The first order of business is for the Board. to set Monday, July 12, 1993 at 7:30 p.m. at the Southold Town Hall, Main Road, Southold as the time and place for the next regular Planning Board Meeting. PUBLIC HEARINGS Subdivisions - Final: Mr. Ward: 7:30 p.m. Puritan Farms - This minor subdivision is for four lots on 17.5551 acres located on the southwest side of Ackerly Pond Lane; 990' northwest of Lower Pond Road in Southold. SCTM $1000-69-5-7. Is there anybody here that would like to speak on behalf of this project. If not, are there any comments from the Board? WHEREAS, Pamela Hunt is the owner of the property known and designated as SCTM $t000-69-5-7, located on the southwest side of Ackerly Pond Lane; 990' northwest of Lower Pond Road in Southold; and WHEREAS, this minor s,,bdivision, to be known as Puritan Farms, is for four lots on 17.551 acres; and WHEREAS, the Southotd Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8)r Part 617, declared itself Lead Agency and issued a Negative Declaration.on July 16, 1990; and WHEREAS, a Declaration of Covenants and Restrictions has been filed in the Suffolk County Clerk's office (Liber 11474, Page 565) as required by the Planning Board; and WHEREAS, a final p~blic hearing was closed on said subdivision application at Town Hall, Southold, New York on June 14, 1993; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval onthe surveys dated January 7, 1992, subject to fulfillment of the following conditions within six (6) months of the date of this resolution: Submission of the $6,000.00 park and playground fee ($2,000 per vacant lot) as per Section A-106-38 (E) of the Town Code. SOUTHOLD TOWN PLANNING BOARD 3 JUNE 14, 1993 e The installation of drainage structures to prevent runoff from entering Ackerly Pond Lane. Additional information must be presented in regard to the drainage structures as per the Engineering Inspector's report dated May 20, 1993. A performance bond estimate must also be calculated for the cost of the construction. The drainage structures must be installed prior to endorsement of the final map, or a performance bond must be presented. An administration fee of 6% of the total bond estimate amount will also be required prior to endorsement of the subdivision. e The Planning Board is awaiting additional information from the Southold fire District in regard to their firewell recommendation. You will be notified under separate cover if the Planning Board determines that a firewei1 is required. This proposal is to convey 6.594 acres from a vacant 37.555 acre parcel to he merged with a 3.581 acre parcel containing a nursing home. Both parcels are zoned Hamlet Density. SCTM ~1000-45-2-p/o 10.2. Is there anybody here this evening that would like to address the Board regarding this lot line change. If not, does the Board have any questions? Board: No questions. Mr. McDonald: Mr. Chairman, I would like to make a further motion~ SOUTHOLD TOWN PLANNING BOARD 4 JUNE 14, 1993 WHEREAS, the San Simeon Retiremen% Community, Inc. is the owner of the property known and designated as SCTM ~1000-45-2-2 and p/o lot 10.3, located at the northeast corner of Route 25 and Chapel Lane in Greenpo~t; and WHEREAS, this lot line, to be known~ as proposed lot line change for the San Simeon Retirement Community, Inc. is for a lot line change to s~btract 6,594 acre~ from a 37.555 acre parcel and add it to a 3.581 acre parcel; and WHEREAS, the Southotd Town Planning Board, pursuant to the State Environmental Quality Review Act~ (Article 8), Part 617, declared itself Lead Agency and issued a negative declaration on May 24, 1993; and WHEREAS, a final public hearing was closed on said subdivision application at Town Hall, Southold, New York on June 14, 1993; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and be it therefore RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final survey dated March 1993. Hearings Held Over From Previous Meetings: Mr. Ward: Hillcrest Estates - Section 2~- This major subdivision is for twenty lots on 22.9 acres located in Orient. SCTM #1000-13-2'8.5. Mr. McDonald: Mr. Chairman, I make a motion that this hearing be held open because at the last minute we received a call from a representative of Hillcrest Estates indicating that they were out of the country and were not able to come and plead their case so I would like to hold it open for one more meeting. Mr. Ward: Harold Reese, Sr. et al & Otto Uhl, Jr. et al- This lot line change between Harold Reese, Sr. et al and Otto Uhl Jr. et al is to convey 10,093 square feet from Harold Reese, Sr. to Otto Uhl, Jr. and to convey 5,258 square feet from Otto Uhl, Jr. to Harold Reese, Sr.. After the lot line change the Harold Reese, Sr. parcel will be 98.1463 acres and the Otto Uhl, Jr. parcel will be 12.4051 acres. SCTM~1000-22-3-15.1, 18.1 & 18.3. Mr. McDonald: Mr. Chairman, I make a motion we hold this open. We have no other alternative since the County Planning Commission has not returned their concurrents on this yet. Mr. Edwards: Seconded. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF APPLICATIONS Final Determinations - Re-endorsement: Mr. Ward: Cranberry Acres - This minor subdivision is for three lots on 24.77 acres on the north side of Cedar Beach Road in Southold. SCTM ~1000-79-8-15.2 & 10.3. Mr. Orlowski: Mr. Chairman, I would like to make a motion. RESOLVED that the Southold Town Planning Board authorize the Chairman to re-endorse the final surveys dated May 6, 1993. Final Determinations: Mr. Ward: Too Bee Realty - This minor subdivision is for four lots on 7.956 acres located on the west side of Lighthouse Road; 419' south of Sound View Avenue in Southold. This subdivision is an amendment to the approved Too Bee Realty subdivision ~/19/91), which will be ahandoned~ SCTM ~1000-50-6-5. Mr. Edwards: Mr. Chairman, I would like to offer a motion. RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final surveys dated January 4, i993. This subdivision received conditional final approval on May 24, 1993. Motion carried. Mr. McDonald: Mr. Chairman, I would like to thank Mr. Hanauer on this subdivision. It has been a long road to get to here but what we finally have is in the best interest I believe of himself and the Town and I would like it to go on record thanking him. Mr. Ward: Yes and I think at this point we're awaiting from him the easements for drainage and recreation in favor of the Town which he said he would provide. Mr. Latham: The whole Board thanks him. Stewart Rauch - This minor subdivision is for two lots on 5.2 acres located off Equestrian Avenue on Fishers Island. SCTM 91000-9-9-22. Mr. Edwards: Mr. Chairman, I would like to make a motion. RESOLVED that the Southold Town Planning Board grant sketch approval on the map dated May 3, 1993. Mr. Orlowski: Second. Mr. Ward: Motion seconded. Ail those in favor? Stevens This minor subdivision is for two lots on 4.4603 acres located off a r-o-w, approximately 600' east of Cox Lane in Cutchogue. SCTM 91000-83-2-8. Mr. McDonald: Mr. Chairman, I would like to offer a motion. RESOLVED that the Southoid Town Planning Board grant sketch approval on the map dated April 29, 1993 with the following conditions: The north/south access to the proposed lots from Oregon Road is to be via the twenty foot right-of- way located on the property shown on the proposed map as n/o/f of Nina A. Stevens (SCTM 1000-83-2-10.3). For the record, the subject parcel has deeded access over a 16 foot right-of-way as indicated on the proposed subdivision may. This access is over the land n/o/f of Joseph Hannabury and the easterly side of the land n/o/f of Nina A. Stevens. On September 28, 1981, a minor subdivision for Nina Stevens was approved with a 25 foot right-of- way along the westerly side of the property line to provide access to the four soundfront lots. The proposed access for the Stevens Bluff subdivision is via this twenty foot right of way, which is to be improved as part of the 1981 approval as described in reports from James Richter, Engineering Inspector, dated January 6, 1993 and December 2, 1992. f The fifty foot wide east/west right-of-way is to be improved with a sixteen foot wide road as per Section i5-3 of the Highway Specifications. The improvements SOUTHOLD TOWN PLANNING BOARD 8 JUNE 14, 1993 are to be continued within the sixteen foot right-of- way over the property shown as n/o/f of JOseph Hannabury. An irrevocable offer of dedication is to be offered to the Town of Southold for the fifty foot wide right-of-way area within the proposed subdivision. Road profiles and drainage maps are to be submitted for review by the Planning Board and the Engineering Inspector. An irrevocable offer of dedication is to be offered to the Town of Southold in order to allow the twenty-five foot right-of-way shown on the minor subdivision of Nina Stevens to be widened to a total of fifty feet in width in the future. In addition, a Declaration of Covenants and Restrictions is to be prepared for the proposed subdivision stating that access is to be granted to the parcels of land adjacent to, and in the vicinity of the subject property, over both the north/south fifty foot wide accessway and the east/west fifty foot wide accessway. The Coastal Erosion Hazard Area must be indicated on the final maps. All building envelopes must be landward of such area. Mr. Orlowski: Second. Mr. Ward: Motion seconded. Ail those in favor? Mr. McDonald: Mr. Chairman, I would like to offer the following motion. RESOLVED that the Planning Board adopt the Engineering Inspector's Report dated May 10, 1993 with the following amendment. There are two firewells that remain to be constructed. These firewells were included in the performance bond. Mr. Latham: Seconded.
