SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated October 31, 2007 stating that this application is considered a matter for local determination as
there appears to be no significant county-wide or inter-community impact.
PROPERTY FACTS/DESCRIPTION: The McNulty property is shown as County Tax Map (CTM) 145-2-1.4
with an area of 22, 151 square feet and 52.58 feet along the south side of Peconic Bay Boulevard and 435.12 feet
extending to Peconic Bay. The Diller property is shown as CTM 145.2-1.5 with an area of 20,877 square feet
and 89.63 feet along the south side of Peconic Bay Boulevard and also extending to Peconic Bay.
BASIS OF APPLICATION: Request for a Variance under Zoning Code Section 280-18, based on the Building
Inspector's July 26, 2007 Notice of Disapproval which states that the Bulk Schedule requires a minimum lot
area of 40,000 square feet. The area of CTM Parcel 1000-145-02-1.5 will be reduced from 20,877 square feet to
20,093 square feet, creating a greater degree of nonconformity with a lot line change, to enlarge CTM Parcel
1000-145-02-1.4 from 22,151 square feet to 22,936 square feet. Both parcels are currently improved with a
single-family dwelling and contain nonconforming lot sizes in this R-40 Low-Density Residential Zone District.
RELIEF REQUESTED: The co-applicants are property owners with adjacent lots that are both non-conforming
in size in the R40 Zone District. They are seeking a lot line change which will reduce the Diller property (CTM
parcel 1000-145-02-1.5) from 20,877 square feet to 20, 093 square feet and annex this 785 square feet to the
neighboring McNulty property (CTM 1.4) in order to create a code conforming 10,9 feet side yard setback on the
McNulty property. Such action requires an area variance for the Diller property from the Board of Appeals
before the Planning Board can issue a lot line change,
ADDITIONAL INFORMATION: McNulty proposes to provide a 5 ft. easement within this new side yard
setback as access to Peconic Bay for the Diller property. A letter from the Southold Town Planning Board
dated November 20, 2006 signed by Anthony p, Trezza, Senior Planner, states that if the ZBA grants a

variance then the Planning Board would process the applicants' application and issue an approval for the
requested lot line change.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Town Law &267-b(3)(b)(3)(l). Grant of the variance will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. No visible change will occur as a result of this lot line
change and a non-conforming side yard setback will be eliminated on the McNulty property.
2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance because both lots are nonconforming in size.
3. Town Law &267-b(3)(b)(3)' The variance granted for 875 square feet herein is not substantial on lots that
are both more than 20,000 square feet.
4. Town Law &267-b(3)(b)(5). The difficulty has not been self-created. The location of the house on the McNulty
property pre-dates the zoning code.
5. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. It
merely moves a property line.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of a lot line change with conforming side yard setback, while preserving and protecting the
character ofthe neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Dinizio, and duly
carried, to
GRANT the variance as applied for, and shown on the survey map prepared by Young and Young,
licensed land surveyors, for Edna McNulty dated September 7, 2005.
Vote of the Board: Ayes: MemberNice Chairwoman Oliva, Member Dinizio, and Member Weisman. This
Resolution was duly adopted (3-0). [Absent were Chairman Goehringer and Member Simon.]

Dear Mr. Goggins:
This will confirm our telephone conversation, that Town Counsel advised our office that a
current written consent from the owner of CTM 1000-145-2-1.5 is required before a ZBA
determination may be issued concerning the pending lot-line change variance application. For your
convenience when replying, we enclose a copy of the incomplete notice with inquiries noted in
preparation of the hearing requested to be held on November 15, 2007.
Also, in reviewing the Affidavit of Mailing with attached certified mail receipt for three
adjacent landowners today, we noticed that two other adjacent landowners were also required to be
notified. As soon as may be possible, please also furnish the additional proof of mailings and
Supplemental Affidavit of Mailing concerning two other adjacent landowners ofCTM 1000-145-2-
1.5 (Diller), and for CTM 1000-129-1-3.1 (owner ofland across the street).

f Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. I f no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

INSTRUCTIONS
L All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the L WRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
