Witnesseth, that the parry of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel at land, with the buildings and improvements thereon
erected, situate, lying and being in Orient, in the Town of Southold, County af` Suffolk and State
of New Yark, known and designated as plot #39 an a certain map entitled "Orient-By-The-Sea,
Section f, situated at Orient Point, Town of Southold, Suffolk County, New York, October 29,
1957" by Otto W. Van 7'uyl & Son, Licensed Land Surveyors, Greenport, New Yark, filed in the
OFlice of the Clerk of the County of Suffolk, an November 2l, i 957 under File No. 2777.

highways to be kno~+m as Park View Lane and Plum Island Lane from the northwesterly corner of
the premises easterly and then southerly and then westerly and then again southerly to the Main

same do not render the title unmarketable; (2) zoning regulations and ordinances of the Town of
Southhold; (3) Declaration of Govcnants and Restrictions dated November 21, 1957, filed in the

BEING and intended to be the same premises conveyed fmm Stella Molfctas to Stella Molfetas,
Andrew Molfetas and Jason Malfetas by decd dated September 5, 1988 and filed in the Sufi'alk
County Clerk's Office an October 12, 19$$ in Liber 10711 Page 103.
Together with all right, title and interest, if any of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; Together with the appurtenances and all the estate and
rights of the part} of the first part in and to said premises; To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or sut3'ered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
And the party of the first part, incompliance with Section 13 of the Lien Law, covenants that the parry of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same fur any other purpose.
The word "party" shat! be construed as ii it read "parties" whenever the sense of this indenture so requires.
