Mr. Ward: Oood evening. I'd like to call the October 3, 1994 Planning Board
meeting to order. The first order of business, the setting of the next
Planning Board meeting. Board to set Monday, October 24, 1994 at 7:30
p.m. at the Southold Town Hall, Main Rd, Southold as the time and place of
the next Planning Board meeting.

WHEREAS, Alice J. Dart, is the owner of the property known and designated
as SCTM# 1000-78-I-10.19 located at 2415 Main Bawiew Road, Southold.,
and
WHEREAS, this application to be known as set-off for Alice J. Dart is to set
off a 62,315 square foot parcel from a 18.89 acre parcel; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on April 27, 1992; and
WHEREAS, a final public i~earing was closed on said set off application at the
Town Hall, Southold, New York on October 3, 1994; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town
of Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board approve and authorize
the Chairman to endorse the final surveys dated May 12, 1992.

Final Determinations
Mr. Ward: Harbor Park Homes - This major subdivision is for 5 lots on 9.04
acres located on the west side of Harbor Lane; 675 feet south of Main State
Road in Cutchogue. SCTM# 1000-97-6-17 and 103-I-20.5 & 20.6. What's
the pleasure of the Board?
Mr. McDonald: Did you bring the check? Didn't we need the check for
this?
Ms. Spiro: Yes, you can do the conditional approval thoug~q.
Chester Orlowsld: Mr. Chairman, I think we've got all the other papers in
there, except the $10,000 check for the Town. We applied through the
North Fork Bank and we should hear from them in the next week or ten
days, so they tell me.
Mr. Ward: Well then, what we'd do tonight then is we'd make this a
conditional
Chester Orlowski: We didn't want to go to a big thing, we just went for a
non,secured loan, because the other one would take us three or four
months to get us set up and this would only take us a week or ten days,
she told me, so as soon as we get it we'll have a check in to the Town of
Southold.

Mr. McDonald: Mr. Chairman, I'd like to make the following motion:
The following resolution was adopted:
WHEREAS, Dalchet Corp. is the owner of the property known and
designated as SCTM# 1000-97-6-17 & 103-1-20.5 and William Orlowski &
Lorraine Orlowski are the owners of SCTM# 1000-103-I-20.6 located on the
west side of Harbor Lane in Cutchogue; and
WHEREAS, this proposed major subdivision, to be known as Harbor Park
Homes, is for 5 lots on 9.04 acres; and
WHEREAS, a variance for proposed lot # 3 was granted by the Zoning Board
of Appeals on May 7, 1992 (Appl # 4070); and

WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on October 20, 1992; and
WHEREAS, a Declaration of Covenants and Restrictions has been recorded in
the office of the County Clerk in accordance with the Planning Board's
requirements., and
WHEREAS, an Irrevocable Offer of Dedication has been filed in the Town
Clerk's office in regard to the land area designated on said subdivision as
"Reserved for possible future road" located on lot # 3; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on September 12, 1994; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town
of Southold will be met upon fulfillment of the follow conditions; be it
therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated July 27, 1994 subject to fulfillment of the
following condition. Condition must be met within six (6) months of the
date of this resolution:
I. The park and playground fee, in the amount of ¢I0,000.00 (two
thousand dollars per vacant lot), must be submitted.

Mr. Ward: Mar,qaret Best & Adlyn Swerson - This existing 1.3 acre parcel
with two dwellings is to be divided into two lots, each having one of the
dwellings. SCTM# 1000-123-6-17. What's the pleasure of the Board?
Mr. Kassner: Mr. Chairman, I believe there is someone here that there's
someone here that would like to speak on this point.
Jim Fitzgerald: I'm Jim Fitzgerald of Proper-T-Permit Services and I
represent Mrs. Best and Mrs. Syverson and I would like to ask. that the
Board, if it is your inclination to approve the finding of the Suffolk County
Planning Commission, which I understand was negative; that you table that
motion and give us the opportunity to meet with the Board in the
worksession to discuss it and present some thoughts that we think might
change your mind.

We're going to hold that until the next meeting.
Mr. Ward: Anna Plock - This major subdivision is for 5 lots on 21.79 acres
located on an existing right of way off North Bayview Rd., approximately
935 feet east of Reydon Rd. in Southold. Four of the lots are between 1.7
acres and 2.2 acres in size. The fifth lot is a reserved area to be conveyed
to the Peconic Land Trust. SCTM# 1000-79-5-20.2. What's the pleasure of
the Board?

Mr. McBonald: Should we do a resolution on the winery, to send our
comments on the winery law?

Mr. Ward: Well, I think we should. Do you want to summarize that Mark?
Mr. McDonald: I move that we send our comments on the current Winery
Law for the Town Board over to them, 0asically being that wineries should
be allowed subject to the normal site plan review in all commercial zones
other than RO, and in areas where they are allowed by Special Exception on
residential properties, that there be a minimum of ten acres contiguous
with the winery.
