Board to set Monday, July 15, 1991 at 7:30 p.m. at the Southold Town Hall, Main Road, Southold as the time and place for the next regular Planning Board Meeting. Mr. Edwards: So moved. PUBLIC HEARINGS: Subdivisions - State Environmental Quality Review Act ~ SOUTHOLD PLANNING BOARD 2 JUNE 24, 1991 Mr. Orlowski: 7:30 p.m. Macari at Laurel - Public hearing on the Draft Environmental Impact Statement dated March 1991, together with the six pages of revised text, received by the Planning Board on May 13, 1991. This proposed subdivision is located in Laurel. SCTM 9 1000-121-4-9. We have proof of publication in the local papers and at this time everything is in order for this hearing. I will ask if there are any comments or questions. Please step up to the microphone'and state your name and your co~ents or questions. Mark Gross: My name is Mark Gross, I live on Laurel Lake, I'm a member of the Laurel Lake Property Owners Association. Our attorney has looked over the Environmental Statement and is going to be sending a letter to the Planning Board, because they feel there are deficiencies in the statement. There are a few points I wanted to mention that concerns me and I'm sure concerns other members of the Laurel Lake Property Owners Association. One of these is the run off that we are going to be experiencing into Laurel Lake and into the wetlands as a result of this development. There will be fertilizers, conceivably pesticides, salt from the roads and I'm worried about the quality of the water in the lake and what will happen to the wildlife in the lake, the migratory birds that we get and the wildlife that we have there all year round. I'm also concerned about the character of the neighborhood and if it will change from a rural neighborhood to~a suburban neighborhood. And the loss of open space, and this includes the considerable amount of traffic which we have right now, and will certainly increase' when this development goes in. Mr. Orlowski - O.K.. I'd just like to note the public comment period will run until July 5th. Mark Gross: Yes, we're aware of that. Mr. Orlowski: O.K., any other co~m,ents? Mr. Ray Herfurth: My name is Ray Herfurth, my parents own a piece of property on Laurel Lake. I've beencoming out to the lake since I was about four years old, better~than 20 years. I think it's a darn crying shame the last real bastion of beautiful land that we have out in this area that attracts a lot of people and is not necessarily destroyed, but possibly could be. We recognize everyone here has some background and has looked into the environmental impact but just from a personal standpoint, I've been coming out here for tke beauty and the ability to get away from the big hustle and bustle of the city. I mean, if somebody wants to put a development in, let him put it in but not near our lake. That's really the comment that I'd like to make and the feeling I think everyone in the property owner's association got and I guess I'm really'asking you as the ~ SOUTHOLD PLANNING BOARD 3 JUNE 24, 1991 Board members what I could do personally to prevent this from happening? Mr. Orlowski: That's a good question. You can make comments until July 5th, if you have any comments on the Environmental Impact. Mr. Ray Herfurth: It'S not necessarily environmental impact that I'm concerned about, just aesthetically. Mr. Orlowski: Well, that's all part of it. Have you reviewed the Environmental Impact? Mr. Ray Herfurth: No I have not, I was just made aware of it about three days ago to tell you the truth. Mr. Orlowski: You can call the office and it is also in the libraries so you can take a look at it. Judy Greco: I'm Judy Greco and I live on Laurel Lake and this directly affects me and directly affect my drinking water because these houses will be adjacent to the back of all my property. What I can't believe is that the Town goes to all the trouble of printing up this, (holds up pamphlet) for the libraries, for the post office, for the watershed and the environment, and the impact it will have, and tells us about our garbage and what we can do and then can approve something like this. I think, I don't know how you justify pr/tn~ing what we should do and approving this at the same time. Mr. Orlowski: Any other comments? Mr. Robert Weintrab(sp): My mother-in-law, Emaline Lee, lives on Laurel Lake. We had some questions regarding the open space and what your plans were for the open space if this was to be approved. It's not very clear. Is this to be used by everyone? Will it be public? Mr. Orlowski: Well, the open space right now is a question that the Town Board and this Board is discussing, but right now it stays with the owners of the subdivision. Mr. Robert Weintrab(sp): These 27, if this was approved, these 27 houses would have access to the lake and people would go down to the lake on this right-of-way and use it. Would there be facilities? Bathrooms, parking 10t, police, garbage? We would like to address all of these issues it woUld seem before you can just turn it loose. Mr. Orlowski: Have you reviewed the Impact Statement? Mr. Robert Weintrab: I have. Mr. Orlowski: O.K.. SOUTHOLD PLANNING BOARD 4 JUNE 24 , i991 Mr. Robert Weintrab: So we're very concerned what this is going to do to the lake, to the land around the lake, pollution, garbage who is going to look after facilities? It seems as though there is a small piece of wetlands on the lake and a narrow band on sort of a sloping hill. Are they going to remove that hill to make a parking lot? Are they going to ... it seems as though its not very clear. Mr. Orlowski: Right now, the hearing is addressing the Impact Statement. Mr. Voorhis is here. He's our enVironmental consultant reviewing this. Chic, maybe you could just hold it up and show everybody the size of this Impact Statement that you have of copy of there. Mr. Chic Voorhis: There is some information here that may cover that. What Benny indicated is that there really no plan for it at this time. What I could mention just to give a little more info£m&tion is that any activity adjacent to the lake or the wetlands would still require wetland comments from the Town Trustees as well as the state DEC. This is a wetlands designated under Article 24 of the Environmental Conservation Law. Any activity within 100 feet would require additional permits. There's no mention of it. At this time, we are not aware of any plans for putting in docks, parking lots or any facilities down in that area. Based on the EIS and based on the known permits that are on file, applications that are on file, so that my help you some. It's something that hasn't come up; we're not aware of any plans for it. They would need further permits. Mr. Robert Weintraub: Would this be a selling point for the subdivision? Mr. Orlowski: They can't do that now. They can only do what they show us on the subdivision map; and the impact statement, as Chic says, is addressing that, and that's what we're taking about tonight; not the subdivision. It's the Draft Environmental Impact Statement. From here we go on to final before we address the subdivision. Mr. Chic Voorhis: C~u~ents will be responded to in writing as far as part of the record. Mr. Robert Weintr~b: They will be. Audience member: Yes. Mr. Robert Weintrab: We also wondered who would be looking after this area if these twenty-seven families had access to it. Who would look after it to make sure it remained in the natural state it is in, garbage, litter. Judy ~reco: In the spring, I take my paper bag and my plastic bags and my truck and I walk up and down picking up the beer ~ SOUTHOLD PLANNING BOARD 5 JUNE 24, 1991 cans, the soda cans, the bottles, the old cigarette cartons and I don't mind doing it because I feel we're doing it to keep the area the beautiful spot that it is. But, if you have twenty-seven more families, I mean I'm one person, hc~many more families in there are going to be picking up with us? My main concern is the watershed, is really the water. I want to be able to drink the water, I have well water. I w~nt to be able to drink the water. I can't have my grandchildren drink it because of the nitrates now. I have to buy bottled water. What's it going to do with twenty-seven more families in there; that is rally an issue as far as I'm concerned. Thank you. Mr. Orlowski: Any other co~m~ents? Mr. Ray Herfurth: t just have a quick question for you. You said that any conferments in writing to the Board will be addressed and we have until July 5th to do that? And they have to be addressed just to the Board? Mr. Orlowski: Yes. And these comments tonight will be addressed also. Sherry Johnson: On behalf of North Fork Environmental Council we will be providing detailed co~m,ents later on this week. But, just to get into the record tonight, I would like to be sure the Draft Environmental Impact Statement and FEIS discussed the issue of Cou~nty acquisition, which is particularly import, as the legislature recently approved a list that~contained this parcel. Also, the issue that the reco~m~endations of the special ground water protection areas study be discussed in the FEIS if they weren't in the draft. That's the extent of my comments tonight. Like I said, you have until July 5th to get you comments in and the Impact study is , SOUTHOLD PLANNING BOARD 6 JUNE 24, 1991 available throughout the Town so you can call the office and they can tell you where you can take a look at it. Mr. Voohris: The process calls for the completion of the comment period which goes through July 5th. That is our office, the Planning Office~ will review the comments, determine the substance of co.,.ents, usually all the comments are included and forwarded back to the applicant to respond to. They have been paying professional consultant to prepare the responses. The Board retains that fi~m to insure that the professional consultant does a professional job. Once that is done, the full response to the comments, the comments themselves, the original DEIS will all be filed as what is known as a Environmental Impact Statement. That will be filed bythe planning Board with a minimum ten day comment period on that after which the Board will proceed to adopt. Which will essential, fax on the final EIS the entire record and lay down some issues, environmental, social and economic issues and (inaudible) Judy Grecco: What we said tonight, do we have to put in writing? Mr. Voohris: No, it is on the record, it is part of the transcript at the hearing tonight and that is sufficient to be responded to in the final EIS. Mr. Orlowski: O.K., the next order of business at 7:40 p.m. Southold Villas - This proposal is for both a subdivision and a si~e plan. This subdivision is for seventeen affordable lots and ~he site plan is for sixteen condominium units. The parcel is located on the west side of NYS 25 approximately 917 feet south of Tucker Lane. SCTM #1000-70-1-6. At this time we have proof of publication in the local papers and everything is in order for a final hearing. First, I will ask if there are any objections to this subdivision or the site plan? Hearing none, are there any endorsements of this subdivision and site plan. Merle Wiggin: For the applicant. Just briefly, this as you know, this public hearing has been a long four year process and the application process of the various reviews, approvals, SEQRA process, draft, final and to my k~owledge this is the only subdivision, that has in it affordable housing approvals. It has public water approval, the Village of Greenport just waived the increase and upfront money for one section and now consideration may be made for the whole thing because they now realize that they are both tied together. The site plan now inCludes buffers between that and the adjacent residential areas and it is also in the final stages of getting the clean up grant for $25v000 per unit. I would appreciate it if you would approve this so it can go forward. Thank you. SOUTHOLD PLANNING BOARD 7 JUNE 24, 1991 Mro Orlowski: Any other endorsements? Hearing none, is there anyone out there who is neither pro nor con but may have information pertaining to this project that would be of interest to the Board? Hearing none, any questions from the Board? Mr. Ward? Mr. Ward: Just one. Mr. Wiggins, in terms of, could you give us your intended price ranges on the affordable and on the condo units? Mr. Wiggins: I don't know what the condo units are but the price range on the affordables after the last calculations, I think is going to be $89,000. Excuse me it is $79t000 with the ~$25,000 allowed. Mr. Ward: What happens if we don't get the $25,000? Mr. Wiggins: Then the applicant's only choice is to use the maximum of Southold Town which I think is going up to $103,000. Mr. Ward: O.K., thank you. RESOLVED to adopt the bond estimates for Phase 1 and 2, dated as revised June 24, 1991, and to recommend same to the Town Board. The bond estimate for Phase I is in the amount of $426,455.00, with an inspection fee in the amount of $25,587.00. The bond estimate for Phase 2 is in the amount of $50,550.00, with an inspection fee in the amount of $3,033.00. Mr. Ward: Second. Mr. Orlowski: Motion made and seconded. Any questions on the motion? Mr. McDonald: Mr. Chairman, I would like to adopt-the following in reference to the Subdivision of seventeen (17) affordable lots: WHEREAS, Southold Villas, Inc. is the owner of the property known and designated as SCTM # 1000-70-1-6, located on the west side of N.Y.S. Route 25 (Main Road); approximately 917 feet south of Tucker Lane in Southold; and WHEREAS, the Town Board granted a Change of Zone from "A-C" Agricultural-Conservation District to "AHD" Affordable Housing District subject to four ter~s and conditions on May 22, 1990, for this 18.025 acre parcel, and all terms and conditions have been fulfilled; and WHEREAS, a Negative Declaration was issued on February 27, 1990,'by the Town Board for the Change of Zone and for the construction of the affordable homes and the toWnhouse units; and WHEREAS, this major subdivision, to be known as SOUTHOLD VILLAS, is for seventeen affordable lots on 9.0107 acres; and WHEREAS, a final public hearing was closed and said subdivision application at the Town Hall, Southold, New York on June 24, 1991; and SOUTHOLD PLANNING BOARD 9 JUNE 24, 1991 WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore, RESOLVRD, that the Southotd Town Planning Board grant conditional final approval onthe surveys dated February 21, 1991, received by the Planning Board on June 20, 1991, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following conditions. All conditions must be met within six (6) months of the date of this resolution. The road and drainage plans must be revised in accordance with confluents numbered 1 and 2 of the Road Inspector's report, dated June 12, 1991. Six (6) copies of the revised final road and drainage plan must be submitted. A bond, Letter of Credit, or the equivalent, in the amount of the bond estimate adopted by the Town Board for Phase 1 must be submitted and must be accepted by the Town Board. 3. The inspection fee for Phase 1 must be submitted. 4. Six (6) copies of the final Landscape plan must be submitted and accepted b~ the Planni~Board~ 5. The curb cut permit from the New York State Department of Transportation must be submitted. A letter stating that the subdivider shall install all utilities must be submitted. 7.- A notarized letter stating that the sale of the affordable lots and homes will be in compliance with the provisions for the Town's Affordable Housing District; including the fact that the cost of installing water service lines to each lot will not be charged to prospective affordable lot owners, must be submitted. A draft Declaration of Covenants and Restrictions containing the following must be submitted for review, or these items must be added to the previous Declaration of Covenants and Restrictions: No plantings shown on the approved Landscape Plan shall be destroyed, cut, or removed, except as required for disease control. There shall be no further subdivisionof any lot in perpetuity. These covenants and restrictions can be modified only at the request of the ten owner of the premises with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their to such modification shall not be required. Upon acceptance of the draft Declaration by the Town Attorney and Planning Board, it must be filed in the office of the County Clerk. A copy of the filed Declaration must be submitted to the Planning Board. The filed Declaration of Covenants and Restrictions (Liber 11232, Page 374) must be revised as follows: Number 2 of the Declaration shall be omitted as the layout has been designed with conservation easements contained within the lots, rather than a general open space area. Be Number 5 of the Declaration shat~r~ead "...after a public hearing." rather than "... after a preliminary hearing." The revised Declaration must be filed in the office of the County Clerk. A copy of the filed Declaration must be submitted to the Planning Board. A copy of the filed Declaration of Covenants and restrictions (Liber 11129, Page 30) must be submitted. A copy of any covenants and restrictions required by the Health Department must be submitted. If there are to be any other Covenants and Restrictions placed on thelots, these shall be submitted for review and approval by the Planning Board. No covenants and restrictions shall be imposed on the lot owners without prior approval from the Planning Board. Six (6) paper copies and two (2) mylars of the final subdivision maps must be submitted. All maps must contain: A. Mr. McDonald: Mr. Chairman, I would like to make a motion on the resolution that was adopted in reference to the sixteen (16) unit SITE PLAN: WHERRAS, Southold Villas, Inc. is the owner of the property known and designated as SCT~ ~ 1000-70-1-6, located on the west side N.Y.S. Each unit will be subject to a one-year review from the date of its Certificate of Occupancy. e Two copies of the October 1990 lighting plan and specifications are to be submitted with the Building Permit. RESOLVED, to authorize the Chairman to endorse the final surveys upon completion of the following conditions: i. Receipt of six paper prints and two mylars with the Health Department's stamp of approval. 2. Proof of Filing of Bylaws for the Condominium Association with the State Attorney General. SOUTHOLD PLANNING BOARD 13 JUNE 24, 1991 Hearings Held Over From Previous Meetings: Mr. Orlowski: Eleanor Sievernich - This minor subdivision is for two lots on 3.748 acres located on the east side of Cox Neck Lane in Mattituck. SCTM 9 1000-113-8-5. I'll entertain a motion to keep this hearing open. Mr. McDonald: Mr. Chairman, hasn't this been decided. Mr. Orlowski: It hasn't been finalized, the final decision has to be filed. Mr. McDonald: O.K., we would hold it in advance anyhow for the ZBA. Mr. Orlowski: Yes. Mr. McDonald: I was just wondering if technically we would ask for the 78 or because it is going to the ZBA, but if it hasn't been finalized ..... Mr. Orlowski: No, would you like to make a motion. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES A~D SET OFF APPLICATIONS: Final Determinations: Mr. Orlowski: Highpoint at East Marion, Section Three - This major subdivision is for three lots on 2.9189 acres located in East Marion. SCTM $ 1000-31-3-11-25. We approved this subject to our decision on the firewell. Mr. Edwards: Mr. Chairman, I would like to entertain a motion. RESOLVED that the Planning Board has determined that in the interest of protecting and enhancing the public health, safety and welfare with regard to fire protection in the vicinity of the proposed subdivision of Highpoint at East Marion, Section three, it will require the placement of a fire well within the subdivision, as requested by the Board of Fire C0~,~ssioners of the East Marion Fire District. ,SOUTHOLD PLANNING BOARD 14 JUNE 24, 1991 The Board's decision is based on testimony given by C~m~issioner Ralph Martin at a hearing that was held on June 4, 199i at 7:45 p.m. at Town Hall. As part of this testimony, whick is incorporated herein by reference, Mr. Martin submitted supporting documentation, which consisted of sections of the National Fire Protection Agency's standards for fire protection, and of observations of the Commissioners based on their collective firefighting experience and the limitations of the equipment on hand. RESOLVED that the Southold Town Planning Board grant a ninety (90) day extension of conditional final approval. Conditional final approval was granted on January 14, 1991. 90 day extension will expire on October 12, 1991 unless all conditions of approval have been fulfilled. The Mr. McDonald: Second. How much of that will remain with theland that we can continue with? Mr. Orlowski: It is still active. Mr. McDonald: What is the problem? I got the feeling when I think your husband left last time he was going to try to add one more. Firs. Dickerson: My name is Betsy Bickerson and my husband's name is Parker and we own the property. (Inaudible) Our question is "what steps do we need to take to keep the plan as is so that all that work is not wasted? Mr. Orlowski: Well, everything holds good right now and the last thing we did was run a preliminary approval extension which runs to October 30th, 1991 and if you come into the office and talk with Valerie or Melissa, they can explain. Mrs. Dickerson: I have done that. Somehow, I thought I had to check with everybody. Mr. Orlowski: No. Mr. McDonald: The plan is good, you can just pick it up and move ahead. Mrs. Dickerson: I don't know if it's got final approval. ~SQUT~OLD PLANNING BOARD 20 JUNE 24, 1991 Mr. Ward: If it has preliminary approval, there normally aren't any major changes between preliminary and final. Mrs. Dickerson: And suppose if someone else w~ants to do it how much has to be done to review . Mr. Ward: Ownership is up to you, processing the plan is different. Mr. McDonald: Well, in the end what ever has been paid so far has been paid. Is there any money left on this. Melissa: Just the bond. Mr. McDonald: So until we finalize it there is no more money due. So you don't have to come up with any money. Mrs. Dickerson: That's not what I meant. I'm just getting at what has been spent is completed. Mr. Orlowski: You have until October 30th to file an extension other than that there maybe a new application fee after that you may have to go back a couple cf steps. Mrs. Dickerson: If you don't 'file an extension. Mr. Orlowski: Well no, you have your final extension through October. Mr. McDonald: Do you think it will take a long time to sort out what is going to happen? Unknown? Mrs. Dickerson: I'm not even sure yet. Mr. McDonald: That is a date you need to remember because if that date passes, that is the last extension so you would drop back down to preliminary. Melissa: This is preliminary. Mr. McDonald: You would drop back down to sketch. Mr. Orlowski: If you come into the office they will show you everything. Mrs. Dickerson: This is really the other thing I wanted to ask you about. This eight acres in Bayview with no wetlands. Should we talk ~bout it some other time? Mr. Orlowski: Yes. O.K., we won't take up anymore of your time tonight. Fir. Orlowski: As I said, you can come into the office and they will give you whatever information you need. Mr. Dickerson: We just wanted to know the preliminaries and what we should do and where we should start and where we should go. Mr. McDonald: Your real problem down there will probably be the Health Department, right? Everyone talking at once. Mr. McDonald: If the nitrates are high the Health Department probably won't give you an approval. They will ask for a test well and you will test it. Mr. Ward: You do have the ability to sell that lot as a single large lot. Somebody could put a house on it. You can put one house on it without the Health Department, it is in excess of five acres so it is something to consider. I'm just saying that the Health Department requirements for the wells and the septic and all that has to deal with groundwater control and has to deal with properties less than five acres so leaving it as a large parcel you could put a house on it, I mean, if there is a water problem. Mr. McDonald: More like a mini farm type of idea. If you have water quality problems you have an option. Maybe the land trust, the Peconic land trust might be able to do something as an option. They may be able to give you a few option that we might think of off the top of our heads. Mr. Orlowski: O.K., I'll entertain a motion to adjourn. Mr. Ward: So moved. Mr. McDonald: Second.
