SEE REVERSE~ / / / t Marjor//e McDermott, Secretary After investigation and inspection the Board finds that applicant requests permission to set off business lot with insufficient area and insufficient offstreet parking on property located on Main Road and Love Lane, Mattituck. The prospective purchaser is interested in establishing a real estate office in the octagon building which is a permitted use in the "B-i" District. He would also have enough room in the building for other business. The findings of the Board are that this is a site of historical interest and approval by the Board offers an opportunity to promote historical antiquity on eastern Long Island. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the har4ship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, M. A. Kelsey Properties, Inc., Box 983, Southold, New York, be GRANTED permission to set off business lot with insufficient area and insufficient offstreet parking. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( ) A Variance to the Zoning Ordinance (X) A Variance for Permission to Subdivide is requested for the reason that premises proposed to be divided contain a large octagon- shaped building which is an architectural and cultural landmark in need of repair as its present condition does not yield a reasonable economic return. Appellant would like to see this building preserved. To acconplish .this Appellant will have to sell to a third party, and in order to consmunate the sale Appellant is required to obtain an area variance because of insufficient lot area with front, side, and rear yards, as well as the required number of off-street parking areas. The parcel to be divided is ~ shown on a survey by ' Roderick Van Tuyl, P.C., dated 9/17/73, wb_ich is attached hereto as Exhibit "A". Photographs of the existing building are also attached hereto as Exhibit "B". REASON FOR APPEALO Continued O 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because although it is an historical landmark, the building is in de- plorable condition needing a vast amount of structural and interior repairs as the building in its present state does not yield a fair economic return. Appellant cannot afford to make the extensive repairs and, in order to save the building, knows of no other alternative method but to sell it to a third party who is willing · to make the needed renovations. Otherwise, the building will have to be razed. The parcel to be divided contains 10,942 square feet, and the octagon-shaped building contains 2,750 square feet. Due to the configuration of the octagon building, there is virtually no side yard to the North, and the front yard has no setback which conforms to all of the properties on Love Lene. There is no practical way to re- locate the existing building on the premises and conform to the present front, side and rear yard zoning requirements. The variance for areas and yards being requested will not substantially affect or change the surrounding business area in that a majority of the businesses in the vicinity of the property are of the neighborhood variety, and virtually all of them are non-conforming lots by today's zoni~ standards. At present there is no off-street parking provided for this building, as well as the other stores on Love Lane, and as seen on Exhibit "A" nine (9) off-street parking places are proposed; plus, other portions of your Appellant's property borders on the public parking lot owned~by the Mattituck Park District which could be utilized by this parcel. 2. The ha~shipcreatedis UNIQUEandisnotshared by all prope~ies ali~ in the immediate vicini~ ofthispr~ertyandinthis use di~rictbecause the octagon building isone of America's curiosities, having been built in the mid-nineteenth century, and it is the only one of its kind on Eastern Long Island. The building is highly regarded as a unique development of its era, and it has been urged that it be preserved as an architectural and cultural landmark. It is the Appellant's desire to preserve this unique structure and Appellant has found a purchaser who is willing to do so by preserving the exterior, and renovating the interior for a real estate office and for other usable office space. 3. The Variance would obsewe the spirit ofthe O~inance and WOULD NOT CHANGE THE CHAP,~CTER OF THE DISTRICT becau~ there would be no change in what Appellant could presently_do on a non-conforming basis as there are no new buildings to be added, and the renovations will be done strictly within the existing structure. The parcel to be divided is surrounded by substandard parcels, and the granting of this variance to enable the Appellant to sell would not affect the public health, safety, or wel- fare. Balancing all of the community interests, substantial justice will be performed in granting this variance as the renovated building will add to the charm and attractiveness of the Love Lane shopping area.
