Mr. Ward: Oood evening. I'd ike to call the June 15, 1994 Planning Board meeting
to order. The first order of business is the setting of the next Planning Boa rd
meeting. Board to set Monday, July 11, 1994 at 7::50 p.m at the Southold Town
Hall, Main Road, $outhold as the time and place for the nex~ regular Planning
Board meeting.

Southold Town Planning Board 2 June 15, 1994
Public Hearings:
Mr. Ward: At 7:50 p.m., Frances B. Rauch and R. Stewart Rauch, Jr. - This minor
subdivision is for $ lots on 10.9 acres located off Equestrian Ave. on Fishers Island.
SCTM# 1000-9-9-22. Is the applicant or an agent here of the applicant, who
would like to address the Board? If not, what's the pleasure of the Board?
Mr. McDonald: I make a motion to close the hearing.
Mr. Orlowski: I second it.

Mr. McDonald: Mr. Chairman, I'd like to make a further motion that
WHEREAS, Frances B. Rauch and R. Stewart Rauch, Jr. are the owners of SCTM#
~ 000-9-9-22 and John C. Evans ~s the owner of SCTM# 1000-9-9-I 6, located off
Equestrian Ave. on Fishers Island; and
WHEREAS, this minor subdivision is for $ lots on 10.9 acres; and
WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a
Negative Declaration on August 9, 1993; and
WHEREAS, a final public headng was closed on said subdivision application at Town
Hall, Southold, New York on June 13, 1994; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore,
RESOLVED that the Southold. Town Planning BOard grant conditional final
approval on the surveys dated January 27, 1994, and authorize the Chairman
to endorse the final surveys subject to fulfillment of the following condition.
This condition must be met within six (6) months of the date of this resolution:
Five (5) paper prints and two (2) mylars of the final maps, all containing a
valid stamp of Health Department approval and a notation that a
Declaration of Covenants and Restrictions was filed pertaining to the
subdivision must be submitted.

to address the Board? If not, an order to close the hearing?

WHEREAS, Thomas A. Palmer and Joan C. Gibbs are the owners of the
property known and designated as SCTM# 1000-123-4-4 & 5 located on Deep
Hole Drive in Mattituck; and,
WHEREAS, this lot line change, to be known as lot line change for Thomas A.
Palmer and Joan C. Gibbs is for a lot line change to subtract 9,300 square feet
from a 21,500 square foot parcel and add it to a 11,900 square foot parcel.
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on May 23, 1994; and,
WHEREAS, a variance was granted by the Zoning Board of Appeals on May 4,
1994; and

WHEREAS, a final public hearing was closed on said lot line change application
at Town Hall, Southold, New York on June 13, 1994; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; and De it therefore,
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated February 23, 1994 and authorize the Chairman
to endorse the final surveys subject to fulfillment of the following condition.
This condition must be met within six (6) months of the date of this resolution.
1. The filing of new deeds pertaining to the merger of the 9,300 square feet
from the 21,500 square foot parcel SCTM# 1000-123-4-4 with the 11,900
square foot parcel SCTM# 1000-123-4-5.

Mr. Ward: The next order of business, 7:40 p.m. for Peconic Homes - This
minor subdivision is for 2 lots on 45.9741 acres located on the south side of
Sound Ave.; 1917 feet east of Farmveu Road in Mattituck. SCTM# 1000-121-
3-7.1. Is the owner here, or the agent who would like to address the Board?
At this point, is anybody here that would like to address the Board on this
application. Would you please state your name for the record?
Barbara Sayer: I'm a neighbor. I live on Laurel Lake Road (inaudible). What I
want to give you now is a letter that the Laurel Lake Pro perry Owners
Association wrote to Mr. Gaffney, the County. Executive, and it mentions
Southold Town Board and six parcels and the quarter percent sales tax, and so
forth, and I just wanted to submit this for your record on this matter.
Mr. Ward.: Airight, thank you very much. Is there anybody else that would like
to address the Board on this particular application? If not, I think we're all in
order to close the hearing?

WHEREAS, Peconic Homes Corp. is the owner of the property known and
designated as SCTM# 1000~121-3-7.1, located at the south side of Sound Ave.;
1917 feet east of Farmveu Rd. in Mattituck; and
WHEREAS, this minor subdivision, to be known as Peconic Homes, Inc., is for
2 lots on 45.97 acres; and
WHEREAS, the Southold Town Planning Board: pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on November 15, 1993; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on June 13, 1994; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated July 30, 1993, and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following conditions. All
conditions must be met within six (6) months of the date of this resolution.
The Declaration of Covenants and Restrictions required by the Planning
Board must be recorded in the County Clerk's office. The Liber and Page
number of the recorded document must be noted on the final map.

Mr. Ward: Stevens/Hannabury - This lot line change consists of 2 applications
that are being reviewed concurrently for Nina Stevens and Joseph Hannabury
et al. It is located on tt~e north side of Oregon Rd.; approximately 150 feet east
of Cox Lane in Cutchogue. SCTM# 1000-83-2-8 & 11.
Mr. Orlowski: I make a motion that
BE IT RESOLVED that the Southold Town Planning Board acting under the
State Environmental Quality Review Act, do an uncoordinated review of this
unlisted action. The Planning Board establishes itself as lead agency, and as
lead agency makes a determination of non-significance and grants a Negative
Declaration.

Mr. Ward: The O'Kula Family - This minor subdivision is for a 1.6072 acre
parcel from an existing 16.5116 acre parcel located on Indian Neck Rd. in
Peconic SCTM# 1000-103-1-19.2. At this time is the applicant or agent here
that would like to address the Board?
Henry Raynor: Good evening gentlemen. On behalf of the applicant, Ithink
everything is ~n order in regard to the section of the Subdivision Regulations. If
there are any questions concerning this I'd be more than happy to address
them. If not, I'll just sit down.
Mr. Ward: The SEQRA determination is in order for a resolution at this time.

BE IT RESOLVED that the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, established itself as lead agency on
May 23, 1994, and as lead agency makes a determination of non-significance
and grants a Negative Declaration on this Type I action.

BE IT RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated January 14, 1994, upon the-following conditions:

1. This is a clustered subdivision, therefore the following statement shall be
placed within the boundaries of the 14.9044 acre lot on the final map:
"VVhen the 14.9044 acre lot is subdivided in this clustered subdivision, the
yield shall be determined after first subtracting 10,000 square feet in area
from the 14.9044 acre lot because said land represents the clustered open
space for the 70,009 square foot lot.
Submission of a copy of the recorded Declaration of Covenants and Restric-
tions. A notation of the Liber and Page number of the recorded Declaration
must be on the final prints (2 mylars and 5 paper prints).

Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board
grant a six month extension of sketch approval from June 14, 1994 to
December 14, 1994. Conditional sketch approval was granted on June 14,
1993.

Mr. Ward: Under other items, we have David Saland and Luis San Andres -
Planning Board to abandon 4 lot minor subdivision approved on October 23,
1987. SCTM# 1000-125-1-2.26, 2.27, 2.28 & 2.29.
Mr. McDonald: I'd like to make a motion that
WHEREAS on July 6, 1987, the Planning Board granted conditional final
approval to a four (4) tot minor subdivision on 22.9387 acres for David Saland
and Luis San Andres; and
WHEREAS, a condition of final approval required that a Declaration of
Covenants and Restrictions be recorded restricting the future subdivision of the
four (4) lots and establishing a conservation easement on proposed Lot Number
4 from the 40' contour line northward to the marsh; and
WHEREAS, all conditions 'of final approval were fulfilled and the subdivision
was endorsed by the Planning Board Chairman on December 14, 1987; and
WHEREAS, Laurel Lake Vineyard, LTD, purchased the entire 22.9387 acre
parcel consisting of the four (4) lot subdivision from Saland and San Andres,
and sold the development rights to Suffolk County on 20.878 acres of the
parcel in June of 1994; and
WHEREAS, the development rights were not sold on a 2.06 acre portion of this
subdivision area which was reserved for future use; and
WHEREAS, this 2.06 acre area is not recognized by the Planning Board as a
separate parcel; and
WHEREAS, Laurel Lake Vineyard, LTD, wishes to abandon the four (4) lot
subdivision; be it therefore
RESOLVED that the Southold Town Planning Board abandon the December
14, 1987 four (4) lot subdivision for David Saland and Luis San Andres, and
that this abandonment of the subdivision causes the property to revert to one
22.938 acre parcel as described in the attached Schedule A. In addition, the
Declaration of Covenants and Restrictions required at the time of subdivision
approval is no longer required, and should be so abandoned in the office 'of the
County Clerk.
