church was appraised at $160,000, b~t because
of the poor market we were not able to sell that building~ At
that time, I decided to Buy that building and to move my office
from Ma~nRoadup to Beckwith. At the time, we thought we would
make it into an office building and I spoke to Victor and he
indicated to me that as long as I stayed out of the shopping
mall concept, he would allow on~ office and at that time all we
needed was the five parking spaces. I think the reasoning at
that time was, previously it was a meeting hall which required
thirty parking spaces. The building is a lovely building but it
lacks one thing, the building occupies most of the property. At
least two thirds of the parcel is occupied by the building
itself. The church received a special exception and a
certificate of occupancy, which at that time also would have
allowed, or should have provided thirty parking spaces.. It
operated in t~at capacity first as a grange and then as. bh~
church in a very high density area requiring thirty spacss. The
thought was well if you are going to go from~highdensity use to
low density use and you 0nly require five parking spaces, it
would be an allowably change in use. Because the renovation is
much to high and Walter then decided., he's a person of the
church, he purchased the build~n9 and received a cou~ order.
He purchased the building for $160,000. The problem nowvery
frankly, .we need your help, we don't ¥~ow what to do with the
building. Under the MaSter Plen it's bamletdmnmity and Walter
has in mind a office and~small accessory apartment. He had in
mind at one time a two family house, but that could~be too much
use for the septic system, b~t they would consider one offi~e
and an accessory apar~ment. The problem now though is, we have
been informed that in oEder to do that we need twenty parking
spaces. It is justphysically ~mposSible to put in any parking
there at all. I think b~icallyWhat we are doing is asking the
board if under the provisions of the town code if you could
waive that provision there is ~dd~t~onal parking withL~ ~00 feet
or right behind the Mattituck Auto Parts with access from
Traveler Street. It is really what we would like ar~l I
suggested to Walter to go before the beard ~nd at lea~t get some
ideas as to, even if he wants to resell it. I think Nancy has
some preliminary sketches and ideas she would like to submit to,
but basically, it is a hardship to the ~, there is-really no
place to put parking other than Traveler Street.
Mr. Ward: Is there public water there?

Mr. Ward: Is the Health Department still giving you a hard time
on the sanitarY?

Nancy Speetman: The Health Department, their major concern, we
talked to Bob Jewel, was that ior two apartments it exceeded the
allowed amount of water per day andthey would nnt allow the two
apartments.
Mr. Ward: What about enlarging the system?
Ms. Speelman: The area of the site is so small and so d~se
that they wouldn't accept it so we came back with possible one
apartment on the upper floor below that we would be less than
three h~nd~ed gallon~ a day.
Mr. Ward: Is the whole area served by public water?
Ms. Speelman: Not in every case. According to their records,
there is public water there but a lot of people try not to hook
up.
Mr. Ward: You have some wells in the area that are being
impacted?
Ms. Speelm~n: We felt that two apartments would be least amount
of parking, least amount of parking on ~he Street. We thought
that was the best proposal but now we've come into a problem
with the Health apartment so we are looking for alternative uses
and let me show you. Here,s a survey of the property, he only
cmn put on four parking spaces. To do even four parking spaces
we have back out onto Travelers and it is tiqht. Three is fine
for realistic. There is a drop, a substar~tial drop towards this
part of the ~ildlng from Travele-Es, it ha~ to be filled.
Mr. Ward: Is the building line low as well as the floor line in
the back?
Ms. Speelman: The churmh used it as a play gro~n~ for kids so
it can be filled and used for parking. It is a small site, the
actual area of the site is about 4600 square feet. Allowable in
this district is 20,000 so we are far below the minimum lot.
This is part of our problem. What we are thinking of and this
is just basically diagrams showing a one bedroom apartment on
the uppe~ level which is the act~,at old m~ction, the old
grange. Using that, this area is a one story in the rear and
then using the entire remaining portion of the building for
office space. This proposal yieldm 17 spaces, one for the upper
apartment and about 1600 square feet of office area so we're
around 17 spaces. You can see where the side is we just can't
do it. Mr. C~m~n~ti is pointing out that within ~00 feet, I
think it is almost 250, there is a lot that is being teased by
the town so potentially that cla~,me in the parking would be some
relief for us az a wmiver.
Mr. Latham: Is the town just leasing it?

Ms. Speelman: That's what we've been told by the Highway
Superintendent.
Mr. Ward: Along Traueler and Beckwith, what kind of parallel
parking capability is there?
Ms. Speelman: There is some, I don't think it is actually
curbed at this point. Beckwith, a lot of people park on
Beckwith. Traveler Watchm~n is across the street, there is a
lot of activity here.
Mr. Mullen: They park down at the railroad station. There is
one advantage ~re. It's a one-way street too.
Ms. Speelman: Yes, Beckwith is one-way.
Mr. Ward: Beckwith is one way, but I think there is some
d~scretion about making Traveler one-way East.

That exits out onto Main Road right behind the phaz~cy. Oh,
that's right, she had that subdivided, The old post office.
Mr. Orlowski: Why don't you give us the list of uses that you
are considering.
Mr. Ward: The rational for what you are doing, numbers that you
feet.wok~ldbe a practical number of use o~ cars for this kind of
business.
Ms. Scopaz: Would there be a possibility of perhaps curbing or
place some curbing around Traveler Street so thatthere is a
possibility of providing some on street parking there.
Mr. Ward: Maybe you can check the actual width of Traveler,
maybe we will be half way surprised and find a few more feet.
