Richie Latham Town Planner Valerie Scopaz Planner Melissa Spiro Jane Rousseau, Temporary Secretary Absent was: Member Kenneth Edwards Mr. Orlowski: Good evening, I would like to call this meeting to order. First order of business is the public hearing on final maps dated as amended February 27, 1989 of Karl Baunach. This is a lot line change located at Mattituck. SCTM ~1000-t41-I-34 & 36.1. We have proof of publication in the Suffolk Times and also the Traveler Watchman. At this time everything is in order for a final hearing. I'll ask if there are any objections to this subdivision? Hearing none, are there any endorsements of this subdivision? Karen Stretz: Hello,-I'm from Wickham, Wickham and Bressler. W~ have complied with all the ~equirements of the Planning Board. This lot line change application is fairly simple where if the application is approved ~the size of this whole lot will be increased and the shape of the larger lot will in conformity with the other lots in the area. We haven't been able to succeed in having any response to our letter. I wondered at what point we could expect the board to respond? This minor subdivision is located at Mattituck. SCTM $1000-114-7-13. The Suffolk County Planning Commission has denied this for their reasons which I'm sure you're familiar with. I have to abstain from voting because I'm family, which means we don't have enough here tonight to override the county, so we'll have to hold this one over. CHANGES OF ZONE: Mr. Orlowski: Thomas Thompson - Board to make a recommendation to the Town Board on this change of zone from "A-C" Agricultural-Conservation District to "L-I" Light Industrial District. This property is located on the northerly side of County Route 48, east of Cox Lane at Cutchogue. SCTM %1000-84-1-25.3. What is the pleasure of the board? Mr. Mullen: We should deny it because its not in conformity with the Master Plan. Mr. Ward: Also Mr. Chairman, in the iim,ediate vicinity large tracks of land have been currently rezoned with the Master Plan for this particular use. I believe that until such time as the current zone in place is exhausted we shouldn't consider additional changing any additional zones in that area at this time. ' SOUTHOLD PLANNING BOARD PAGE 11 APRIL 3, 1989 Mr. Mullen: I must refrain from commenting on this application for the possible conflict of interest. Mr. Orlowski: What is the pleasure of the board? Mr. Ward: I would offer a resolution for approval subject to several conditions. One, that the Highway Superintendent be informed of the project for his review and comments on possible drainage in the street adjacent to this property. Secondly, that all lighting fixtures whether they be on the building or on site be submitted for our approval for height, intensity and shielding. Third, the asphalt pavement be scheduled on the plans to show a two inch top course and either four inch base under which would be six inches of soil prepared base or two inch top and six inch blend base whichever the applicant prefers to use. Subject to those things I feel we could approve the plan. Mr. Orlowski: O.K., basically, that is what the building inspector also said. Mr. Mullen: I'll second it. The applicant has asked that the Planning Board rescind the resolution. Mr. Ward: There is just one condition in that resolution. Mr. Orlowski: Well we could rescind the resolution that was made, which was subject to curbing and drainage brought to proper standards upon future development. This major subdivision is on 14.723 acres located at Peconic. SCTM ~1000-86-4-6. We have proof of publication in the Suffolk Times and also the Long Island Traveler Watchman and at this time everything is in order for a preliminary hearing~ I will ask if there are any objections to this subdivision? Hearing nonet are there any endorsements of this subdivision? Mr. Henry Raynor: Mr. Chairman, I represent Wild Oats subdivision. Th~s agency granted sketch approval back in November 1986 and in %he interim we have submitted to your board the following n0n-juristiction letters by b°th the Southold Town Trustees and the New York State Department of Environmental Conservation. We have amended the map before you three times at the boards request. We have alS0 received the Suffolk County Department of Health Services approval on which we will affix the Certificate oC Occupancy on the final map. We have revised the drainage in conformity with Sidney Bowne, your engineers, and also revised and complied with Southold Fire District commissioners request for fire wells. I would requestthis map be approved since it is in compliance with all the agencies responses as well as section 106, the subdivision regulations. I wouldalso request that the Planning Board declare itself lead agency under this action and in response, as all agencies have already given their input to your board, a negative declaration be created. Thank you. Mr. Orlowski: We did declare lead agency in March. Mr. Raynor: Would you send me a copy of that? I have nothing in my file. Mr. Latham: Question about the use of the road, there are no roads. Mr. Orlowski: Mr. Jacobs sent a letter that he has no concern as long as he has a co~mL~on driveway and we also asked him about the curb on Leslie Road and Indian Neck and he has no problem with leaving it just as it is. Mr. Mullen: No comment. Mr. Ward: No conm.ent. Ms. Scopaz: No comment. Mr. Orlowski: Being no further questions, I'll declare this hearing closed. Thank you for coming. Mr. Orlowski: Next we have Andreas Markakis: Board to review this site plan for a food establishment located on Boisseau Avenue, Southold. Being the site plan does not have sufficient parking, that is basically our biggest problem right here for a restaurant, there is insufficient parking. Does the board have any other conunents to make on this? Mr. Ward: Mr. Chairman, the parking that is shown doesn't work. Mr. Orlowski: No. There basically is insufficient parking. What is the pleasure of the board on this site plan? Mr. Mullen: I recolm,end denial because of insufficient parking area. Mr. Ward: Second. Mr. Orlowski: O.K., motion made and seconded. Any questions on the motion? Mr. Markakis? Mr. Markakis: Mr. Chairman, Gentlemen, I have been trying for four years to establish this business in this place, trying to supplement my family in the best way I can after my disability. The business use has been approved by this same authority, I have an approval for five parking spots and all I am asking, according to the law is to be allowed to use the existing parking Spots. That is all I am asking. There are certain items which I feel are in negligence, there are certain items I feel are in discrimination and in due time I am going to take action on those. At this time, what I'm asking is what I'm allowed to do according to the law. Thank you. SOUTHOLD PLANNING BOARD PAGE 94 APRIL 3, 1989 Mr. Orlowski: The site plan approval is for a printing press, not a restaurant. Mr. Markakis: That does not remove the five places that are there. The five parking spots. This place has been used many years, you have many weddings and receptions, VFW and so on and so forth. Last August I donated the hall to t~e Helenic American Association, there were cars there for over eighty people, I do not know where they parked . Now, what I am asking, for fifteen seats in that establishment, fifteen seats to allow me to sustain my family. I'm paying taxes in this place for twenty-six years, I'm paying taxes f r this building for four years now that is vacant. These taxes, part of these taxes support this establishment here and pay for your expenses also. I'm not asking for any luxury, I'm asking to help me in accordance with the law to establish what I can do there and when we are talking about the law and you know very well that the law fits the needs of humanity, the law changes from zero, (inaudible) minutes after midnight for twenty four hours the law changes and humanity trying to fit the necessity of human beings to that score of the law. I'm not asking for anything illegal, I'm asking to do exactly what the law says. If I applied as I should a few months ago, I should be entitled to get twenty-four seats. I have the approval, I have the requirements of the Building Department which I complied with, I spent all my fortune to put all the cesspools that the Health Department asked me and now you come and tell me you deny my application? Why? Put it in writing and I'll take the next:step. Mr. Orlowski: What is the pleasure of the board? I have a motion made and seconded. Mr. Ward: I think we should hold it over to the next meeting and see where we are with the five parking spaces. I didn't realize we had five approved parking spaces. Mr. Markakis: One addition if I may, I thank you very much for the remark. Next dooris Wayside Market. That~eStablishment throUgh the years has ekpanded. (Inaudible) The help of the immediate environment there that establishment diSmantled the sidewalk from my place to the stop sign at the street. They dismantled the sidewalk, they put a sign on the wall, parking for customers only. When I addressed myself to the board if you remember, the entire board and I stood here with a scale. On this side Mr. Murphy, I put human life, public safety, what is the price you put on the other side of the scale. I'm wasting three years to get an answer to my question. There are many accidents at that intersection. They do not want to elevate the traffic congestion and here I come asking for a legality not an illegality and I'm faced with what? I beg you to consider my position, to consider my status, to consider everything in the case and please give the right answer. Please put it in writing so I know what to do next. SOUTHOLD PLANNING BOARD PAGE 15 APRIL 3, 1989 Mr. Laths/n: I second Dick's motion. Mr. Ward: I think we should just look at it again. Mr. Orlowski: O.K., we'll hold it over. DISCUSSIONS: Mr. Orlowski: Marina Bay Club - Board to discuss the status of the Final Environmental Impact Statement. SCTM ~1000-227-8-18. We sent a letter to the applicant and the FEIS cannot be completed because the site plan does not conform to the new zoning code. They have to revise the site plan and then we will review it in accordance with the findings set forth in the FEIS. These revisions may necessitate an additional supplement or amendment to the Draft Environmental Impact Statement. Does the board have any questions or comments on this? Mr. Ra!rnor I believe you're representing the applicant. Mr. Raynor: Yes Mr. Chairman, I understand that this is a memo that you received from Szepotowski Associates and all it would request to clarify the position of the board would be those specifics that Szepotowski claims the new ordinance varies from the old ordinance. I discussed this at length with the Assistant Town Attorney as to where many of these site plans sit in the spectrum and until we have some specif~ics I would find it very difficult to address what you are asking us to do. I would also ask the board to consider that this site plan has been four years in process. Mr. Orlowski: Unfortunately, it does put a lot of site plans in this predicament and the Town Attorney has advised us that everything now has to confoim to the new zoning code. Mr. Ra!rnor: The Town Attorney said that there would be the least disruption as possible with all those applications that are already in the process and all I'm asking for is that if there are variances which are stipulated by Szepotowski, would you please give us a list so that we may review them. Thank you. Ms. Scopaz: There was no listing by Szepatowski of what was missing so to speak they simply said that because its not in conformance that it should be brought into conformance. Mr. Orlowski: If Szepatowski doesn't have a list we'll get you a list. Mr. Raynor: Then the board is going to produce a list on behalf of Szepatowski? Mr. Orlowski: Have you read the new site plan elements? Mr. Raynor: Yes I have several times. Mr. Orlowski: Do you see any big difference there? Mr. Raynor: Very little. Mr. Orlowski: O.K., We'll point out things that we see a difference. Mr. Raynor: Thank you very much. Mr. Orlowski: Does the board have any other co~ents to make? Hearing none. The only thing I have left on my agenda are field inspections. Mr. Latham and myself went out this week-end and we inspected Founders Village and everything was in place except for the final seeding of the grass. Did you see anything else Mr. Latham? Mr. Latham: No. Mr. Orlowski: I think we can make a reco, m~endation to the Building Department that a C.O. be issued for Building 5 or 6, I don't know, both of them need seeding around them. We have a letter in the file that the seeding will be completed by May 1, so I doubt very much that they are going to leave it the way it is. What is the pleasure of the board? Mr. Latham: So moved.
