On February 11,2011, Planning Staffconducted an inspection of the site work and it was discussed at the February 14, 2011 Planning Board work session. Due to the snow cover on site, it could not be determined if all the site work was completed in accordance with the approved site plan. However, based on what could be seen, the parking area leading behind the building did not have an asphalt surface area with drainage and striping as indicated on the approved site plan. As such, all site work will need to be completed as depicted on the approved site plan prior to a final inspection. Please notify the Planning Department at 765-1938 after all work has been completed for a final inspection. If you have any questions contact the Planning Board at any time. Thank you. Floria, P.E., Chair, Board of Review Findings and Recommendations of the Review Board Regarding: C10-07-0016 - FJ Gerard Holdings LLC, s/s Sound Avenue, 258 feet w/o L.I. Railroad - t/o Southold - SCTM 1000-14100-0300-044000 Hearing Date: August 21, 2008 Full Hearing Board Members: Walter Dawydiak, P.E., Martin Trent Reviewer: Bryan Grogan Statement of Problem Construction standards require that the distance between commercial sanitary systems and private wells be at least 150 feet. The applicant is proposing to install the sanitary system less than 150 feet from private wells. The applicant is also proposing to install a private well less than 150 feet from sanitary systems. Findings and Facts 1. The subject parcel is 0.264 acres located in Groundwater Management Zone 4, and is depicted as 1 lot on the 1981 tax map. Allowable sanitary flow on parcels in Groundwater Management Zone 4 is 300 gallons per day (gpd) per acre when served by a private well. The yield at density is 79.2 gallons per day gpd of design (sanitary) flow. However, because the parcel is depicted as one tax parcel on the 1981 tax maps, standards allow 300 gpd of total design flow on the site. 3. Town zoning for the property is L-1 industrial. The applicant is proposing to remove an existing single-family dwelling and construct a new 2-story warehouse and non-medical office building, with a total gross floor area of 3,762 square feet (sf), to be served by a private well and sewage disposal system. Proposed design flow is 213 gpd, all of which is sanitary flow. The proposed design flow is 71% of the allowable flow based upon the 1981 tax map exemption of 300 gpd total flow. 6. Depth to groundwater is greater than 17 feet below existing grade, with acceptable sand at approximately 2.5 feet below grade. Humayun J. Chaudhry, D.OM.S., Commissioner Hearing Date: August 21, 2008 Subject: Findings and Recommendations of the Review Board Regarding: C10-07-0016 - FJ Gerard Holdings LLC, s/s Sound Avenue, 258 feet w/o L.I. Railroad - t/o Southold - SCTM 1000-14100-0300-044000 The applicant is proposing to abandon the existing sewage disposal system presently serving the existing dwelling, shown as a single cesspool, and install a new system consisting of a 1,200 gallon septic tank and one 8~foot q) by 12 foot deep leaching pool. The proposed sanitary leaching pool is 148 feet from an existing neighboring well to the west (Simmons), and 137 feet from the proposed on-site well, where department standards would require 150 feet. 9. The proposed sewage disposal system is further away from the neighboring wells than the existing cesspool presently in use on the subject parcel. 10. The proposed private well is 115 feet to the north, 121 feet to the west, and 131 feet to the northeast from existing sanitary systems on neighboring lots to the east and west, as well as 137 feet north of the proposed new sewage disposal system for the subject parcel. Department standards require 150 feet separation between wells and commercial sewage disposal systems. 11. The closest public water main according to the Suffolk County Water Authority (SCWA) is at the intersection of Pacific Street and Sound Avenue, approximately 520 feet east of the parcel. Depa~hnent standards would require extension of public water to serve the project if public water mains were within 500 feet of the parcel. 12. Extending public water from the Pacific Street intersection would require crossing the Long Island Railroad right-of-way and tracks, and SCWA has estimated that the cost would be approximately $75,000. The only other option for public water is an extension of over 1,000 feet from an existing main at Sound Avenue and Factory Avenue to the west. SCWA has estimated a cost of $100,000 for that option. 13. The applicant has provided an October, 2007 water analysis from a new test well installed on the site, which indicated a manganese level of 1 rog/L, a nitrate level of 4.8 mg/L, and an ammonia level of 0.29 mg/L. These parameters are within drinking water limitations. The well has a total depth of 67 feet below grade, with water at 21 feet below grade, and a screen length of 4 feet, providing 42 feet of water above the screen, which meets depa~hnent requirements for depth. 14. The project engineer has submitted a report stating that due to the proximity of Mattituck Creek, groundwater flow is to the northeast. 15. The engineer calculated the lateral area of influence for the private wells on-site and in the vicinity to be 25 feet in diameter, based upon pumping rates of 5-10 gallons per minute. With groundwater flow to the northeast, and the specific well and proposed sanitary system locations, the conclusion was that the sanitary system Humayun J. Chaudhry, D~ M.S., Commissioner Hearing Date: August 21, 2008 Subject: Findings and Recommendations of the Review Board Regarding: C10-07-0016 - FJ Gerard Holdings LLC, s/s Sound Avenue, 258 feet w/o L.I. Railroad - t Jo Southold - SCTM 1000-14100-0300-044000 and well locations proposed were the most suitable for the site, and would not cause any health hazard or detrimental impact on the surrounding environment. Determination It was a 3 to 0 determination of the Board to grant the request for the variance to construct the sewage disposal system and private well in the proposed locations. The discharge plume from the proposed disposal system is away from the proposed and neighboring drinking water wells and will not affect the wells. Furthermore, the proximity of the existing disposal systems on the adjacent parcels and the proposed new sewage disposal system on the subject parcel will not affect the proposed well. As per §760-609 of the Suffolk County Sanitary Code (Sanitary Code), the approval of the variance is in harmony with the general purpose and intent of the Sanitary Code to protect groundwater and drinking water supplies, surface water and other natural resources, and public health, safety and welfare. Requested radio tower- denied by ZBA (Please be sure to research before completing this question or call our office for assistance.) Name of Owner: Seifert Construction ZBA Pile # REASONS FOR APPEAL (additional sheets maF be used with preparer's signature): AREA VARL4NCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The existing house is dilapidated and will be demolished. Rosen, the former owner tried to operate a radio tower from the subject property and was denied the variance. The property is zoned Light Industrial which permits the contractor's office and warehouse use. Siefert Construction wishes to locate his office and warehouse with custom carpentry materials in the building. The setbacks in the code anticipate a one acre parcel, the parcel is preexisting nonconforming in size and can not meet the required setbacks. The front yard setback conforms to the surrounding properties which are, on average 23.9 feet from the road (see Drawing S-2). The front yard setback conforms to the variable setbacks which are less than 100 feet of the surrounding properties. In order to place the parking behind the building the building is placed closer to the road, the parcel is along the Long Island Railroad, and the shape of the parcel requires the front yard setbacks to be slightly on an angle (19' and 22.9 fee0. The Lot Coverage is conforming (less than 30%) Mark Schwartz has designed a beautiful building which retains the "residential character" along the street. Placement of the parking in the rear also preserves the "residential"look of the property. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The Light Industrial zoning places setbacks applicable to a one acre parcel, this parcel is only 11,517 sq.ft. It is impossible to develop this property with the required setbacks because the property is preexisting nonconforming in size. However, the proposed plan conforms to the existing development of the commercial buildings on Sound Avenue and the proposed design enhances the property which is presently a run down preexisting nonconforming use (dwelling). (3) The amount of relief requested is not substantial because: As seen on the site plan (S-2) the setbacks of the adjacent properties are shown: the adjacent two story residence is 12.5 feet from the street (east) and adjacent one story residence is 58.5 feet (wes0. In addition, a two story warehouse (east) is 3.5 feet from the street and Kolb Mechanical's warehouse (wes0 is 12.5 feet from the street. This is a well developed area of Mattituck which provides a good location for Contractors. Penny Lumber Yard is near by and the area is zoned LI. Residential uses are not a permitted use in the zoning and will eventually be replaced with similar commercial uses. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The property will be significantly improved. The proposed use is conforming in Light Industrial Zoning. All activity is inside the building and will not interfere with the adjacent nonconforming residences. The Long Island Railroad boarders the property along the south property line. (5) Has the alleged difficulty been self-created? ( )Yes, or ( X )No. The parcel predates zoning. Are there Covenants and Restrictions concerning this land: ~ No. [3 Yes (Mease furnish cowl This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety, and welfare of the community. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full FAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact ia likely to be considered small to moderate or whether it is a potentially-large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. Gerard Holdings LLC and Seifert Construction Property Location: 11780 Sound Avenue, Mattituck CTM 141-3-44 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's property size is only 78 feet wide by 132 feet deep along the easterly side line. The dilapidated, unhabitable remnants of a former dwelling has been located on at the site for a long time and shown on the December 18, 2006 survey prepared by Joseph A. Ingegno. BASIS OF APPLICATION: Zoning Code Sections 280-63 and 280-64, based on the Building Inspector's June 4, 2007 amended Notice of Disapproval concerning proposed construction for use as a custom workshop in this LI Light Industrial Zone District. The reasons stated for disapproving the building permit application are that the new construction will be: (1) less than 100 feet from the right-of-way; (2) will have a single side yard t less than 10 feet; (3) will have a total side yards at less than 40 feet for both setbacks, (4) the rear yard is less than 70 feet. SUFFOLK COUNTY ADMINISTRATIVE CODF: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated July 25, 2007 states that the application is considered a matter for local determination as there appears to,~e no significant county-wide or inter-community impact. LWRP: This application is exempt under Chapter 268. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on 2006, at which time written and oral evidence were presented. Based upon nil te.~timnny, dom~m~nt~tinn, ner~nnnl in~n~ntinn nf the ornnc~rfv nnd other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant proposes a 40' by 78' contractor's office-warehouse building with storage of custom carpentry materials and as a limited workshop clarified by the applicant during the August 2, 2007 public hearing. The new building will include a 6' by 40' one-story open porch, a two-story office area 40' by 21', and one-story warehouse floor area. This properly is in the LI zone and contains a size of 11,517.67 square feet. The May 31, 2007 site plan (Map S-2) shows the new building with a front open porch proposed at 19 foot from the front lot line facing Sound Avenue instead of the required 100 feet, a rear yard setback of 42.1 feet instead of 70 feet (measured from the closest corner), 10 feet on the west side yard Page 2 - Aug,ust 16, 2007 · ZB File N~. 6059~- FJ Gerard Hok, '"~ and CTM No. 141-3-44 Seifert Construction and total side yard setbacks of 37.9 feet. The bulk schedule requires total side yard setbacks at 40 feet (10 feet on one side, and a minimum of 30 feet on the other side). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This area has many mixed uses, Residential and Industrial, with a building that is similarly situated. The applicant proposes to place the parking area behind the new business building, with removal of the entire dilapidated structure on the site and other site planning with the Planning Board. The applicants' planned improvements will be an asset to the area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's property size is only 78 feet wide by 132 feet deep along the easterly side line, with a limited site area for parking screening, and re ated site of only 11 517.67 feet in an Light Industr al (LI) Zone for construction of a bus ness, new parking area, new sanitary system and related utilities. This lot is not large enough to meet the setback requirements to place a building, and the applicant is forced to follow a variance procedure to request multiple setback variances from both side lines, from the right- of-way (front yard), and from the rear lot line. 3. The variances requested are substantial, but the size of the property limits the use of this LI zoned land. The owner has devised a plan which meets his business needs and which will meet other code requirements as a permitted business use, and all improvements as planned will be an asset to the community. 4. The difficulty has not been self-created inasmuch as the Town Board in 1989 deemed this property LI Light Industrial Zone District with setback requirements that would not be met on this lot of only 11,517 square feet in size. 5. No evidence has been submitted to suggest that a variance from the Light Industrial Zone District standards will have an adverse impact on the physical or environmental conditions in the neighborhood. Changes were agreed by the applicant during the hearing to reduce the width of the easterly driveway by one foot and to narrow the warehouse by two feet, and providing adequate screening for the nearby residence(s). RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried, to Grant the variances, with the following condition, and as shown on plans drawn by Mark Schwartz dated May 31, 2007: Reduction of the width of the easterly driveway by one foot, and reduction of the warehouse by two feet, to provide adequate screening for the residence(s). Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that Page 3 - Augus, t 1~, 2007 · LB File No~6059 - FJ Gerard Holdi~ ~nd Seifert Construction CTM No. 141-3-44 does not increase the degree of nonconformitY. He said that since the ZBA decision to allow a 22' front yard setback for the building leaves no opportunity for the applicant to meet the full 25' front yard landscaping setback, that requirement in the code is essentially "trumped," and they shouldn't have to go back to the ZBA. These p al~s have bee~ 'pi-~r~(~ b~?~th~ffi~e of Mark K. Schwartz, AIA and have been dated 12/18/07. Please consider the following: 1. Drainage Calculations have only been indicated for the pavement areas. Additional calculations must be provided to contain the run-off generated by all proposed building construction. All drainage structures should be numbered and the size of each structure should be indicated. All drainage construction must complywith the requirements of Town Code Section 236 for Storm-water Management. 2. Site Grading and Contour Elevations have not been indicated. At a minimum, spot elevations should be shown along curb lines & building perimeters. In addition, the drawings should provide elevations of finish floor, asphalt pavements and inlet Grates where needed to indicate appropriate pitch in parking surfaces. 3. The entrance to the site, within the shoulder of the Sound Avenue, should be constructed with asphalt to meet Town Highway Specifications. This Curb Cut should also be crowned to prevent storm water run-off from leaving the site and entering the Town Road System. All work within the existing Town Road Right-of-Way shall be the responsibility of the developer. 4. As per section 280-95 (B) of Town Code, all curbing and pavement areas must maintain a minimum set-off of four (4') feet from the property lines for use as a landscaping buffer. In addition, all curb & pavement lines must meet the requirements set forth by the Zoning Board of Appeals. 5. Land banked parking spaces, numbered 6 to 10, should be shown at least four (4') feet from the property line and should be accurately drawn at 9' wide x 19' long. Page 1 of 2 Jerilyn B. Has this item been addressed by the ZBA? 7, With the exception of item # 6 above, the proposed Landscaping appears to meet the minimum requirements of Town Code. This item should be reviewed and approved by the Planning Board. 8. Proposed Lighting appears to meet the minimum requirements of Town Code. This item should be reviewed and approved by the Planning Board. 9. The north eastedy corner of the proposed structure should be protected by Concrete filled Steel Bollards or other such means to secure the integrity of the warehouse building. The Department has no objection to the Town of Southold Planning Board assuming lead agency. Based on a review of the subject coordination, the Department offers the following comments. However, the Department wishes to reserve its right to provide more detailed information within the comment period(s) established for this action. These comments should not be construed as an implicit SCDHS approval or rejection of the project. All applications are reviewed thoroughly with respect to Suffolk County Sanitary Code concerns by appropriate departmental personnel when SCDHS applications are completed. 1. SANITARY CODE A. (631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF AUGUST 16, 2007 ZB File No. 6059 - F.J. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated July 25, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application is exempt under Chapter 268. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on _2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant proposes a 40' by 78' contractor's office-warehouse building with storage of custom carpentry materials and as a limited workshop clarified by the applicant during the August 2, 2007 public hearing. The new building will include a 6' by 40' one-story open porch, a two-story office area 40' by 21', and one-story warehouse floor area. This property is in the LI zone and contains a size of 11,517.67 square feet. The May 31, 2007 site plan (Map S-2) shows the new building with a front open porch proposed at 19 foot from the front lot line facing Sound Avenue instead of the required 100 feet, a rear yard setback of 42.1 feet instead of 70 feet (measured from the closest corner), 10 feet on the west side yard Page 2 -August 16, 2007 ~ ZB File No. 6059 - FJ Gerard Hol~J's and Seifert Construction CTM No. 141-3-44 and total side yard setbacks of 37.9 feet. The applicant's property size is only 78 feet wide by 132 feet deep along the easterly side line, with a limited site area for parking, screening, and related site of only 11,517.67 feet in an Light Industrial (LI) Zone for construction of a business, new parking area, new sanitary system and related utilities. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that .Page 3 - August 16, 2007 8 ZB File No. 6059 - FJ Gerard Hold~ and Seifert Construction CTM No. 141-3-44 does not increase the degree of nonconformity. This new site plan is for the proposed construction of 3,080 square foot building where 800 sq. ft. is a 2-story office and 2,280 sq. ft. is a custom cabinet workshop on an 11,517.67 sq. ft. parcel in the Light Industrial zone on the s/s/of Sound Avenue, approximately 520' west of Pacific Street known as 11780 Sound Avenue in Mattituck. SCTM #: 1000-141-3-44. The Planning Board received a site plan application on June 18, 2007 and accepted the application at our work session on June 25, 2007, requesting additional site plan information. The Planning Board issued a letter dated July 5, 2007 to the agent requesting a revised site plan showing the necessary site plan information. The Planning Board will begin the referral process on this application once the necessary site plan changes have been made. A copy of the July 5, 2007 letter is attached. The Planning Board is currently reviewing an incomplete site plan drawing dated May 31, 2007. This plan shows the proposed 78' x 40' building with an approximate 10' single side yard, 37.9 total side yard, 42.1' rear yard and 19' front yard setback. In addition, the site plan indicates lot coverage at 29.2%. The Planning Board recognizes this Light Industrial parcel is non-conforming and requires relief from ZBA. The Planning Board supports this application, as proposed, pending review of the proposed site plan by the Town Engineer, Suffolk County Seifert Construction Page Two July 17, 2007 Planning, Mattituck Fire District, LWRP, ARC, NYSDOT, SCDPW and Building Department certification. In addition, the applicant must obtain approval from Suffolk County Health Department for the proposed construction. The preservation of the natural vegetation buffers to lessen the impact to the adjacent residential properties is strongly recommended. The parcel is wooded with significant trees it is recommended that the site plan be designed to retain the trees to the greatest extent practical. We hope these comments will be useful to the ZBA in its review of this appeal. Enc: Letter dated July 5, 2007 Cc: File APPEALS BOARD MEMBERS James Dinizio, Jr., Chairman Gerard P. Goehringer Ruth D. [] A Variance due to lack of access required by New York Town Law-Section 280-A. [] Interpretation of the Town Code, Article Section [] Reversal or Other A prigr ap, peal E has, has not been made at any time with respect to this property, UNDER Appeal NO. ~/~ear ~ q .~. Requested radio tower- denied by ZBA (Please be sure to research before completing this question or call our office for assistance.) Name of Owner: Seifert Construction ZBA File # REASONS FOR APPEAL (additional sheets map be used with preparer's signature): ARE,4 VARIANCE REASONS: (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The existing house is dilapidated and will be demolished. Placement of the parking in the rear also preserves the "residential"look of thc property. (3) The amount of relief requested is not substantial because: As seen on the site plan (S-2) the setbacks of the adjacent properties are shown: thc adjacent two story residence is 12.5 feet from the street (east) and adjacent one story residence is 58.5 feet (west). In addition, a two story warehouse (east) is 3.5 feet from the street and Kolb Mechanical's warehouse (west) is 12.5 feet from the street. The Long Island Railroad boarders thc property along the south property line. (5) Has the alleged difficulty been self-created? ( )Yes, or ( X )No. The parcel predates zoning. Are there Covenants and Restrictions concerning this land: ~ No. [] Yes (vlease furnish cow). This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety, and welfare of the community.
