and being in the
tract or parcel of land, situate at Nassau Farms, Peconic, in the Town of
Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the northerly side of Bay Avenue and the southeasterly
corner of the premises hereby conveyed and the southwesterly corner of the land
formerly of Overton and rmilling thence along the northerly side by Bay A venue a
distance of 74.22 feet to a point;
THENCE RUNNING North 16 degrees 25 minutes 30 seconds West a distance of
250.16 feet to a point;
THENCE RUNNING easterly a distance of71.61 feet to the northwesterly corner of
land of Overton;
THENCE southerly along land formerly of Overton a distance of259.70 feet to the point
or place of BEGINNING;
BEING the same premises described in the deed to the parties of the first part herein by
deed to the grantor in USER 11761 PAGE 771.
The grantors herein being the same person( s) as the named grantees in a certain deed in
USER 11761 PAGE 771 in the Office of the Clerk in the County of Suffolk.
TOGETHER with all right, title and interest, if any. of the party of the first part in and to any streets and mads
abutting the above described Pl'emises to the center lines thereof; TOGETHEH with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the fil'st part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and wiII hold the right to receive. such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply Lhe same first to
the pnYlllent of the cost of the improvement before using any part of the lolal of lhe same for any other purpose.
