WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the sec9nd part, does hereby grant and release unto the party of the s~cond part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon erected, situate, lying
and being m~lIl1 at Mattituck, Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a point on the westerly side of Breakwater Road a/k/a Luthers Road, distan
186.37 feet as measured southerly along said road from the southerly end of a curve
which connects the westerly side of Breakwater Road with the southerly side of Stanley
Road, said point also being where the southerly line of lands shown on Subdivision Map
of Sunset Knolls, Filed Map No. 5023, intersects the westerly side of Breakwater Road;
RUNNING THENCE from said beginning point along the westerly side of Breakwater Road,
South 22 deg. 14 min. 00 sec. West, 288.07 feet;
THENCE North 88 deg. 47 min. 00 sec. West, 680.72 feet to the easterly line of lands
shown on Subdivision Map of.Sunset Knolls, Section 2, Filed Map No. 5448;
THENCE along said line, North 11 deg. 07 min. 00 sec. West, 300 feet to a monument;
THENCE along the southerly line of lands as shown on Subdivision Map of Sunset Knolls,
Filed Map No. 5023, the following two courses and distances:
I (1) South 88 deg. 47 min. 00 sec. East and through 2 monuments, 406.40 feet;
(2) South 85 deg. 39 min. 00 sec. East, 442.40 feet to the westerly side of Breakwater
Road, the point or place of BEGINNING.
BEING and intended to be the same premises conveyed to grantor by deed dated July 2,
1998 and recorded July 13, 1998 in Deed Book 11904 at Page 203, in the Suffolk
County Clerk's Office.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the 'party of the first part, in compliance with Section 13 of the Lien Law; covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost oftlle improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
