THIS INDENTURE, made the/~oi December, 2007
BETWEEN
CDCLI HOUSING DEVELOPMENT FUND CORPORATION, a New York not for profit corporation with
offices located at 2100 Middle Country Road, Center'each, New York 11720, party of the first part, and
DAVID VAN POPERING, residing at 475 Youngs Avenue, Southold, New York 11971, party of the
second part,
NOTE: This deed conveys property subject to Affordable Housing Restrictions o! the Town of southold
and County of Suffolk as set forth of record.
WITNESSETH, that the party of tha first part, in consideration of Ten and O0/100-($10.)-Doliars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain p[ol, piece or parcel of land, situate, lying and being at Mattituck, in the Town of
Southold, County of Suffolk and State of New York, known as Lot 1 on a certain map entitled, "Map of
cottages at Mattituck', filed in the Office of the Clerk of the county of Suffolk on January 30, 2007 as
Map No. 11491, bounded and described as follows:
BEGINNING at a point on the easterly side of cottage Way distant 257.78 feet seuthedy as measured
along the easterly side of Cottage Way from the corner formed by the intersection of the eastarly side of
Cottage Way and the seuthedy side of Sound Avenue (North Road);
THENCE North 69 degrees 52 minutes 20 seconds East 36.25 feet;
THENCE South 18 degrees 39 minutes 40 seconds East, 28.73 feet;
THENCE South 21 degrees 50 minutes 20 seconds East 147.58 feet;
THENCE South 70 degrees 55 minutes 20 seconds West 133.28 feet to the easterly side of Cottage
Way;
THENCE Northerly along the eastady side of Cottage Way the following two courses and distances:
1. Northerly along an arc of a curve bearing to the right having a radius of 100.00 feet a-distance of
67.33 feet to a paint;
2. Still northerly along an arc of a curve bearing to the left having a radius of 150.00 feet a distance of
136.12 feet to the point or place of BEGINNING
BEING AND INTENDED TO BE part of the premises conveyed to the party of the first part by deed
dated February 8, 2007, recorded March 5, 2007 in Liber 12494 page 982.
SUBJECT to DecJaration of Covenants and Restrictions between CDCLI Housing Development Fund
Corporation and Town of Southold dated 11117/06 and recorded on 11/28/06 in Liber 12480 page 627.
SUBJECT to Declaration of Covenants and Restrictions required by Southold Town Planning Board
dated 12J08106 recorded on 12/14/06 in Liber 12483, Page 291.
SUBJECT to conditions, covenants and other terms of deed from county of Suffolk to Town of southold
dated February 8, 2007 and recorded March 3, 2007 in Libor 12494, Page 951.
EXCLUDING all dght, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the f~rst part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose. The word 'party' shall be construed as if it read 'parties"
whenever the sense of this indenture so requires.
