THIS INDENTURE, made the 10th day of August, Two Thousand and six
BETWEEN, JAMES V. JABLONSKI, residing at 315 Horton Road, Cutchogue, NY 11935
party of the first part, and
MARC WAHL and LAURA WAHL, his wife, both residing at 185 Shore Lane,
Peconic, NY 11958
party of the second part.
WITNESSETH. that the party of the first part, In consideration of Ten Dollars and other valuable consideration paid
by the party of the second party, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part foraver,
ALL that certain plot, piece or parcel of land, situate, lying and being near Peconic, in the Town of
Southotd, County of Suffolk and State of New York, known and designated as the westerly portion of
Lots 56 and 57 as shown on a certain Map entitled, 'Map of Nassau Farms, situate at Peconic, Suffolk
County, New York' , filed in the Suffolk County Clerk's Office on March 28, 1935 as Map No. 1179, said
premises being more particularly bounded and described as follows: BEGINNING at a point formed
by the intersection of the northerly line of Bittersweet Lane with the easterly line of Horton Road (as
shown on said Map); RUNNING THENCE in a northerly direction along the easterly line of Horton
Road, North 23 degrees 50 minutes West, a distance of 200 feet; RUNNING THENCE North 66
degrees 22 minutes 50 seconds East, a distance of 100 feet; RUNNING THENCE South 23 degrees
50 minutes East. a distance of 200 feet to the northerly line of Bittersweet Lane, South 66 degrees 22
minutes 50 seconds West. a distence of 100 feet to the point or place of BEGINNING.
SAID premises being commonly known as 315 Horton Road, Cutchogue, New York.
BEING AND INTENDED TO BE the same premises as those conveyed to the grantor herein by deed
dated October 16,1997 and recorded in the Suffolk County Clerk's Office on November 5, 1997 in
Liber 11860 at page 642.
TOGETHER with all right, 1iU8 and interest, if any. of the party of the first part in and to any streal8 and roads
abulling the above described premises to the center lines thensof; TOGETHER with the appurtenances and all the
estate and righl8 of the party of tha first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenanl8 lhatthe party of the first part has not done or suffared anything whereby
the said premises heve bean encumbered in any way whatever, except as aforesaid.
AND the party of the first part in compliance with Section 13 of the Lien Law, covenanl8 lhat the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund 10 be applied first for the purpose of paying the coat of the improvement and will apply the same first to the
payment of the cost of the Improvement before uSing eny part of tile total of the same for any other purpose.
The word "party" shell be construed es W It read "parties" whenever the sense of this indenture so requires.
