Richie Latham Richard Ward Kenneth Edwards Mark McDonald Valerie Scopaz, Town Planner Melissa Spiro, Planner Holly Perrone, Secretary Mr. Orlowski: I would like to call this meeting to order. First order of business at 7:30 p.m. is a public hearing on the final subdivision of Thomas MacKenzie, Ram Realty and Ralph and Ellen Petuso. This minor subdivision is for four lots on nine acres located at Platt Road in Orient. SCTM ~1000-18-6-26. Mr. Orlowski: We have proof of publication in both the local papers and at this time everything is in order for a final hearing. I'll ask if there are any objections to this subdivision? Hearing none, are there any endorsements of this subdivision? Hearing none, is there anyone out there neither ~ pro nor con but may have information pertaining to this subdivision that would be of interest to the board? Hearing none, any questions from the board? Board: No questions. Mr. Orlowski: Being there are no further questions, I'll entertain a motion to close the hearing. Mr. Edwards: So moved. Mr. McDonald: Mr. Chairman, I would like to make a motion. WHEREAS, Ralph and Ellen Peluso, Thomas MacKenzie and Ram Realty are the owners of the property known and designated as SCTM #1000-18-6-26, located on Platt Road in Orient; and WHEREAS, this minor subdivision, to be known as Minor Subdivision for Thomas MacKenzie, Ram Realty and Ralph and Ellen Peluso; is for four lots on 9.1456 acres; and WHEREAS, the Southold Town Planing Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Declaration on August 5, 1986; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on June 25, 1990; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and be it therefore, RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final survey dated June 12, 1986. I don't think there is anyone here representing the applicant tonight so I think I'll entertain a motion to keep the hearing open. Mr. Ward: So moved. Mr. Latham: Second. RESOLVED to extend the time period in which the Planning Board must take action after the final hearing for an additional 49 days. The extension will run until August 13, 1990. RESOLVED that the Southold Town Planning Board grant sketch approval on the map dated June i, 1990 with the. following conditions: The located of the LILCO poles must be noted on the map. In addition, authorization from LILCO allowing the proposed right-of-way to be located within the LILCO right-of-way must be submitted. 2. The drainage calculations must be revised for a 6" rainfall. Is it going to be the decision of the board that 6" rainfall is (a) subject to the subdivision regulations which has always been common and (b) are the particular lots described on commercial property going to be PLANNING BOARD 7 JUNE 25, 1990 held in addition to that drainage which is necessary which has been 2" prior to this site plan? Mr. McDonald: Your question isn't the 6" for the subdivision, your asking ...... Mr. Raynor: I'm wondering if we are going to be hit with an additional 2" on top for each site plan? PLANNING BOARD 9 JUNE 25, 1990 RESOLVED to adopt the June 7, 1990, Suffolk County Planning Commission report with the following amendments (numbers correspond to numbers in report): 1 & 2. Are to remain as written. Is to be omitted. Is to be omitted. The Planning Board is requiring that a Homeowner's Association for the open space areas be filed prior to any endorsement of the map. WHEREAS, James Dully is the contract lessee of the propertyknown and designated as James Duffy Restaurant SCTM 1000-121-2-2, located at County Road 48 and Sound Avenue in Mattituck; and WHEREAS, the Southold Town Planning Board, pursuant to the State EnviromentalQuality review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Declaration on June 25, 1990; and WHEREAS, the site plan known as James Duffy Restaurant will supersede the site plan for Walter and Marilyn Gata approved on March 14, 1986; and WHEREAS, only phase one as shown on the map will be built, future proposed buildings will be subject to a future application; and be it therefore, PLANNING BOARD 13 JUNE 25, 1990 RESOLVED, that the Southold Town Planning Board grant conditional final approval, and authorize the Chairman to endorse the final surveys dated May 13, 1990 subject to the following conditions. WHEREAS, the Site Plan approved by the Planning Board on April 3, 1989 contained the following condition, a lighting plan for all outside light fixtures, including the lights on the building, must be submitted for review before the issuance of a building permit; and WHEREAS, a lighting plan was received on April 11, 1990 and approved by the Planning Board on June 6, 1990; and now therefore, be it RESOLVED that all conditions contained in the site plan approved by the Chairman on April 3, 1989 have been met, and a copy of the lighting plan has been officially affixed thereto. I spoke to Mr. Cuddy today and we're asking if you would jUst give us a temporary approval of the site plan on the premise that the Board of Health would be coming this week. WHEREAS John Simicich Jr., is the owner of the property known as designated as Mattituck Hills Wineries, SCTM ~ 1000-121-1-p/o-1 located at Sound Avenue and Bergen Avenue in Mattituck and WHEREAS a formal application for approval of this site plan was submitted on December 7th, 1989 and WHEREAS on March 29th, 1990 the Zoning Board of Appeals gave a special exception for a winery and PLANNING BOARD 15 JUNE 25, 1990 WHEREAS on May 24th, 1990 the Planning Board took lead agency and granted a negative declaration on June 25th, 1990 and WHEREAS all the requirements of the site plan regulation for the Town of Southold have been met; be it therefore; RESOLVED that the Southold Town Planning Board grant conditional final approval and authorize the chairman to endorse the final surveys dated May 20, 1990, subject to fulfillment of the following conditions: Ail conditions must be met within six months of the date of this resolution. 1. Submission of a signed sketch showing dimensions. e Compliance with Sidney Bowne's drainage report dated June 21, 1990. 3. Health Department approval. Mr. Latham: Second.
