The Southold Town Planning Board held a regular meeting
on Monday, January 23, 1989 at 7:30 p.m. at the Southold Town
Hall, Main Road, Southold.

Mr. Orlowski: Good evening, I would like to call this meeting
to order. First order of business ~s The W. oods At~Cucchogu . This
is a public hearing on the final maps dated as amended on
September 19, 1988. This major subdivision is on 29.54 acres
located at Cutchogue. Publication in Suffolk Times & Traveler
Watchman. At this time everything is in order for a final
hearing. I'll ask if there are any objections to this subdivision?

Mr . Dan Ross: I would like to address the board on something
in respect to this. Should I wait until the end of the meeting?
Mr. Orlowski: No, go ahead.
Mr. Ross: It's with respect to the Planning Board's requirement
of a site plan in respect to a special exception that was granted
by the Zoning Board of Appeals. We would request that the site
plan be waived in this case. The work that is to be done under the
special exception is all going to be indoors. It is assembling
antique cars and ~here is going to be no changes to the outside,
no changes at all to the building. Our first request would be
that site plan approval be waived. There is an economic considera-
tion, there is going to be a lease in affect. The landlord, as
soon as we get this approval, will start working and there is a large
amount of money a week that is in consideration. However, if the
board feels that it doesn't wish to waive, I bring to the boards
attention the lot line change application that is before this
board, and it wouild seem that it would be a better approach to
have the site plan submitted with respect to that application,
rather than this one, and that way the board would still have its
site plan review, and would allow the tenant to get going in what
he wants to do. In his presentation before the Zoning Board of
Appeals he explained that he would be the only employee. There
would be no outside work except one truck coming in from time to
time. It's not manufacturing cars in the sense that you think
about in a General Motors plant. It's mostly put together. He
lust gets it and puts the fenders on these no painting or anything.
We would request that the site plan, the requirement of site plan
on the special exception be waived and if the board so desires
required on the lot line change.
Mr. Orlowski: The only thing on this, have you been to the
Building Department?
Mr. Ross: We received a disapproval.
Mr. Orlowski: And went to the Zoning Board?
Mr. Ross: We have the Zoning Board's approval. We don't have
it in writing yet.
Mr. Ward: Did they give you conditions?
Mr. Ross: It may be. I don't have the w~itten resolution.

Mr. Orlowski: Did the Building Department on their denial
also say you have to have site plan approval?
Mr. Ross: Yes. We're not questioning that. Site plan approval
with a special exception there is no doubt ~it be required. We
would ask~that it be waived and I'm not sure if site plan
approval is necessary with respect to lot line changes. We
would be willing to submit it. I think from a planning view-
point it would be better considered.
Mr. Orlowski: I think the main one we would like to see right
now is an~kas- built, what's existing right there.
Mr. Ward: Identify the parking and how that relates to the
coverage of the building.
Mr. Ross: The actual parking is on the map that exists.
Mr. Orlowski: We have nothing here to even say go ahead, we
don't even know what it looks like.
Mr. Ross: There is adequate parking, the lines aren't on
the parking area but I just came from the site and its an
extensive asphalt area. I believe in a letter which we
indicated the calculations that would be, that I don't know
how many spaces it was seven or fourteen. It would be
a simple matter to put lines in the parking area. Its not
a case where there will be many employees. The tenant who
is going to be doing the work represented to the Zoning Board
of Appeals that he was going to be the only employee.
Mr. Latham: Is the parking lot in good condition?
Mr. Ross: Its solid, it's 01d.
Mr. Mullen: You won't be using the parking lot for your operational
situation for your cars that you are going to be working on.
Mr. Ward: There is no outside storage?
Mr. Ross: No
Mr. Ward: It would seem to me that you could file with us,
showing the indication of the cars, you g&ve us a letter,
don't believe we would be in a position to want to waive the
site plan requirement but I think you"re talking about a very
simplified plan at this point. It is primarily a parking
relationship to the interior use.
Ms. Scopaz: May I just make a suggestion. We have a procedure
set up for requesting the board to waive site plans which have
been out. The applicant has to submit a written letter to the
board with an actual site plan or a written description why he
feels he doesn't need the site plan Sox we have that information

before you make the decision based on that.
Mr. Ross: Again, I am not asking the board to waive the site
plan, I'm just asking'them to consider it with respect to the
lot line.
Mr. Orlowski: Well we'll consider it but if you precede with
a "as built" site plan we can probably speed things up for you
by the next meeting.
Mr. 0rlowski: Next order of business is Calvin Rasweiler -
public hearing on the preliminary maps dated as amended
April 21, 1988. This major subdivision is on 55.4896 acres
located at Laurel. SCTM ~1000-129-1-1. After publication
in the Suffolk Times and the Long Island Traveler Watchman
at this time everthing is in order for the preliminary hearing.
I'll ask if there are any objections to this subdivision?
Hearing none, are there any endorsements of this subdivision?

Mr. Danowski: I would like to comment that we have met with the
planning staff and we would be in the final road drainage plans
be doing mountable curbs as opposed to grass swales and we re-
cognize that the policy that currently exists,so we'll take care
of that amendment. We'll also provide for emergency access on
Railroad Avenue,which was one of the considerations,not improve
emergency access on Railroad Avenue which was one of the con-
siderations, not improve emergency path and I continue to pitch
for some endorsement in the future that large lot open space
areas with restricted easements on them because Mr. Rasweiler,
with regard to two of the lots that are adjacent to the open
space area would intend to keep those in ownership and not sell
them and continue to use that open space area for agricultural
and nursery stock. So the very same map can be obtained with
those big open space area owned by the lot owners with regard
to those two lots. With that said, hopefully that can be
accomplished in the future.
Mr. Orlowski: O.K. Any other endorsements of this subdivision?

information pertaining to this subdivision that would be of

Mr. Orlowski: Next we have Eileen & Edward Deutsch - Board
to review the bond estimate datged October 13, 1988 and to
make a recommendation to the Town Board regarding this bond

Mr. Orlowski: North Ridge Estates - Board to review the
Suffolk County Planning Commission report dated November 18,
1988. Board to review the Engineer's report dated December 8,
1988. Board to make a determination under the State Environ-
mental Review Act. This major subdivision is on 22.46 acres
located at Orient. SCTM ~1000-18-2-34. There are some
questions on this report, I think without reading the whole
thing that we should sendi~.~e~ ~to our en~gi~e~r,~he~r-e~seems
to be a discrepancy between~ th~ Planning 'commi~s~o~
engineer. We will send a copy of this o~er to the applicsnt,
and some o£-these I believe we will override on the final.
Mr. Ward: I think before we take any action we should get
it resolved as to the reaction from the developer and the
engineer.

public hearing on the preliminary maps dated as amended June 1,
1988. This major subdivision is on 30.3565 acres located at
Cutchogue. SCTM ~1000-95-4-7 & 14. Publication was in the
Suffolk Times and also the Traveler Watchman. At this time
everything ms in order for a preliminary hearing. Are there
any objections to this subdivision? Hearing none, are there
any endorsements of this subdivision?
Peter Danowski: We'll change our drainage to comply with
your recent policies and mountable curbs. We've read the
report from Sidney Bowne and come in earlier and discussed
it with him, we have no objection of doing it the way you
want and the same thing with the large lot open space.
With the policy changes we would rather make it a_ large
lot.
Mr. Orlowski: Any other endorsements of this subdivision?
Hearing none, anyone out there neither pro nor con but may
have information pertaining to this subdivision that would
be of interest to the board? Any question from the board?

Mr. Orlowski: Peccnlc Trails - Board to discuss this application
with the applicant. This major subdivision is on 97.1292 acres
located at Peccnlc. SCTM ~1000-74-1-38.
Unidentified person: It's 44.7 acres.
Mr. Orlowski: What would you like to do?
Dave Saland: Well I submitted a compromise plan and you know
bearing in mind the whole issue about the water shed committee,
we would have some open space to start clustering the lo'ts,
trying to protect the woodland and then two other five acre lots
towards the end here and then open space again, i brought my
neighbors from the north end who are willing to testify to the
fact, in a letter, that they like this plan and that they feel
if you cluster all the lots to the north, that you're going to
impact on their water table and cause salt water intrusion, and
that they think for whatever reasons, they state that they can
live with this. ks far as the developers go, we feel we are
moving as far north as we can and that we tried to answer some of
the complaints that Valerie has had and work with you as much as
we could as far as the water shed area or the tentative water
shed area.
Mr. Ward: Isn't that identified by this?
Mr. Saland: Except its a proposal that isn't going anywhere.
Mr. Ward: Our policy has been to cluster north of that, because
of the, mainly because of that as well as the keeping the impact
off of Middle Road. We have been pretty consistent with every-
body who comes
Mr. Satand: Well if you want to write that up and that's the
boards decision.
Mr. Latham: This is no% open space its just two five acre lots.
Mr. Saland: Correct. I would like a letter to that affect if
you are going to keep to that overall policy that he keeps
talking about. Whatever we can get, my partners are ready
to strangle my neck as it is. I think they will take what
ever they can get. I would like the letter stating the
reasoning. Also, my neighbor put a letter on record as far
as their complaints about forcing me to cluster and what I am
doing to their water shed area and we'll take it from there.
This is the compromise that everyone I hope could live with.
Sophia Greenfield: I represent the voices and sentiments of
four adjoining property owners in Cabots Woods, which is the
minor subdivision directly north of this proposed subdivision.
We have no business interest or involvement with the Peconlc
Trail subdivision or the developers. This letter expresses our
concerns and if you give me a moment, I will read it and hope-
fully it will clarify our feeling.

Dear Planning Board Members:
We, the undersigned owners of four prope'r~ies adjacent to,
and potentially affected by the proposed subdivision of the land
directly to our south (S.C. Tax #1000-74-1-38), wish to express
our concern over the design Df the subdivision, and to make the
Planning Board aware of potential problems that are likely to
arise should the major thrust of the development be pushed to the
north end of the property.
Of major concern to us is the potential drain on the supply
of good, potable ~ater. The further south one goes on the
property, the greater the supply of water. However, as you get
nearer to Long Island Sound, the .aquifer g~ts thinner and thinner
and the potential for salt water intrusion gets greater.
This is not just theory. This past summer, on August 18th
to be exact, on the waterfront parcel directly to the north,
Sophia Greenfield inadvertently left a hose running overnight
with the nozzle set on a misting position. The result: the next
morning the water was brackish and completely undrinkable. It
took three days, with no interim drawing of any water whatever,
for the well to be drinkable again.
Emil & Jenny Pupecki, caretakers for the parcels along the
Sound immediate to the east of us report that for the last 20
years, those properties have had intermittent problems with salt
water intrusion.
It is our concern, that any radical increase in water demand
near to the area where the aquifer has already shown itself to be
fragile, will result in unpotable water for all. The further
north development is pushed, the greater the chances of that
happening.
We therefore request that the Planning Board seriously
consider the latest map proposed for the "Peconic Trails"
subdivision, (dated September 1988) as the most acceptable design
proposed. This proposal not only provides for 10 acres of
unbroken meadow to act as a natural buffer and watershed on the
north end, it also provides for an unbroken 8 acre scenic buffer
off Route 48 as well, and clusters housing development to
minimize negative environmental impact.
And since th~ developer has indicated that he would consider
covenanting the woodland against removal of trees, (except for
construction purposes) it limits developmen~ of the woodland as
well. Preserving this woodland provides for, as the East
Hampton Town Board put it: "...stabilization and preservation of
soil; maintenance of watershed areas; absorption of air pollution
and production of oxyqen; establishment of natural barriers to
noise and habitats for wildlife; and creation of °a desirable
aesthetic quality which is a key factor in the ~own's existence
as a rural resort community."
We feel that this map provides the best compromise solution
for the development of this parcel, and we urge the Planning
Board to accept it.

Mr. Orlowski: O.K.. Does the board have any other comments?
Mr. Ward: We have a work session, maybe we can go over it.
Mr. Preston: I am a builder in the Town of Brookhaven and one of
the partners in Peconic Trails. I entered into this agreement with
the other general partners to get the plans approved. I was at
the August meeting that you had and I didn't say anything at that
time because I felt that the board was acting in good faith. It
was said by the board at that time that they were going to make
a physical inspection of the property. My understanding is that
this one inspection was just made recently, like four or five
months ago, which disappoints me a little bit. Also, at that
meeting nothing was mentioned about maintaining a certain previous
status on this watershed area. I just hope you will consider
our proposal. Thank you.
Mr. Orlowski: Alright, there could be a water problem up there
from what we understand now. Have you had any results from your
water test?
Mr. Preston: Yes, when I purchased the property I did five or
six test wells and they were fine. In fact, I didn't have
problems with any one of them.
Mr. Ward: Do you have locations of them?
Mr. Orlowski: They are on the map here. Four test wells right
up this middle piece. Do you have that information?
Mr. Preston: No, we don't think there was a request for any
reason. We did four wells right in the middle and we anticipated
the second would be those four wells in that area or five.
Perhaps Mr. Ward is objecting to the fact that, as he points to
this that everything would be north of it, it was my proposal
that we could live with one or two less lots but it would be
awful tight.
Mr. Orlowski: How come you didn't make these five acre lots?
Is there any reason for that?
Mr. Preston: If you left the minor subdivision roads alone,
perhaps I could talk to you about roads, we could knock it out
of the box that way. Not only for myself but for all the
developers. Oriqinally, I did a major in one section and then
came back and di~ a minor in the second section, maybe we could
compromise that way. All I know is my partners want to get off
the dime.
Mr. Orlowski: Lets take a look at the test results for the
water and we will get back to you.

Mr. Orlowski: Next we have Hiawatha's Path - Board to make
a determination under the State Environmental Review Act.
Everything is in order for a negative declaration at this
point and time, this is affordable housing lots that the
town is proposing.

any endorsements of this subdivision? Any questions from
the board? Mr. Mullen, Mr. Latham, Mr. Ward, Ms. Scopaz.
All answered none.
Mr. Grlowski: No further questions, I declare this hearing
