Good evening, I would like to call this meeting to order. First order of business is to set Monday, November 2, 1992 at 7:30 p.m. at the Southold Town Hall, Main Road,-Southold as the time and place for the next regular Planning Board Meeting. Orlowsk: 7:30 p.m. Hillcrest Estates - Section 2 - This major subdivision is for 20 lots on 22.9 acres located in Orient. SCTM 91000-t3-2-8.2. Is anyone here representing Hillcrest Estates? Mr. Groser: I am a consultant for Mr. Reese, I would like to wait a little bit until he gets here. Mr. Orlowski: O.K.. Mr. Orlowski: 7:35 p.m. Spectacle Ridge~ Inc. - This proposed lot line change is to s~htract 1.2715 of an acre ~rom a 15.245 acre parcel and add it to a 19 acre parcel to expand an existin~ vineyard. SCTM ~t000-73-1-3.1 and 84-1-.2. We have proof o~ publication in both local papers and at this time everything is in order ~or a final hearing. This condition must be met within six (6) months of the date of this resolution. Mr. Orlowski: O.K., we'll go back to Hiltcrest Estates, Section 2. This major subdivision is for twenty lots on 22.9 acres located in Orient. At this time every thing' is in order for a final hearing. I'll ask if there are any objections to this subdivision? Hearing none, are there any endorsements of this subdivision? Mr. Ben KinZler: I am the attorney for the applicants. At this time, the applicant as you know has sought tOattain approval fromthe Suff°LkCounty Boa~d of Health with respect to the well conditions on the side. AS you know the test wells, showed evidence of certain contaminants. Our application had bee/1 denied. We have been engaged in discussions with an adjoining public water systems, Brown Hill Estates, and we have been unsuccessful in our efforts to consolidate into their water system. We are in the process of preparing a revised plan for the Board of Health which provides for the location of the public water system on at least one, perhaps two of the lots, two of the twenty lots that we proposed in the subdivision, We are presently preparing plans for the Board of Health, we have with us Mr. Paul Groser ~no is our expert hydrelcgist, as well as one of the applicants Harold Reese Jr.. Very frankly, what we would ask you to do is to hold the application in abeyance pending our pursue of the application before the Board of Health. SOUTHOLD PLANNING BOAR~ 5 October 19, 1992 Mr. McDonald: Do you have a new application in front of them right now? Mr. Kinzle~: No, when the Board of Health denied our application for a variance what we did was to meet with our hydrologist to e~plore other alternatives and very frankly the enormous expense involved, it is estimated to cost s~mew?~re aro%md a quarter Of a million dollars for the installation of a public water system. We have made every effort to explore the possibilities of inclusion into the public water system Which is presently in existence with Brown Hills Estates as some of you may know. They had some of their own proble.ms and they required some substantial capital improvements of late. It was our hope that by sharing with them some of the costs and some of the expenses in their own upgrading and there own capital improvement program that we might join to their system, and then provide them with. additional revenue screen with which to maintain and operate their facility. For reasons that are frankly just not known to us they have elected not to include us or permit us to be included in their system. We are now faced with one or two dile~m,as. It appears from informal discussions with the Board of Health that we have one or two options. One is to take the twenty lot subdivision and resubmit a proposal to you which would provide for a ten lot Health that they Wo~ld consider.a.v.arzance whi~e we su_b~_t, two acre lots for' the proposed subdlvlslon. Now, t~ere are Two problems with that. One is the econo~ic problems involved in that. At the time, the money we have extended~ to date. The other and perhaps the more practical problem is that the proposed subdivision is already part of the larger subdivision and incidental to that roads and curbs had alre~Sy been installed on the sub~ject premises and so that to propos~ a modified subdivision' o~ two acres l°ts, the existing subdivision and roads as installed d~ not in. a pro,tic, al sense lend themselves to a revised subdivision of two acre lots. We hsve concluded that the only practical alternative, for us is to go back to the Board of Health with a public water system. Our hyd2rologist informs us that a p~blic water system would consume one, if not two of the lots in the radius requirement of on~ hundred and fifty feet. What we contemplate on doing is either to provide two lots or if they will permit us to install it on one lot and to retain easements, utilit~ easements on two ~butting parcels so that we can then create the buffer for a total radius, it's a hundred and fift~ foot buffer. We have elected to proceed with a public water system. We have met with the arctitects Young and. Young, we have met with the hydrologist Paul Groser and we are goin~ to proceed on that basis. Mr. Ward: How long? Mr. Kinzler: My guess is that, I spoke to Young and Young and guess unfortunately, they are not very bus~ right now so they SOUTHOLD PLANNING BOARD 6 October 19, 1992 feel they can get a set of plans together and get this to the Board of Health within 30 to 60 days. Mr. McDonald: All of the tests are done? Mr. Gzoser: Yes. The test wells have been installed. Mr. McDonald: But they were installed for the initial purposes of the subdivision? Mr. Groser: That is correct. Mr. McDonald: The tests that you need for the c~ty water system, have you run those yet? Mr. Groser: Yes. Mr. McDonald: So, you don't even have that data? How long~ before you have that data? Mr. Groser: We could have that within the 30 to 60 days. Mr. McDonald: So, that is not the limiting factor by any means. Are you expecting with'd~awal below the forty five gallon a minute limit? Mr. Groser: No. Mr. McDonald: You are going to have it above that? Mr. Groser: Yes. Mr. McDonald: So, you are going to have a DEC permit? Mr. Groser: Yes, correct. Mr. McDonald: How long for that? Isn't that going to be a couple of years? Mr. Groser: No. My experience has bee~, we have gotten them also in sixty days. Mr. McDonald: Really, ~at's great news. Mr. Groser: We just got one last June. Mr. Groser: It is obvious that we have spent a lot of time and money in developing and it is one that we do not wish to abandon. We have been very ~ptimistic that the Board of Health would have considered our application.. Perhaps if the applicant had sought the original subdivision when they went into Section I we wouldn't have been her~ to8~y. Mr. Groser: The one well site that we have chosen fez public supply well has shown forty feet of water but two did not have forty feet of water only about twent Mr. McDonald: Is it nitrates? Is that the. problem? Mr. Groser: Nitrates were somewhere arozkn8~ seven, th thing was Aldicore. Mr. McDonald: The only problem you had really was aid Everyone talking. Mr. Orlowski: We have a question that has been brou~ the fire district, they want to know when Section I is get their firewell? Mr. Reese: I think at this point., with the correspond my dad had initially with the Orient Fire Department,. of his correspondence that he had, for them to get bac to where they want it and then I will be prepared to p right in. Mr. Orlowski: O.K. Mr. Reese: We did write one lette~ but I don't have at this point asking them where they want it. I haven since. The parcel is located in the Affordable Housing District and is Section Two of the Southold Villas ~evelopment. The lots in SsctionTwo are not affected by the provision of the AHD. SCTM ~1000-70-1-P/O 6'. We have proof of publication in both the local papers and at this time everything is in order for a final hearing. I'll ask if there are any objections to this subdivision? BE IT RESOLVED to adopt the October 8, 1992 Suffolk County Planning Commission report with the following amendments (numbers correspond to numbers in report): Is to be amended to read as follows: No lot line shall be changed in any manner at any future date unless authorized by the Town of Southold Town Planning Board. 2. Is to remain as written. Is to be omitted. At such time that the adjacent parcel is developed, a 25 foot wide scenic easement will be required, thus creating a 50 foot wide easement area between the two developments. 4. & 5. Are to remain as written. Is to remain as written, with the omission of No. 2. The second paragraph of this section must be included in the document. 7. Is to remain as written. Mr. Ward: Second. Mr. Ward: Mr. Chairman, I would like to offer the following resolution. WHEREAS the Planning Board has reviewed the subdivision proposal for Anna K. Plock and the Long Environmetnal Assessment Form for the proposed project; ~nd WHEREAS the Planning Board's consul.taut has also reviewed the site and the Long E~vironmental Assessment Form; and WHEREAS the Planning Board has received comments from only one coordinating agency, the Southold Town Board of Trustees, in response to the Lead Agency coordination request; and WHEREAS both the Planning Board and the Board's consultant have concluded that there are additional items that must be addressed; be it therefore RESOLVED that the Planning Board adopt the Octobe~ 14, 1992 report from Cramer, Voorhis & Associates, and further, require SOUTHOLD PLANNING BOARD 15 October 19, 1992 that the information requested in the report be addressed by the applicant in the form of a Part III Long Environmental Assessment Form. SOUTHOLD PLANNING BOARD 21 October 19, 1992 Mr. Ward: Mr. Chairman, I would like to offer the following resolution. RESOLVED that the Planning Board has reviewed this proposed legislation which calls for the deletion of references to the issuance of Special Exceptions by either the Town Board or the Planning Board from the text. The Planning Board is opposed to this amendment, and for the following reasons. When the Town's planning consultants Raymond, Parish, Pine & Weiner submitted its first draft of the Zoning Code to the Towr~ in 1985, it recommended that responsibility for special .exceptions be shifted frum the Zoning Board of Appeals to the Planning Board. It supported this rec~,~.endation by stating that "Special Exceptions generally involve planning decisions in that they are concerned with land use relationships. The ZBA should really focus on appeals, variances and matter of interpretations? (Memorandum. January 28, 1985. Raymond, Parish, Pine & Weiner, Inc.) This recommendation was changed between its introduction in 1985 and 1989 when the Town Beard adopted the current Zoning Code. However, we find the original recommendation to be valid. Since the Stewardship Task Force is examining ways to better implement the Master Plan Update, this matter should be brought to their attention for consideration and. recommen~ationSo Mr. Latham: Second. P~SOLVED that the Planning Board has reviewed this proposed legislation which calls for the addition of a subsection to Section 100-33 would allow for the construction of accessory buildings within the front yard lot line of waterfront parcels. The Planning Board is opposed to this amendment, and for the following reasons. Thus, this legislation will discriminate against non-waterfront lots owners in that it will grant structures within three, five, seven or twenty feet of their front yard lot line, regardless of the impact that p~oposed structure might have on the surrounding neighborhood; yet, the owner across the street from a waterfront lot must make an application to the Zoning Board of ApPeals (at a cost of either $150. or $30Q.) for permission to reduce their front yard setback in a similar fashion. The Planning Board finds that the present code's requirement that all lot owners seeking variances apply to the Zoning Board of Appeals is fair and non-discriminatory as it stands. Mr. Ward: Second.
