.ZONING BOARD OF APPEALS

After investigation and inspection the Board finds that
applicant requests permission to locate accessory building
in side yard with insufficient area to property line. The
findings of the Board are that applicant has chosen the
only feasible location for an accessory building, which is
not attached to the house. The applicant's legal front yard
is the area toward the road, and the easterly and southerly
exposures are on the pond. The Board agrees with the
reasoning of the applicant.
The Board finds that strict applicationof the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by
all properties alike in the immediate vicinity of this
property and in the same use district; and the variance will
not change the character of the neighborhood, and will observe
the spirit of the Ordinance.
THEREFORE IT WAS RESOLVED, Edwin W. Stewart, 20 Carole
Road, Southold, New York, be GRANTED permission to locate
accessory building in side yard with insufficient area to
property line. Location of property: 20 Carole Road,
Southold, New York.

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
isrequestedforthereasonthat the small lot size of approximately 60' x 100~,
including beach area, has no other suitiable area for location of
needed accessory building.

I. STRICT APPLICATION QF THE ORDINANCE would produce practicaldifficulti~ orunneces-
sary HARDSHIPbecau~ the placement of the needed accessory building
within the area permitted by the Code would result in it being
located a short distance away from my neighbors living room window
and thereby obstruct his view of Hashamomuck Pond. Also, its
olacement within the permitted area would make it visible to most
of the residents along the Hashamomuck Pond shoreline and would not
improve their view.
2. The hardshipcreatedis UNIQUEandisnotshared by all prope~ies ali~ in the immediate
vicinity ofthis prope~y andinthis use district becouse the house and lot are located
at the end of Carols Road and face the Pond. (see enclosed photo's)
The entire property is clearly visible from almost any point around
the Pond and.~nv construction within the legal rear yard of this proper~
affects the~ view of a large number of persons.
3. The Variance would obse~e the spirit ofthe Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT becau~ the accessory building was designed and
located so that it would be as inconspicuous as possible. It does not
disturb are change the character of the neighborhood in anyway.

The enclosed photograph shows the location of the
building in question. It is not connected to the
house in anyway and is entirely independent of it
antis moveable. It was erected without any knowledge
~ thought that a variance would be required.

This will acknowledge receipt of youm orde~ to Remedy
Violation, dated March 11, 197~, pePtaining to an accessory
structume located in the rear of my house on ~arole Road,
Southold.
On its face you~ order appears to be techinally de~e~
in that it describes the p~emises upon which the altered
violation exsist as being 20 Cajole Road instead of 2 Cajole
Road. I have never known this location to have any address
otheP than 20a~ole Road and have never been infox~aed of any
change in such address.
However, be that as it may, I would like to info~myou
that the alleged violation has in no way been intentional
on my pax*t and the structure was erected under the assumption
that no per. it or variance was required. And further I wish
to assureyou that whatever violations may exsist will be
corrected as seem as a reasonable and practical way of doing
so can be worked out.
The >first point to be considered is to request you to
extend the March 21st date of compliance for a period of six
months or until the end of the approaching summer seasom. I
believe such a request to be reasonable in view of the fact
that the violations or of a minor techinical nature and present
ne problem in regard to the health o~ safety to anyone and
do not seem to disturb anyome except your office.
I would also appreciate any suggestions from arlene in
your off, ce as to how the present structure may be modified
so as to remove your effical concern. If the lemght is reduced
to umdo~ ten feet will it still require a permit o~ variance in
its present location.
I a~ not sure if you are aware that the present structure
merely replaced another structure located on the same spot
for several years. No objection was raised to its location.
The new structure is merely a somewhat larger replacement and
is not attached to ~e house in anyway.
I would apnreciate you granting me additional time to make
whatever modification or removal if necessary and any help oF
advice you may be able to give me regarding a solution to this
problem.

chosen the only feasible place for an accessory building.
THE CHAIRMAN: Is there anyone present who wishes to

MR. EDWIN W. STEWART: I think the application speaks
for itself. I believe you noted from the position of the
house on the lot that it is the only feasible place. We
really need a storage area.
THE CHAIRMAN: We talked to your neighbor and he
approves of it.

After investigation and inspection the Board finds
that applicant requests permission to locate accessory
building in side yard with insufficient area to
property line. The findings of the Board are that
applicant has chosen the only feasible location for an
accessory building, which is not attached to the house.
The applicant's legal front yard is the area toward the
road, and the easterly and southerly exposures are on
the pond. The Board agrees with the reasoning of the
applicant.
The Board finds that strict application of the
Ordinance would produce practical difficulties or
unnecessary hardship; the hardship created is unique and
would not be shared by all properties alike in the immedi= -
ate vicinity of this property and~in the same use district;
and the variance will not change the character of the
neighborhood, and will observe the spirit of the Ordinance.

In answer to your letter of March 16, 1974. The
official house number of your home on Car.la Road
that has been assigned is %20. These n~mhers are
assigned based on a starting point of "0" feet. In
this case, the south end of Car. la Road being Zero,
and %20, an even number, desigantes the right side of
the road approximately 20 feet to the center of the
property.
Our Police Department and Fire Department in
your fire district ~ave this number on their records
and will, therefore, know where to respond in the event
of emergency.
You were notified on October 28, 1971 that the
accessory building was in violation and, again, on
November 3, 1971 a letter was sent to you by Mr. Terry.
The violations are as follows~
1. All structures require building permits -
Art. XIV - Sec. 100-41.
Accessory Buildings are to be located in the
rear yard and not closer than S~0# to any
property line. Art. III, Sec. 100-32 B.
These Articles are included in Chapter 100 Zoning
Ordinance, Town of South. Id.
I'm suns you will agree that sufficient time has been
granted from the time you were first notified to correct
this situation. This file will be date~ ahead to April
19, 1974. This will give you 30 days to correct these
violations. There is nothing other than applying for a
variance to modify this condition. I 'doubt that a
variance would be granted since there is no hardship in
