Mr. Ward: Good evemng. I'd like to call the May 9, 1994 Planning Board meeting to
order. Welcome to all those in the audience tonight. The first order of business is the
setting of the next Planning Board meeting. Board to set Monday, May 23, 1994 at
7:30 P.M. at the Southold Town Hall, Main Road, Southold, as the time and place for
the next regular Planning Board meeting.
Mr. Orlowski: So moved.

APPLICATIONS
Final Extensions:
Mr. Ward: Highpoint Woods at East Marion - This major subdivision is for 10 lots on
20.5668 acres located on the north side of Main Road in East Marion. SCTM# 1000-
79-5-20.2. What's the pleasure of the Board?
Mr. Orlowski: I make a motion that
BE IT RESOLVED that the Southold Town Planning Board grant a six (6) month
extension of conditional final approval. Conditional final apprqval was granted on
November 15, 1993. The six month extension will expire on November 15, 1994
unless all conditions of approval have been fulfilled.

Mr. Ward: Anna K Plock - This major subdivision is for 5 lots on 21.79 acres located
on an existing r-o-w off North Bayview Road approximately 935 feet east of Reydon
Road in Southold. Four of the lots are between 1.7 acres and 2.2 acres in size. The
fifth lot is a reserved area to be conveyed to The Peconic Land Trust. SCTM# 1000-
79-5-20.2 What's the pleasure of the Board?

BE IT RESOLVED that the Southold Town Planning Board grant a six month extension
of preliminary approval from May 3, 1994 to November 3, 1994. Conditional
preliminary approval was granted on May 3, 1993.

located on the west side of Laurel Ave.; 140 feet south of Yennecott Drive in Southold
SCTM# 1000-55-6-35 & 36 and 1000-56-1-1. What's the pleasure of the Board?

BE IT RESOLVED that the Southold Town Planning Board grant an additional six
month extension of preliminary approval from June 14, 1994 to December 14, 1994.
Conditional preliminary approval was granted on December 14, 1992.

month extension of preliminary approval from April 27, 1994 to July 27, 1994.
Conditional preliminary approval was granted on April 27, 1992.

of sketch approval from May 15, 1994 to November 15, 1994. Conditional sketch
approval was granted on November 15, 1993.

APPLICATIONS -STATE ENVIRONMENTAL QUALITY REVIEW ACT
Determinations:
Mr, Ward: Hilicrest Estates - Section 2 - This n~ajor subdivision is for 20 lots on 22.9
acres located in Orient. SCTM# 1000-13-2-8.5. What's the pleasure of the Board?
Mr, McDonald: Would you like to address the Board?
Ben Kinzler: It's my understanding that there are some environmental issues that the
Board wishes to address and we'd be certainly interested in hearing from the Board
initially.
Mr. Ward: We're looking to take lead agency tonight. We have a determination with

the Suffolk County Planning Commissions report- Why don't we go through that and if
you have any questions at the end, you could address it.
Mr. McDonald: Mr. Chairman, I'd like to make a motion that
BE IT RESOLVED that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, assume lead agency status on this unlisted action.
Mr. Orlowski: Second.
Mr. Ward: Motion seconded. All in favor?.
Ayes: Mr. McDonald Mr. Latham, Mr. Odowski, Mr. Ward.
Mr. Ward: Opposed? Motion carried.
Mr. McDonald: I make a second motion that
WHEREAS, the Planning Board and the Planning Board's enwronmental consultant
have reviewed the proposed subdivision in accordance with the State Environmental
Quality Review Act; and
WHEREAS, it has been determined that the site contains unique and valuable
environmental features including escarpments and steep slope topography, wooded
slopes adjacent to Long Island Sound, visual resources, a diversity of soil types with
some constraints, and a high cultural resource sensitivity; and
WHEREAS, the above mentioned features require careful consideration by the
Planning Board as lead agency in review of the proposed project; be it therefore
RESOLVED, that the Southold Town Planning Board require that additional
environmental documentation, as detailed in the report dated April 29, 1994 from
Charles J. Voorhis, be prepared in order to provide a means to assess the significance
of these impacts.
The Planning Board, by closing the final hearing on March 28, 1994, established a time
frame of sixty-two (62) days to make a final determination on the final subdivision. The
final determination has been scheduled for the Planning Board's May 23, 1994 public
meeting. Therefore, the outstanding items as listed in the Board's February 3, 1994
correspondence, must be completed by that date.

Mr. McDonald: I'd like to make a third resolution
BE IT RESOLVED to override the May 5, 1994 Suffolk County Planning Commission
report, as per Section 100-32 B, (2) of the Zoning Code, the bulk and parking
requirements set forth for the R-40 district apply to all lots shown on the major
subdivision maps upon which the Planning Board held a hearing for preliminary map
approval prior to May 20, 1983. Preliminary approval was granted to Hillcrest Estates
Section Two prior to May 20, 1983.

Mr. Ward: Opposed? Motion carried. So we're looking for a further review of the
items that Cramer and Voorhis have identified as potential issues, if you could address
those and get those back to us.
Mr. Kinzler: Could we get a copy of that?
Mr. Ward: Yes.
Mr. Kinzler: 1 wanted to let the Board know, if it's of interest, a couple of things.
Number one, I know that the firewells have been an ongoing issue. I don't want you to
feel that they've been ignored. Casola had initiated the wells and ran into some
problems with the fine soil and I understand that they have just about completed, or
have completed the installation of the wells. I hope to be able to report to you very
quickly that has been completed. I know it's been a concern.
Al the wells have been installed on each lot and samples have been taken by the
Board of Health. I understand on one tot they couldn't draw a sufficient quantity of
water to take a test, but they have taken all the other lots and they're supposed to
have been due a couple of days ago, we haven't yet gotten it. We expect it
momentarily. Hopefully everything will be completed and finalized by your May 23rd
date.
Mr. Latham: You mentioned wells. Did you mean tanks or wells?
Mr. Kinzler: We've drilled wells on each...
Mr. Latham: I meant firawells.
Mr. Kinzler: As I understood it, and I'm not sure if you were here at the last meeting,
when Casola had dug the wells, he couldn't draw sufficient water, and so they got
special permission from the fire distdct to install the wells.
Mr. Latham: Yeah, I was confused about that.

Mr. Ward: While you're up here, on another subject on Grandview, you're also
involved in that particular subdivision?
Mr. Kinzler: I'm not personally involved in Grandview, but if there is an issue with
Grandview I'd be more than happy to address it with the client.
Mr. Ward: We had a question. We hear that there are going to be tanks placed in for
that for fire protection as well, instead of wells. The Planning Board has no idea, the
Town hasn't been advised, as to where they're proposed to go. We haven't had any
communication from the applicant or the fire district.
Harold Reese: This was arranged with the Fire Commissioner and if he's neglected to
advise the Board, I'll make sure you have it.
Mr. Ward: OK
Mr. Reese: Casola did meet with the Fire Commissioner, both sides Grandview and
Hillcrest, to arrange for the tanks.
Mr. Ward: Well the Town doesn't know anything about it.
Mr. McDonald: Keep in mind that the fire commissioner's advise us. We decide about
the firewells and the tanks. We have no reason to doubt anything that they've ever
done, but the decision...
Mr. Kinzler: We were not aware of that and if what you're saying is that Casola and
the Fire Commissioner have preernpted your authority, it was not intentional.
Mr. McDonald: No. there' s no real reason to disagree with them. They know what
· they're doing.
Mr. Kinzler: No, but our ignoring you was not intentional.
Mr. Latham: Are they putting tanks down at Grandview, not wells?
Mr. Reese: Tanks.
Mr. Ward: Do they have make-up water for these tanks?
Mr. Reese: I don't understand the question.
Mr. Ward: Are they putting in a small well that would make uP water for these tanks or
is it something...
Mr. Reese: My understanding, and I could be wrong about this, that the fire
department is responsible for filling the tanks if it is used. That was my understanding
and I could be wrong in that regard.

Mr. Kinzler: I know that Casola had the same problem with the other wells as well,
they didn't draw sufficient water.
Mr. Ward: OK, we appreciate it. We're trying to reach the distdct also.

Mr. Ward: Also tonight we have before us a proposed legislation in relation to
Accessory Buildings and Structures. I think it's in order that we have a resolution to
pass on our report to the Town Board.
Mr. McDonald: make a motion that we send this report to the Town Board.
Mr. Orlowski: Second.

Mr. Ward: Opposed? Motion carried Any further business to come before the

Ms. Scopaz: No.
Mr. Ward: Members of the Board? Anybody in the public, while we're in the official
public meeting, as we're going to be going into a worksession following this, if you
have anything that you'd like to discuss, you're welcome to stay for that. If not...
