THIS INDENTURE, made the 22nd day of January, Two Thousand Eight
BETWEEN
MARGARET WOODS, residingat 155 Seawood Drive, Southold, New York 11971,
party ofthe first part, and
JUDITH A. RESCH, residing at 725 William Street, Boonton Tusp, New Jersey 07005, and
MAUREEN P. GRECO, residing at 7 Valley Road, Clifton, New Jersey 07013,
party of the second part,
WITNESSETH, that the party of the first part, in consideration often Dollars and other valuable
consideration paid by the party oftbe second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns oftbe party, of the second part forever,
ALI. THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate,
lying and being in the Town of Southoid, County of Suffolk and State of New York, known and
designated as Lot Number 31 on a certain map entitled "Seawood Acres, Section One, situate at
Bayvicw, Town of Southold, Suffolk County, New York" and staveyed January 19, 1956 by Otto
W. Van Tuyl & Son, Licensed Land Surveyors, Greenport, New York, and filed in the Office of
the Clerk of Suffolk County on the 26~h day of June, 1956, as Map Number 2575, which said lot
is more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of Seawood Drive, 100 feet northerly from its
intersection with the northerly side of Midland Parkway;
RUNNING THENCE from said point of beginning, North 63 degrees 21 minutes 00 seconds
West and along the northerly side of Lot Number 32 on said map, 125 feet to land now or
formerly of Seawood Acres, Inc.;
THENCE North 26 degrees 39 minutes 00 seconds East and along the easterly side of the last
mentioned land, 100 feet;
THENCE South 63 degrees 21 minutes 00 seconds East and along the southerly side of Lot
Number 30 on said map, 125 feet to the westerly side of Seawood Drive;
THENCE South 26 degrees 39 minutes 00 seconds West along thc westerly side of Seawood
Drive, 100 I~ct to the point or place of BEGINNING.
BEING AND INTENDED 'FO BE thc same premises conveyed to the part3' of the first part by
deed dated April 22, 1993, and recorded April 29, 1993, in the Office of the Suffolk County
Clerk in Liber 11627, Page 116.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as she may choose, to change her remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or bom here',ffter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of thc first part may direct
and appoint during her lifetime by properly written and acknowledged instrument, and recorded
prior to death, making specific reference to this power ofappointment. The party of thc firsl part
may not appoint herself, her estate, her creditors or the creditors of her estate, under any
circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, thc heirs or successors and assigns of the party of thc second part forever.
AND thc party of the first part covenants that thc party of the first part has not done or suffered
anything whereby thc said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
thc party of thc first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying thc cost
of the improvement and will apply thc same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party ofthe first part has duly executed this deed the day and year
first above written.
