Mr. Ward: Good evemng, I'd like to call the November 14, 1994 Southold Town
Planning Board meeting to order. The first order of business is the setting of
the next Planning Board meeting. Board to set Monday, December 12, 1994 at
7:30 P.M. at the Southord Town Hall, Main Rd., Southold, as the time and
place for the next regular Planning Board meeting.
Mr. Latham: I'll move that.
Mr. Edwards: Second.
Mr. Ward: Moved and seconded. All in favor.

Final Determinations:
Mr. War(l: Harbor Park Homes - This major subdivision is for 5 lots on 9.04
acres located on the west side of Harbor Lane; 675 feet south of Main State
Road in Cutchogue. SCTM# 1000-97-6-17 and 103-1-20.5 & 20.6. Is the
applicant or representative of the applicant here? If not, what is the pleasure of
the Board?
Mr. McDonald: Mr. Chairman, I make a motion that the Southold Town
Planning Board authorize the Chairman to endorse the final surveys dated July
27, 1994. Conditional final approval was granted on October 3, 1994. All
conditions have been fulfilled.

acres located on the north side of Main Rd.; 1776 feet east of Stars Road in
East Marion. SCTM# 1000-22-3-15.1 & 18.3. What's the pleasure of the
Board?
Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board
set Monday, December 12, 1994 at 7:30 P.M. for the final public hearing on
the maps dated June 23, 1994.

Mr. Ward: Anna K. Plock - This major subdivision is for 5 lots on 21.79 acres
located on an existing right of way off North Bayview Rd., approximately 935
feet east of Reydon Rd. in Southold. Four of the lots are between 1.7 acres
and 2.2 acres in size. The fifth lot is a reserved area to be conveyed to the
Peconic Land Trust. SCTM# 1000-79-5-20.2. What's the pleasure of the
Board?
Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board
set Monday, December 12, 1994 at 7:35 P.M. for a final public hearing on the
maps dated October 4, 1994.

from a 42.468 acre parcel and add it to a 21,382 square foot parcel, in Orient.

Mr. McDonald: Mr. Chairman, I make a motion that the Southold Town
Planning Board set Monday, December 12, 1994 at 7:40 P.M. for a final public
hearing on the maps dated December 23, 1991.

Mr. McDonald: I'd like to make a further motion that the Southold Town
Plan ning Board, acting under the State Environmental Quality Review Act, do

an uncoorclinated review of this unlisted action. The Planning Board
establishes itself as lead agency, and as lead agency makes a determination of
non-significance and grants a Negative Declaration.

Sketch Determinations:
Mr. Ward: Latham Farms - This proposal is to set off a 5 acre parcel from an
existing 81.578 acre parcel:located on the south side of Main Rd. and the north
side of Narrow River Rd. in Orient. SCTM# 1000-18-6-(14.5 - 14.9) and 27-2-7.
VVhat's the pleasure of the Board?
Mr. McDonald: Mr. Chairman, I make a motion that the Southold Town
Planning Board Southold Town Planning Board grant sketch approval on the
map dated August 15~ 1994 with the following conditions:
1. The 2.973 acre area shown on the set off map shall not be considered
a building lot. This area is located within the R-200 Zoning District.
Thus the buildable area (2.973 acres) does not meet the minimum lot
area requirements of the R-200 District.
2. The final maps must contain all requirements necessary to file the map
in the office of the County Clerk (key map, lot numbers, etc.)
Sketch plan approval is conditional upon submission of final maps within six (6)
months of the date of sketch approval, unless an extension of time is
requested by the applicant, and granted by the Planning Board. Final maps
(six paper copies ancl two mylars) all containing a valid stamp of Health
Department approval~ must be submitted before a final hsadng will be set.

Mr. Latham: I'll abstain, because although Ed and I are distant cousins, we
have the same name and it looks a little better.
Mr. Ward: OK, we note for the record that Mr. Latham abstains.
Ed Latham: Mr. Chairman, seeing as haven't been here before, just what
does this mean, this action that has been taken tonight? It's just a bunch of
mumbo jumbo to me. Is this mean that it just keeps going on?
Mr. McDonald: The first step is to get a sketch approval. That's what we just
granted you. The next step is a final approval. You go right from a sketch to a
final approval, so we've given you the sketch, and the conditions, and you're
pretty much ready to go right to final.
Ms. Spiro: He needs to get Health Department approval.
Mr. McDonald: Health Department is all that's left.
Ed Latham: I'll get a copy of this?
Mr. Ward: Yes, you'll get a copy of this from us. You'll need Health
Department approval to show, with your final and then we can authorize it.
Ed Latham: OK.

Sketch Extensions:
Mr. Ward: Edith Dillon Edson - This minor subdivision is for 3 lots on 6.74
acres located on the northeast corner of Central Ave. and Munnatauket Ave. on
Fishers Island. SCTM# 1000-6-3-8 and 6-4-7. What's the pleasure of the
Board?
Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board
grant a six month extension of sketch approval from November 15, 1994 to May
15, 1995. Conditional sketch approval was granted on November 15, 1993.

5. What's the pleasure of the Board?
Mr. McDonald: Mr. Chairman, I make a motion that the Southold Town
Planning Board grant a six month extension of sketch approval from November
30, 1994 to May 30, 1995. Conditional sketch approval was granted on
December 17, 1990. The Planning Board has granted this extension due to the
delays caused by the requirements of the New York State Department of
Environmental Conservation for a Stage II Cultural Resource Survey.

Mr. Ward: Eliiah's Lane Estates Sections 2 & ,3 - This proposed major
subdivision is for a total of 27 lots on 38.56 acres. Nineteen lots are proposed
in Section 2, and eight lots are proposed in Section 3. SCTM# 1000-108-4-7.1.

Mr. Edwards: Mr. Chairman, I move to adopt the environmental consultant's
report dated November 10, 1994, in regard to the comprehensive review of the
Final Environmental Impact Statement.

1, 2 & 3. What's the pleasure of the Board?
Mr. Orlowski: I make a motion that the WHEREAS, James Homan is the owner
of the property known and designated as Braun's Oyster Company, located at
Main Road, Cutchogue, SCTM#1000-103-1-1, 2 & 3; and
WHEREAS, a formal application for the approval of this site plan was submitted
on February 18, 1994; and
WHEREAS, the Southolcl Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency, and issued a Negative Declaration on April 18, 1994; and
WHEREAS, this site plan was certified by Thomas Fisher, Building Inspector,
on November 14, 1994; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board approve and authorize the
Chairman to endorse the final survey dated September 23, 1994, subject to a
one year review from date of building permit.

Mr. Ward: John J. Miska - Planning Board to review amendment to Declaration
of Covenants and Restrictions for approved set off. SCTM# 1000-115-4-8.1.
Mr. Orlowski: I make a motion that WHEREAS the Planning Board has
reviewed the filed Declaration of Covenants and Restriction in regard to
paragraph no. 9 which reads:
"All residential structures that are erected within this subdivision
shall be constructed using materials and techmques that will reduce
inte dot noise levels in accordance with the recommendations of the
Department of Housing and Urban Development or other authority that
has promulgated standards for reduction of interior noise levels."; and
WHEREAS the Planning Board has decided that the intensity of the
Mattituck Airport does not merit such a restriction since~it is a
private y owned and operated limited access airport; be it therefore
RESOLVED that the Planning Board rescind the requirement that paragraph no.
9 be included in the Declaration of Covenants and Restrictions.
