Mr. Orlowski: I would like to call this meeting to order.
First order of business at 7:30 p.m. is a public hearing on the
final subdivision of Thomas MacKenzie, Ram Realty and Ralph and
Ellen Petuso. This minor subdivision is for four lots on nine
acres located at Platt Road in Orient.

Mr. Orlowski: We have proof of publication in both the local
papers and at this time everything is in order for a final
hearing. I'll ask if there are any objections to this
subdivision? Hearing none, are there any endorsements of this
subdivision? Hearing none, is there anyone out there neither ~
pro nor con but may have information pertaining to this
subdivision that would be of interest to the board? Hearing
none, any questions from the board?
Board: No questions.
Mr. Orlowski: Being there are no further questions, I'll
entertain a motion to close the hearing.

WHEREAS, Ralph and Ellen Peluso, Thomas MacKenzie and Ram
Realty are the owners of the property known and designated as
SCTM #1000-18-6-26, located on Platt Road in Orient; and
WHEREAS, this minor subdivision, to be known as Minor
Subdivision for Thomas MacKenzie, Ram Realty and Ralph and Ellen
Peluso; is for four lots on 9.1456 acres; and
WHEREAS, the Southold Town Planing Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
August 5, 1986; and
WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
June 25, 1990; and
WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and
be it therefore,
RESOLVED, that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey dated June
12, 1986.

The located of the LILCO poles must be noted on
the map. In addition, authorization from LILCO
allowing the proposed right-of-way to be located within
the LILCO right-of-way must be submitted.
2. The drainage calculations must be revised for a
6" rainfall.

of the board that 6" rainfall is (a) subject to the subdivision
regulations which has always been common and (b) are the
particular lots described on commercial property going to be

WHEREAS, the Southold Town Planning Board, pursuant to the
State EnviromentalQuality review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
June 25, 1990; and
WHEREAS, the site plan known as James Duffy Restaurant
will supersede the site plan for Walter and Marilyn Gata
approved on March 14, 1986; and
WHEREAS, only phase one as shown on the map will be built,
future proposed buildings will be subject to a future
application; and

WHEREAS, the Site Plan approved by the Planning Board on
April 3, 1989 contained the following condition, a lighting plan
for all outside light fixtures, including the lights on the
building, must be submitted for review before the issuance of a
building permit; and
WHEREAS, a lighting plan was received on April 11, 1990 and
approved by the Planning Board on June 6, 1990; and
now therefore, be it
RESOLVED that all conditions contained in the site plan
approved by the Chairman on April 3, 1989 have been met, and a
copy of the lighting plan has been officially affixed thereto.
This is to be subject to the replacement of the recently
installed flood light across Horton's Road with a standard
street light.

Determinations:

for 5.6468 acres located on the north side of Sound Avenue in

motion.
RESOLVED that the Southold Town Planning Board, acting
under the State Environmental Quality Review Act, make a
determination of non-significance, and grant a Negative
Declaration.

yet?
Mrs. Simicich: No, they should be coming this week. I spoke
to Mr. Cuddy today and we're asking if you would jUst give us
a temporary approval of the site plan on the premise that the
Board of Health would be coming this week. We would appreciate
it as we would like to get started as soon as possible.

WHEREAS a formal application for approval of this site plan
was submitted on December 7th, 1989 and
WHEREAS on March 29th, 1990 the Zoning Board of Appeals
gave a special exception for a winery and

agency and granted a negative declaration on June 25th, 1990

place for the next regular Planning Board meeting.

Mr. Orlowski: Sound View Estates - Chairman to endorse
final subdivision maps for five affordable housing lots on 5.83
acres located off a private right-of-way on the south side of
Soundview Avenue, Southold. SCTM ~1000-59-9-10. The Town
Board has agreed to accept dedication of the road and open space.
Mr. Ward: Mr. Chairman I make a motion to have the Chairman
endorse the final maps.
