Mr. Orlowski: Good evening, I would like to call this meeting
to order. First order of business is setting the next Planning
Board meeting. Board to set Monday, February 24, 1992 at 7:30
p.m. at the Southold Town Hall, Main Road, Southold as the time
and place for the next regular Planning Board meeting.

motion.
WHEREAS, Michael P. Glew, Claire L. Glew and James P.
Kelly are the owners of the property known and designated as
SCTM $1000-56-1-4.1, located at the north side of Main Road
off a private road known as Mill Path; approximately 800 feet
east of Bay Home Road in Southold; and
WHEREAS, this application, to be known as "set-off for
James Patrick. Kelly", is to set-off a 2.177 acre parcel from a
9.182 acre parcel, and;
WHEREAS, a variance for approval of 280-A was granted
subject to eight (8) conditions by the Zoning Board of Appeals
on J~nuary 9, 1990; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
May 15, 1990; and

WHEREAS, a final public hearing was closed on said set-off

RESOLVED, that the Southold Town Planning Board approve and
authorize the chairman to endorse the final survey dated August
21, 1990 with the following condition to be affixed to the map:
No building permit shall be issued for construction u~til
all conditions of the January 9, i990 variance for approval
of 280-A have been fulfilled.

WHEREAS, William B. May, Jr. and Jeanne A. May and Jeanne
B. May individually are the owners of the property known and
designated as SCTM 9 1000-9-9-6.1, 7, 9 and Reservoir Road,
located at Reservoir Road on Fishers Island; and

WH~EREAS, this lot line change, to be known as lot line
change for William B. May and Jeanne A. May and Jeanne A. May
individually is for a lot line change to subtract .86 of an acre
from a 1.16 parcel designated as SCTM %1000-9-9-9 and add it
to a 1.8 acre parcel designated as SCTM %1000-9-9-6.1 located
on Fishers Island. In addition, lot SCTM %1000-9-9-7 which
consists of .58 acres, and the southern portion of Reservoir
Road, consisting of 1.95 acres, will be merged with the lot
designated as SCTM 41000-9-9-9.
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
December 23, 1991; and
WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
February 3, 1992; and
WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and
be it therefore,
RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the surveys dated August 26, 1991,
and authorize the Chairman to endorse the final surveys subject
to fulfillment of the following conditions. These conditions
must be met within six (6) months of the date of this resolution.
The filing of a new deed pertaining to the
merger of .86 of an acre from the lot owned by
Jeanne A. May and designated as SCTM %1000-9-9-9,
with a 1.8 acre parcel owned by William B. May Jr.
and Jeanne A. May designated as SCTMi%1000-9-9-6.1,
resulting in a merged parcel of 2.66 acres. In
addition, lot 7 which consists of Reservoir Road
consisting of 1.95 acres, will be merged with a
.30_ acre lot owned by Jeanne A. May individually
to form a merged parcel of 2.83 acres.
The deed for lot SCTM %1000-9-9-7 contains a
covenant that gives the Race Point Corporation
or its successor an option to purchase this property
prior to any transfer. A waiver of this option is
required of the Race Point Corporation or its successor.
A copy of the filed deed containing this waiver must
be s~,hmitted to the Planning Board and the Liber and
Page number of the filed deed must be placed on the
survey.

Subdivisions - Preliminary
Mr. Orlowski: 7:40 p.m. Tide Group (North Fork Industrial
Park) This major subdivision is for eight lots on 29.11 acres
located on the northwest corner of Middle Road and Depot Lane in
the LI0 District in Cutchogue. SCTM ~1000-96-1-1. We have
proof of publication in both the local papers. At this time
everything is in order for a public hearing. I will ask if
there are any objections to this public hearing? Hearing none,
are there any endorsements of this subdivision?
Mr. Raynor: Good evening Mr. Chairman, Members of the Board.
I represent the Tide Group. Just a notation with regard to the
preliminary hearing. It is situated on the northeast corner,
not the northwest corner. This proposal before you I believe,
is in conformity with Section A-106 subdivision ordinance. The
subdivision was granted sketch approval back in June 25, 1990
and was given a Negative Declaration on the SEQRA on August 13,
1990. That map before you reflects changes the Board has
requested as well as those of the Mattituck Fire District
Commissioner's.
It is the applicant's intent to

~lanning staff has requested that there be no curb cuts onto
County Road 48 as part of the design so that the high speed
circulation traffic on 48 will not be encumbered and this map
reflects those requests. I believe the Suffolk County
Commissioners failed to consider the lot sizes being three and ,
four acres apiece. In the western townships this type of use is
constructed on lots of approximately one acre or less of this
size thereby creating the congestion that they site in their
objection.

Now, with regard to off site improvements, the Town
Engineer and Superintendent of Highways have requested the
applicant's to repave DepotLane to the
entrance of the subdivision. Although, I believe this is a new
requirement, it seems to make good common sense to do so. In
regard to the request for the one hundred foot buffer area, I
would request that this area as a condition of approval, not be
planted at this time. Rather, a covenant and restriction be
placed on each lot, as well as on the map, that the landscaping
will conform with both the type of structure and the location of
the structure on the lot on which each one of these buildings
will be erected. All required street plantings on the roads
etc. will be completely in conformity with the existing
ordinance. I would ask the Board to consider the off-site
improvements and allow the covenant and restriction with regard
to the buffering plantings to stand. We will be very happy to
answer any questions that the Board may have at this time. If
not, I'll sit down.

County Planning Commissioners Report, does the Board have any
pleasure on this tonight?
Mr. McDonald: Mr. Chairman, I would like to offer the following
motion.
Be it RESOLVED to override the January 9, 1992 Suffolk
County Planning Commission report for the following reasons:
The Planning Board is in favor of the internal road design
as it is shown. The road network-provides access to two
adjacent parcels each of which is in the LIO Zoning
District. Access to the northern parcel (owned by Krupski) will
be from both Depot Lane and the McBride property. Access to
CR 48 and Depo~ Lane via individual curb cuts for each lot is
not considered conducive to the Light Industrial Office Park
character that we wish to achieve here. Further, since this
LIO Zoning District is bordered by residential and agriculture
zoned lands, all of which are vacant, the aesthetic impact of an
industrial park will be mitigated by the visual screening that
will be provided by a continuous landscaped buffer around the
southern and western perimeter of this property.
The Planning Board will require that a covenant be placed
on the lots at the end of each cul-de-sac, requiring that the
access to the individual site plans be designed in such a manner
as to provide additional turning area for tractor trailer
trucks. Further, the use of the cul-de-sac for parking will be
prohibited. All parking will be provided on site for each lot.
In addition, a temporary turnaround Will be required at the end
of Dennis Road.

WHEREAS on January 13, 1992 the Planning Board assumed lead
agency status on the subdivision proposal for the Fields at
Mattituck; and
WHEREA~ the Planning Board has received correspondence from
the Suffolk County Department of Health Services indicating the
following:
a)
that test well data obtained in 1987 from the
vicinity of the proposed action indicate nitrate
levels which exceed New York State drinking water
standards; and
b)
that based on the ~hove information the Suffolk
County Department of Health Services will require
additional test well data from the applicant; and
c)
in the event that potable water cannot be derived
from private wells, the applicant will likely be
required to connect to public water as a condition
of any approval by the Suffolk County Department
of Health Services; and
WHYS as a result of the above, the Planning Board has
referred the proposed map to the Suffolk County Water Authority
asking if that agency would like to take part in the coordinated
environmental review. A response from that agency is expected
by February 24th;

Marie Ongioni: Good evening, thank you for this opportunity.
I am representing NYNEX Mobile Communications. I understand
that you received the report from the consultants. I would like
to explain to you the circumstances of the late arrival of this
report and make a specialrequest that you review the report
tonight and make a environmental determination- My office
received a call from Voohris late Friday afternoon, actually
it was about three or four o'clock. By the. time we finally
hooked up with him, it was about 5:10. We stayed in the office
on Friday night until about 7 o'clock, faxing various documents
to Chic Voohris sothat he would be able to prepare
and submit the report for tonight's meeting. As a matter of
fact, we Express Mailed certain reports to him on Saturday so

that he would have them today. When we spoke to him this
morning, he said that he was working on another project but he
would get to this this afternoon and have it to the Planning
Board Office. He did.
I realize that it was late today but I would like the Board
to take this special request into consideration. I understand
that his findings were in the negative. I haven't seen his
report but, from what he has told my office, his findings were
negative and' that there would be no environmental impact° In
view of that, in that there were no gray areas and it is a very
black and white case I would make a special request that the
Board vote on it tonight. I realize that it will be delayed for
three weeks and it for that'reason that I am here. NYNEX is
anxious to move ahead with the project, a delay of three weeks
will be a cost to them in revenue and also it will be a cost to'
the consumers who need this service in Southold Town because I
understand that the transmission for a cellular telephone out
here is not good because the service is not out here. So, I
would request that the Board take this special request into
consideration.
Mr. Orlowski: Well, I haven't read it yet. Does the Board
have any pleasure on this?
Mr. Ward: That is our basic problem. We haven't really had a
chance to review it. I understand what you are saying but our
policy is not to pass on things unless at. least we have read
them.
Ms. Ongioni: Is it lengthy? I haven't seen it.
Mr. Orlowski: Neither have we. We just got here at 7:00
p.m.. Shall we hold it until the next meeting.

Environmental Assessment Form and at fees to be determined by
cost estimate for any further review during the SEQR process.
All fees are to be paid in full by the applicant before the
Planning Board will authorize the consultant to proceed with his
review.
