Board to set Monday, August 17th, 1992 at 7:30 p.m, at Southold Town Hall, Main Road, Southold as the time and place for the next Planning Board Meeting. Mr. Latham: So moved. Mr. Ward: Second. PUBLIC HEARINGS SITE PLANS Mr. Orlowski: Port of Egypt Enterprisest Inc. - This proposed site plan is to construct a 25,375 square foot storage building located at the south side of the marina on Route 25 in SOUTHOLD PLAhrNING BOARD 2 JULY 21, 1992 Southold. SCTM ~1000-56-4-10.!, 11 & 13.2 and SCTM ~1000-56-6-3.2, 3.3, 4 & 6ol. We have proof of publication in the local papers and at this time everything is in order for a public hearing. I'll ask if there are any endorsements of this site plan. Hearing nons, are there any objections to this site plan. Linda Levy: I am from North Fork Environmental Council. I am here to request that the Planning Board not approve the proposed site plan for construction of the boat storage building as proposed by the Port of Egypt Enterprises Inc. Our opposition to this proposal begins with the Planning Board's original application of this project as unlisted and subsequent issues in June 1989 of a Negative Declaration. This site is within a Critical environmental area mainly the 500 feet inland from the Peconic Bay, thus making it a Type I classification under SEQRA. There is a presumption of significance which has been overlooked by all three agencies, the T~tees, the ZBA and the Planning Board) regarding the cumulative impact on the Peconic Bay, Budd's Pond, and Hashamomuck Pond. Clearly, a full environmental impact study should have been performed. The Planning Board had its chance to rectify this matter when the plan was significantly changed in 1990. At that time, the site area was changed from approximately seven acres, to 4.98 acres. Such a revision, together with the later addition of 30,000 square feet on the north side of Route 25 for a parking lot, constitutes a significant change which calls for a new EAF and new determination. The Planning Board did not take this opportunity to take a fresh look at this plan and revoke its negative declaration. The NFEC believes it is not too late to revoke the negative declaration, and requests that the Planning Board do so. The potential impact to the Peconic Bay of additional boats and usage is particularly significant at this time. With the latest resurgence of the brown tide, it is obvious that ~e must be extremely cautious when contemplating any expansion of the existing marina industry in Southold or anywhere else on the Estuary. In addition to the SEQRA questions that have been raised by this project, there are many other concerns. The size of the building exceeds height requirements. The parking lot does not meet code requirements. The plot coverage is over the permitted limits -- in short, there seems t0 be a disregard for the provisions of the Town Code in virtually all aspects of the plan. We recognize that this proposal has been pending for several years. However, all three agencies h~qe been told of these problems repeatedly. Each time the agency in question has chosen to disregard the concerns of the citizens of this town The NFEC is asking that the Planning Board take this final opportunity to protect the fragile ecosystem of our coastline S~ITHOLD PLANNING BOARD 3 JULY 21, 1992 and call for a full Environmental Impact Study of this proposed site plan. Thank you. Mr. Orlowski: Are there any other objections of this site plan? Are there any endorsements of this site plan? Bill Leiblein: I guess as the owner of the Port of Egypt, I would have to say I endorse the site plan. Sorry I got here late, I think most of the questions have been addressed over the years. Mr. Orlowski: Is there anyone out there neither pro nor con but may have information pertaining to this site plan that would be of interest to the Board? Hearing none, any questions from the Board? Mr. McDonald: What was the result of the DOT curb cut for the northern part? Was there a resolution of the need of what the DOT determination on the parking for the northern parking lots was? Ms. Scopaz: (Inaudible) strictly for overflow. The north side of the building is Mr. McDonald: O.K., thank you. Ms. Scopaz: No comments. Mr. Latham: No comments. Mr. Ward: No comments. Hearings Held Over From Previous Meetings: Mr. Orlowski: Paul Matthews (Willow Run) - This major subdivision is for thirty four lots on seventy acres located on SOUTHOLD PLANNING BOARD 4 JULY 21, 1992 the north side of Mill Road; 852 feet east of Reeve Road,and on the south side of Soundview Avenue in Mattituck. SCTM ~1000-100-2-1. We are waiting to receive the letter from the Suffolk County Planning Commission, we basically have that letter and everything is in order to close the hearing and I'll entertain a motion. Mr. McDonald: Mr. Chairman, I would like to offer the following motion. RESOLVED that the Southold Town Planning Board grant preliminary approval on the maps for the major subdivision of Willow Run: Willow Run, Section 1 plat dated May 11, 1992, and the map titled "Preliminary Lot Configuration for Paul Matthews," plat dated April 30, 1992, with the following conditions of approval: The order of the sections submitted for final approval shall be changed from that shown on the map for Sections 2, 3 and 4, dated April 30, 1992 to the following: Section 1: Seven (7) lots as shown on the map for Willow Run Section 1, dated May 11, 1992. Section 2: Lots 9 - 13, Lots 14 - 18, and the proposed re-construction of the intersection of Oregon Road and Mill Lane. Section 3: Lots 19 - 28. Section 4: Lots 1 - 8. Due to the fact that the Planning Board has allowed some of the clustered open space to be included with Lot 3 (rather than be owned by a Homeowners Association the 10 foot pedestrian accessway shown on the map for Section 1, shall be omitted SOUTHOLD PLANNING BOARD 5 JULY 21, 1992 from the final plat for Section 1. e A 20 foot buffer shall be placed on the west side of Lot 1 of Section 1, and on the west side of Lots 1 and 8 of the revised Section 4 (currently shown as Section 2). Such buffer area shall remain in its natural state. This restrictions shall be noted on the map and shall be included in the Declaration of Covenants and Restrictions. 0 Road and Drainage plans must be submitted fo~ Section 1 and the revised Sections 2, 3 and 4. The plan for Sections 2, 3 and 4 must include the reconstruction of the intersection of the proposed road with Mill Road, Mill Lane and Oregon Road as a four-way intersection. Art Melash: I noticed on the latest map, it contains from 40,000 square feet to 58~000 square feet. Is there any particular reason why that was granted? Mr. McDonald: Which lot? Mr. Melash: Saltaire, Mattituck - Ail of the six lots that are facing Soundview Avenue. This letter was dated JUly 8th and there are 58,070 square feet, lots 1,2,3,4, and 5. The original map shows 20,000 square feet. It's an acre and a quarter and it's suppose to be an acre approximately. Mr. McDonald: The rest of that is in the large lot isn't it? Mr. Orlowski: Yes. SOUTHOLD PLANNING BOARD 6 JULY 21, 1992 Mro McDonald: So it's transferring it from the large lot into the separate lots to make these lots a little larger. Is that the map you mean? Mr. Orlowski: Yes. I also wanted to get the 150 foot setback off of Soundview Avenue. Mr. McDonald: I see, we pushed it back. Mr. Melash: I was just curious why this was granted. Mr. Orlowski: It makes for a better lot, we thought. Mr. McDonald: He had an exceptionally wide setback from Soundview Avenue so he added some more acreage into the lot to make up a little bit for what he was losing. Mr. Melash: What about the subsequent lots south of that, what is going to happen to those lots? Mr. McDonald: They are as shown on the map. Mr. Melash: 40,000 square feet? That's going to cut down on the open space. Mr. McDonald: The open space is going into a separate and single lot. Mr~ Melash: It is going to be attached to one of the other lots. There no road going into Soundview Avenue from this correct? Mr. McDonald: Correct. It will all be exited on to Mill Lane. Mr. Orlowski: I have a motion made and seconded. Ail those in favor? SOUTHOLD PLANNING BOARD 13 JULY 21, 1992 Mr. McDonald: Mr. Chairman, it is kind of a late moment to raise since we just voted on it but that was a proposed lot line change for Mattituck Aviation and one of. the lots, maybe I am mistaken, but doesn't one of the lots front on or abut Peconic Bay. Mr. Orlowski: Isn't there a house at the end of that farm? Mr. McDonald: The lot lines are way up by Mattituck Aviation by the buildings. One of the lots goes all the way to the water and that concerns me that technically, it would be Type I. I hate to do this. Mr. Orlowski: It's five hundred feet isn't it? Mr. McDonald: I know, but it is a lot line change between two lots, if one of the lots, I'm not pretending to be an expert, I'm just asking. Ms. $copaz: You are asking if one of the lots ....... Mr. McDonald: I am asking if one of the lots is, I think on Peconic Bay Blvd. isn't this a Type I action? Mr. Orlowski: Not Peconic Bay. Ms. Scopaz: Inaudible. Board discussion. Mr. McDonald: Rather than take any action, why don't we just check into it. Mr. Orlowski: We will note that if there is a mistake, it will be rescinded. Mr. McDonald: Unfortunately, if it is a Type I action, we can't do a conditional negative declaration. We can only do that if it is an unlisted action. SOUTHOLD PLANNING BOARD 15 JULY 21, 1992 WHEREAS, Ali Agarabi is the owner of the property known and designated as Touch of Venice Restaurant at Matt-A-Mar Marina SCTM 91000-114-3-1, located at Wickham Avenue and Mattituck Creek in Mattituck; and WHEREAS, a formal application for the approval of this site plan was submitted on February 10, 1992; and WHEREAS,~ the. Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Declaration on June 30, 1992; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; and WHEREAS, this site plan was certified by Victor Lessard, Principal Building Inspector on July 6, 1992. be it therefore, RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final surveys for the restaurant addition dated March 11, 1992. Mr. Ward: Mr. Chairman, I would like to offer the following resolution but prior to offering the resolution, I would just like to make a statement that in all efforts to the North Fork Environmental Council we have, as a Planning Board been reviewing this project for a number of years and the master plan for this town identified and in terms of proposed zoning and uses in certain areas within the Town for reuse and expansion, we have very limited areas within this Town to do such activities and thishappens to be one of them and therefore, I offer the following resolution. SOUTHOLD PLANNING BOARD 16 JULY 21, 1992 WHEREAS, Port of Egypt Enterprises, Inc. is the owner of the property known and designated as Port of Egypt Enterprises, Inc. SCTM ~1000-56-4-10.1 and 56.6-3.1, 3.3, 4 & 6.1, located at Route 25, Southold; and WHEREAS, a formal application for the approval of this site plan was submitted on January 18, 1989; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Declaration on June 20, 1989; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore, RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated July 20, 1992 and September 13, 1990, subject to the survey dated July 20, 1992 being stamped and signed by a licensed surveyor, engineer, or architect and receipt of certification by the Principal Building Inspector of the plans dated July 20, 1992 and September 13, 1990. The approval is subject to a one year review from the date of the Certificate of Occupancy. All conditions must be met within six (6) months of the date of this resolution. Mr. McDonald: Second. Mr. Orlowski: O.K., I have nothing left on my agenda, does anyone out there have any questions or comments for the Board? Mr. Henry Raynor: Mr. Chairman, members of the Board. I represent Manor Hill Vineyard. I understand from your staff this week that there were some concerns and questions on the proposal I discussed at the last meeting and I am here if there are any questions that I can clear up with regard to the proposal and the development of sections of the vineyard with an average lot area of five acres. I will be happy before we go any further (inaudible) feel that this is an opportunity to establish some different residential construction within the Town over a period of years. We certainly (inaudible). SOUT~OLD PLANNING BOARD 17 JULY 21, 1992 Planning Board looking at maps. Mr. Orlowski: Some of the Board members had some ideas that maybe we could use the cluster provision and obtain some different size lots and also preserve some open space and also a mix with the five acre lots. I don't know what that does for you or what you are looking for, if you are looking for relief because of the water quality, and to speed things up are you looking to really promote mini vineyard here or "vinerettes." Mr. Raynor: Basically, I have no aversion to listening to any proposal in variance to the five acres as creating a five acre density I think particularly over the water protection area makes good sense. I don't want to run (inaudible) the Department of Health Services° Yes, we can proceed on a two acre density and because of the depth of the aquifer at that particular location, we have no problems in meeting the specifications of the Department of Health. I spent considerable time in discussing this with the principals involved with the vineyard at this point and they would rather see the perpetuity of this vineyard in that the development be two and a half times the density allowed by the Town. They also think it is a great marketing tool. We would propose to construct wherever possible the building envelopes outside the existing vineyard. This is, right now, an all working vineyard. What we are trying to do is just get a mix and moderate reports of aCtion and certainly a moderate density on the property. Mr. Orlowski: Can you place the building envelopes in such a way on there with the five acre lots and in doing so you might lose one or two of those lots also but basically protecting the vista and not putting anything close to the road and keeping them interior and protecting most of the vineyard. Mr. Raynor: We have a theory of absolutely no problem with protecting the vistas. The initial discussion on this project was for a minimum of a 100 foot setback similar to something that the Board had worked on already. We think that the setbacks on the size are what's going to be the deal for second home users out here and we will not proceed this as a primary residential construction. As far as density, gentlemen I have got to tell you I going to base to get the five acres. If you are going to tel1 me that you want to cut it and go beyond seven and eight we just won't pursue it. I say that as straight forward and as honestly as I can. This was a considerable compromise on the part of the developers that are involved and again if we can revert the thing and cluster it on the north end as one of the proposals within and what they do with the bottom line of the vineyard I can't help you with. This way, we could create something of a very modest homeowners association where the vineyard could be operated in some type of unit or system. We're dealing here with twenty people as opposed to forty-seven. SOUTHOLD PLANNING BOARD 18 JULY 21, 1992 Mr. McDonald: Homeowners associations, the experience I have with them is that they control lands that are held by the homeowners association. In this case, you would have group of people owning all of the land because it would be five acre lots. Do you have any idea how that would work? Mr. Raynor: Yes, absolutely. This is something that has been discussed at length. Quite honestly it is an incumbrance on the land that the homeowners would have in some form of restricted easement to allow the vineyards to operate or be controlled by a Board of Governors or whatever the association chooses to do. The idea is to maintain the character of what is there, not to disrupt it. Mr. Ward: I think what we have seen to date wasn't very creative. I think what the biggest drawback to it was that I don't know that it was thought out in a sense as to where the vineyard is or what is happening and how far back in we can set back houses and where the right a way is going to be, I don't know any other question which we are starting to answer now in fact of the vineyard operation that how does this overlay work. Maybe a agricultural easement on each of these properties and in turn that easement is going to be managed by someone or at least that is the intent. Mr. Raynor: They are talking about setting an association with a lease operator. Certainly to answer your question, as to the design or something that was done on a table in about thirty or forty five minutes to get a conceptual approval on behalf of the development as to density. If I had my way, I would never put a road up in that vineyard, I would do something with flags, I'm not sure that is going to be the case. If we want to get truly diverse on how we are going to handle this perhaps rather than look at a five acre lot in one section, in one section, we could look at a ten acre lot with a duplex on it. We are looking at new area, we are trying to be a little innovative with what is there. It is up to the Boa~d if they think this is proper to proceed with. By all means, we don't want to proceed Mr. Ward: Personally, I would rather see a duplex on the ten acres because you have less management involved with less people in it and a possibility of maintaining more of the vineyard. Mr. Raynor: That has been kicked around as one side of the spectrum. Three acres has been kicked around here as the other side of the spectrum. If it is not something that is going to sail smoothlywe won't do it. Mr. Ward: The other item is, in terms of the housing, whatever can be kept back into the site more rather than having anything more visual on 48. $OUTHOLD PLANNING BOARD 19 JULY 21, 1992 Mr. Raynor: We have already discussed a hundred foot setback, but maybe we can go over the rise at southwesterly quarter of the property. However that cuts into more vineyard. It has its pros and cons and I know the Board had reservations at one point of not looking at some of the low area that divides the property running north to south. However, building into that section might very well be the least disruptive to the vineyard itself. Mr. Ward: Why don't you present the plan with the vineyard and how you anticipate doing it with the five and ten acre lots. Mr. Orlowski: Do you have a map showing the vineyard. Mr. Raynor: You should have a copy in your file showing the vineyard only. Mr. Orlowski: Would you mind coming in and maybe sitting down with Ms. Scopaz and going over it roughly first and talking about layout and what you are talking about? Mr. Raynor: I have no problem at all. I do need direction from the Board. Mr. McDonald: I thought, last time we talked that the major intent was the fact that all of these were going to be cut into five acre parcels and pretty soon what was vineyard would no be no longer because the guy would be saying, "I don, t like the vineyard anymore." The way you are talking about it is rather considerably different than that. You are going to actually incumbent these properties in such a way that the decisions are going to be made by the farmland and be unified. That was what I thought was the major objection. There may be others that I didn't get out of the discussion. But, that is in line. I think it is a way. It looks like a way to me. Mr. Orlowski: You could sit down with Valerie first and go over this and maybe Ms. Scopaz has some ideas too. Mr. Raynor: Thank you. Mr. Orlowski: Any other questions or comments?
