Mr. Ward: Good evening, I would like to call the May 24th,
1993 Planning Board Meeting to order. The first order of
business is to set the next Planning Board Meeting on Monday,
June 14th, 1993 at 7:30 p.m. at the Southold Town Hall, Main
Road, Southold.
Mr. McDonald: Second.

PUBLIC HEARINGS
Subdivisions - Final:
Mr. Ward: 7:30 p.m~ Too Bee Realty - This minor subdivision
is for four lots on 7.956 acres located on the west side of
Lighthouse Road, 419 feet south of Sound View Avenue in
~ ~OUTHOLD TOWN PLANNING BOARD 2 MAY 24, 1993
Southold. This subdivision is an amendment to the approved Too
Bee Realty Subdivision (4-19-91), which will be abandoned.
SCTM $1000-50-6-5. This hearing tonight is there anyone here
that would like to address this project that is opposed to this
project? If not, is there anybody here that is neither pro nor
con that may have something to contribute or information
regarding this project? If not, is there anybody here in
support of this project? What is the pleasure of the Board?

resolution.
RESOLVED to adopt the bond estimate dated as revised May 6,
1993, and to reco~muend same to the Town Board. The bond
estimate is in the amount of $13,800.00. This bond estimate is
to replace the current bond for this subdivision. The
inspection fee has already been submitted.

WHEREAS, Too Bee Realty, Inc. is the owner of the property
known and designated as SCTM %1000-50-6-5, located on the west
side of Lighthouse Road, 419 feet south of Sound View Avenue in
Southold; and
WXqEREAS, this minor subdivision, to be known as Too Bee
Realty Corporation is for four lots on 7.956 acres; and
WHEREAS, the original minor subdivision of Too Bee Realty
Corporation filed in the. County Clerk's office on April 19, 1991
is to be abandoned and replaced, with this subdivision; and
WHEREAS, the Southold Town Planning Board pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,

declared itself Lead Agency and issued a Negative Declaration on
March 22, 1993; and
WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
May 24, 1993; and
WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and be it
therefore,
RESOLVED, that the Southold Town Planning Board grant
conditional final approval Qn the surveys dated January 4, 1993,
subject to fulfillment of the following conditions. All
conditions must be met within six (6) months of the date of this
resolution.
Submission of five (5) paper prints and two (2)
mylars of the final maps, all containing a valid
stamp of Health Department approval & a notation that a
Declaration of Covenants and Restrictions was filed-
pertaining to the subdivision.
Submission of a recorded copy of both Declarations of
Covenants and Restrictions which have been approved
by the Town Attorney.
3. Submission, and acceptance by the Town Board, of
the Performance Guarantee in the amount of $13,800.
Execution of the deed in regard to the area to be
dedicated to the Town and approval of such by the
Town Attorney.

recreation easement. We have non put that as a Condition but we

Mr. Ward: 7:35 p.m. Harbes Farm - This proposal is for four
lot line applications which are being processed concurrently.
Harbes Farm contains five single and separate parcels. The
proposed lot line changes are to reconfigure the existing five
lots. Additional lots are not being created.

WHEREAS, Edward Harbes Jr., is the owner of the property
know and designated as SCTM ~1000-120-3-11.2, 11.3, 11.4, 11.5
& 11.6, located on the south side of Sound Avenue and west side
of Aldrich Lane in Mattituck; and
WHEREAS, these lot line applications consists of four lot
line applications which are being processed concurrently and are
to be known as HarbeS Farm; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
May 3, 1993; and
WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and be it
therefore,
RESOLVED, that the Sou'thold Town Planninq Board grant
conditional final approval to the surveys dated May 21, 1993
together with the set of maps dated February 12, 1993 showing
each stage of the individual lot line changes and authorize the
Chairman to endorse the final surveys subject to fulfillment of
the following condition within six (6) months of the date of
this resolution:

proposed lot line change is to reconfigure two lots of 45,746
square feet and 41,246 square feet, both of which have frontage
on both wunneweta Road and Nassau Point Road into two lots,
one 45,461 square feet in area having frontage only on
Wunneweta Road, and the other 44,531 square feet in area
having frontage only on Nassau Point Road. Both lots have, and
will have, existing houses. SCTM ~1000-111-8-5 & 6. Is there
anybody here that would like to address the Board regarding this
application?

WHEREAS, the Estate of Evangeline A. Meyer is the owner of
the property known and designated as SCTM ~i000-11-8-5 & 6;
located at Nassau Point Roadand Wunneweta Road, Cutchoque;
and
WHEREAS, this lot line change, to be known as proposed lot
line change for the EState of Evangeline A. Meyer, ms to
reconfigure two lots of 45,746 square feet and 41,246 square
feet, both which have frontage on both Wunneweta Road and
Nassau Point Road; into two lots, one 41,461 square feet in area
having frontage only on Wunneweta Road, and the other 44,531
square feet in area having frontage only on Nassau Point Road.
Both lots have, and will have, existing houses.
WHEREAS, the Southold Town Planning Board pursuant to the
State Environmental Quality Review Act, (Article 8)Part 627,
declared itself Lead Agency and issued a Negative Declaration on
May 3, 1993; and
WHEREAS, a final public hearing was closed on said

RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated December 15, 1992, upon the following
conditions:
This is a clustered subdivision, therefore the
following statement shall be placed within the
boundaries of the 32.054 acre lot on the final
map.
"When the 32.054 acre lot is subdivided in this,
clustered subdivision, the yield shall be deter-
mined after first subtracting 37,000 square feet
in area from the land within the R-80 residential
zoning district; because said land represents
the clustered open space for the 43,000 square

regard to Harold Reese? I am representing Otto Uhl. You
said this is going to be held over again, the Harold Reese Lot
Line Change?
Mr. McDonald: Yes, we are waiting for the County Planning
Co~issiOn's Report. They haven't sent it to us yet, they
requested some more information so, we are getting more
information for them and then they will give us their
reco~endation.
Mr. Russell: What information, if I may ask, is lacking?
Mr. Ward: If you could hold one second, we will get the
letter. We have a letter here from the County Planning
Commission dated April 26th, which we responded to with the
information they requested on May 13th. Essentially, it had

to do with the representation of some of the property lines so
we clarified that and sent it back to the county.
Mr. McDonald: They will meet in the beginning of June again,
they meet once a month.

Mr. Ward: There was some discrepancy on the map and I'm sorry,
it was actually sent back to the attorney, Ben Kinsler for him
to respond back to us and to the county. YoU can have a copy of
this letter if you stop by the Planning Board Office.
Bond Determinations:

in the amount of $17,310.00.

Although the subdivision has been designed in three (3)
sections, the bond estimate has been calculated in two (2)
phases; Phase I and Phase II. These are to take the place of
the original bond estimate adopted by the Town Board on March

24, 1992. The bond estimate for Phase I is in the amount of
$289,445.00, with an inspection fee in the amount of
$17,367.00. The bond estimate for Phase II is in the amount of

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES, SET OFF
APPLICATIONS - STATE ENVIRONMENTAL QUALITY REVIEW ACT
Determinations:
Mr. Ward: Edith Dillon Edson - This minor subdivision is
for three lots on 6.74 acres located on the northeast corner of
Central Avenue and Munnatauket Avenue on Fishers Island.
SCTM #1000-6-3-8 and 6-4-7.
Mr. Edwards: Mr. Chairman, I would like to entertain a motion.
RESOLVED that the Southold Town Planning Board require that
a Stage 1 Cultural Resource Assessment be carried out on the
property. The assessment will be used to determine the location
of features on the site and properly locate the proposed homes
outside of sensitive areas.
It is u~derstood that certain areas of the site have
already been the subject of archaeological studies. It is not
necessary to conduct repeat studies. However, the findings of
the original study must be presented with the current Stage I
Assessment.

Mr. Ward: It basically means that you are through the 'SEQRA
process. It is completed and it has been granted a Negative
Declaration prepared by this Board.
Mr. McDonald: There is no Environmental Significance to what
you are proposing.
Mr. Russell: So, what does this mean?
Mr. McDonald: It means it is another requirement of the law.
The State requires us to examine as to whether there is any
Environmental Impact by what you are doing before we make any
other decisions.
Mr. Russell: This has not been done yet?
Mr. McDonald: We just did it.
Ms. Spiro: Mark, I think he is questioning Cove Beach Estates
not the lot line change which are two different applications.
Mr. Ward: This has to do with the action on the lot line change.
Mr. Russell: Oh, we are still on the lot line change.
Mr. Ward: Correct.
Mr. Russell: We're not on the approval of Cove Beach Estates?
Mr. Ward: No.
Mr. McDonald: Cove Beach Estates is the big subdivision right?
Ms. Spiro: Right.
Mr. McDonald: That is presently being held at Health right?
Ms. Spiro: Right.
Mr. Ward: What we just did has to do with the Lot Line Change.
Mr. Russell: Cove Beach Estates is still being held up on a
Health approval.
Mr~ McDonald: The best I understand it yes, they haven't solved

went to the Board of Review and the Board of Review denied it
and told thom they need the community water supply system there.
Mr. Russell: You mean a~ water main going down the Main Road?
Mr. McDonald: Not necessarily down the Main Road maybe
somewhere on site instead of having all separate wells, they
have to have a community water supply.

Department approval. I doubt it with the water. I think they
have to test each separately. In other words, if they didn't
put it in the community system (inaudible).

situation of what Cove Beach and we are required to do? It is
just dragging on for months and months and years and you keep on

telling us. Mrs Reese was in here two months ago.

Mr. McDonald: Mr. Chairman, I would like to offer a motion.
WHEREAS, Herodatus Damianos is the owner of the
property known and designated as Pindar Vineyards, SCTM
91000-85-2-15, located at Main Road in Peconic~ and
WHEREAS, a formal application for the approval of this site
plan ~was submitted on March 5, 1993; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
May 3, 1993; and
WHEREAS, all the requirements of the Site Plan Regulations
of the Town of Southold have been met; and be it, therefore
RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the surveys dated May 10, 1993,
and authorize the Chairman to endorse the final surveys subject
to fulfillment of the following conditions. All conditions must
be met within six (6) months of the date of this resolution.

WHEREAS, Maureen M. Mooney and Daniel C. Mooney are.the
owners of the property known and designated as North Fork Beer
and Soda Distributors, Inc. SCTM %1000-122-3-3, 4 and 5,
located at 11600 Main Road in Mattituck; and
WHEREAS, a formal application for the approval of this site
plan was submitted on March 4, 1992; and
WHEREAS, the Southold Town Planning Board, pursuant tot he
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
June 8, 1992; and
WHEREAS, all the requirements of the Site Plan Regulations
