Mr. Ward: Good evening. Welcome to the May 23, 1994 Planning Board
meeting. The first order of business is the setting of the next Planning Board
meeting. Board to set Monday, June 13, 1994 at 7:30 p.m. at the Southold Town
Hall, Main Road, Southold as the time and place for the next regular Planning
Board meeting.

Paul Grosser: President of P.W. Grosser Consulting. I'd just like to update you
as best I can on the water issues in regard to Hillcrest Estates. The Health
Department samples have all been taken. We are awaiting the results. We've had
some preliminary results that indicate about 8 of the lots do not meet drinking
water standards. We'll be looking at the covenants as well as reviewing the lot
layout, based on finalization of those results. We still haven't gotten the pesticide
results back yet. Other than that rd be willing to answer any questions at this
point.
Mr. Ward: At this point, what the Board is going to do, because we have to act
tonight on the basis of subdivision, is that we're going to have a motion that's
going to come up now that is going to actually bring you back to prelim. We'll

still pursue expeditiously with you, from our end, all the reviews and that, but we
are at a point where we just can't extend this any longer. By code and by law we
have to, at this point, take an action. It doesn't mean that we are going to drop
dead on this project, but it will mean that we will have to go back to the prelim
and then move ahead with you through this process. So that's where we're at. I'd
like to have the Board, at this point, present a resolution.
Mr. McDonald: Mr. Chairman, rd like to make a motion that
WHEREAS, preliminary approval was granted to the major subdivision of
Hillcrest Estates (Section One and Section Two) on June 15, 1982; and
WHEREAS, the final plat for Hillcrest Estates Section One was approved on
March 7, 1983; and
WHEREAS, since 1986, miscellaneous information pertaining to the application
for Section Two was submitted, reviewed and processed by the Planning Board,
however, the final submission was never completed; and
WHEREAS, the road improvements for both Sections .were constructed at the
same time, although a performance guarantee was not submitted for Section Two;
and
WHEREAS, since the applicant notified the Planning Board that he intended to
aggressively pursue the pending subdivision application, a final hearing for
Hillcrest Estates Section Two was set for October 19, 1992; and
WHEREAS, the final hearing was held on October 19, 1992, and was held open
to allow the applicant to obtain Health Department approval and to complete
other outstanding requirements for final subdivision approval; and
WHEREAS, the Planning Board agreed to numerous extensions requested by the
applicant to allow the final hearing to remain open; and
WHEREAS, the Planning Board, on March 28, 1994, closed, the final hearing
thereby establishing a final time frame of sixty-two (62) days to make a final
determination on the final subdivision and notified the applicant that the final
determination was scheduled for the Planning Board's May 23, 1994 meeting, and
that all outstanding items must be completed by that date; and
WI-tEREAS, the applicant was unable to submit all of the outstanding items
needed by the Planning Board to grant final approval to the subdivision within the
established time frame; be it therefore
RESOLVED that the Southold Town Planning Board deny without prejudice the
final application for Hillcrest Estates Section Two.

The Planning Board's denial of the fmal application has caused the proposed
subdivision to regress to the preliminary stage of subdivision review. If final
approval is not reapplied for within six (6) months of the date of this resolution,
the Planning Board shall revoke the preliminary plat approval, and the file shall be
closed. The following items are required to reapply for final approval of Hillcrest
Section Two:
As per the Planning Board's policy, a new application fee equal to
one-half the major subdivision application fee must be submitted.
The fee is to be calculated as follows: $500. plus $50. per acre or
part thereof in the proposed subdivision.
Final maps (5 paper prints and 2 mylars) containing a stamp of
Health Department approval must be submitted.
Verification from the Orient Fire District must be submitted stating
that the water storage tanks that were installed in lieu of fire wells
have been installed in a satisfactory manner. The location of the
storage tanks must be indicated on the final subdivision map.
A Homeowners Association must be prepared for all areas of
common ownership within the subdivision. A draft of the document
must be submitted to the Town for review. Once the document is
approved by the Town, it must be recorded prior to any endorsement
of the final subdivision.
A draft bond estimate of the work remaining' to be completed must
be submitted for review by the Planning Board and the Engineering
Inspector. Once the bond estimate is approved by the Town, a
performance guarantee will be required prior to any final approval of
the subdivision. An inspection fee will also be required. The
inspection fee will be calculated on the amount of the overall
improvements for Section Two, not for the work included in the
above mentioned bond estimate.
As noted in the Planning Board's letter dated May 10, 1994, the
Planning Board determined that additional environmental
documentation, as detailed in the report dated April 29, 1994, from
the Board's consultant, was necessary in order to provide a
means to assess the si~ificance of the impacts outlined in the
report. Once the additional documentation is submitted, the
Planning Board will continue the SEQRA review.
The SEQRA review may necessitate changes to the final map, the
recording of a Declaration of Covenants and Restrictions and the
submission of additional information. You will be notified if any of
these are required as the SEQRA review progresses. The information

required by the Planning Board in the May 10th letter must be submitted within
three (3) months from the date of this resolution to allow the SEQRA review, and
any additional information and changes to the map required as a result of the
review, to be completed within the six (6) month time frame.
