Mr. Ward: Good evening. I'd like to cai the October 23, 1995 Planning Board
meeting to order. The first order of business is the setting of the next Planning
Board meeting. Board to set Monday, November 13, 1995 at 7:30 p.m., at the
Southold Town Hall, Main Rd., Southold as the time and place for the next
regular Planning Board meeting.
Mr. Cremers: So moved.
Mr. Latham: Second.
Mr. Ward: Moved and seconded. All in favor?
Ayes: Mr. Latham, Mr. Edwards, Mr. Cremers, Mr. Ward.
Mr. Ward: Opposed? Motion carried. I'd just like to make an announcement
that tonight we don't have the microphones set up, so if you wanted to address
the Board in the formal session, the public hearing session, we'd appreciate
you to come and speak towards this microphone here. We don't have that large
a group here anyway tonight, so if you'd do that it would be much appreciated,
when you give your name and just come up here close to this microphone.

7:30 p.m. - Stanley & Sharon Swanson and Robert Hamilton - This lot line
change is to subtract 8,129 square feet from a 35,389 square foot parcel and
add it to a 44,094 square foot parcel. SCTM# 1000-141-2-15 & 21.5. Is the
applicant here. or agent for the applicant? If not, everything is in order to close
the hearing. Is there a motion?
Mr. Cremers: So moved.
Mr. Latham: Second.
Mr. Ward: Moved and seconded. All in favor?
Ayes: Mr. Latham, Mr. Edwards, Mr. Cremers, Mr. Ward.
Mr. Ward: Opposed? Motion carried. What's the pleasure of the Board?
Mr. Cremers: Mr. Chairman, I'd like to make the following motion.
WI~EREAS, Stanley and Sharon Swanson and Robert Hamilton are the owners
of the property known and designated as SCTM# 1000-141-2-15 & 21.5,
located on Horton Ave. and Oak St., Mattituck; and
WHEREAS, this lot line change, to be known as lot line change for Stanley and
Sharon Swanson and Robert Hamilton is to subtract 8,129 square feet from a
35,389 square foot parcel and add it to a 44,094 square foot parcel; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on September 11, 1995; and
WHEREAS, a variance was granted by the Zoning Board of Appeals on
September t3, 1995; and
WHEREAS, a final public hearing was closed ...

WHEREAS, a final public hearing was closed on said lot line change
application at Town Hall, Southold, New York on October 23, 1995; and

WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated August 2, 1995 and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following condition. This
condition must be met within six (6) months of the date of this resolution:
1. The filing of new deeds pertaining to the merger of the 8,129 square feet
from the 35,389 square foot parcel SCTM# 1000-141-2-21.5 with the 44,094
square foot parcel SCTM# 1000-141-2-15. Is there a second?
Mr. Edwards: Second the motion.
Mr. Ward: Motion seconded. All in favor?
Ayes: Mr. Latham, Mr. Edwards, Mr. Cremers, Mr. Ward.
Mr. Ward: Opposed? Motion carried.
Mr. Ward: 7:35 p.m. - Oast House Brew Pub - This proposed site plan is for a
restaurant "brew pub" located on the 3 acre business zoned area of a 26 acre
parcel in Cutchogue. SCTM# 1000-103-1-19.3. I see the applicant is here. Is
there anything you wish to address the Board on, you may at this time, or we'll
just proceed.
Frank Cichanowicz. You can proceed. I'm just here as a listener.
Mr. Ward: In that case, all is in order to close the hearing.

Mr. Latham: Mr. Chairman, I offer this resolution.
WHEREAS, Frank Cichanowicz, III, is the owner of the property known and
designated as SCTM# 1000-103-1-19.3, located on Main Road in Cutchogue,
and;
WHEREAS, this site plan, to be known as site plan for Frank Cichanowicz, III
(Island Ale) is for a restaurant and affiliated microbrewery; and
WHEREAS, the Southold Town Board, pursuant to the State Environmental
Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued
a Negative Declaration on May 15, 1995;and
WHEREAS, a final public hearing was closed on said site plan application at
Town Hall, Southold, New York on October 23, 1995; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated September 27, 1995 and authorize the Chairman
to endorse the final surveys subject to fulfillment of the following condition.
This condition must be met within six (6) months of the date of this resolution:
1. Curb cut permit from the New York State Department of Transportation.

Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board
set Monday, November 13, 1995 at 7:30 p.m. for a final public hearing on the
maps dated April 4, 1994.
Mr. Latham: Second.

Review of Reports: Engineer
Mr. Ward: Wildberry Fields - This major subdivision is for 10 lots on 22.3886
acres located on the south side of Sound View Ave.; 289 feet west of Clark
Road and the north side of County Road 48, 320 feet west of Clark Road in
Southold. SCTM# 1000-51-3-12.2 & 12.4. What's the pleasure of the Board?
Mr. Cremers: Mr. Chairman, I'd like to make the following resolution.
Be it resolved to adopt the Engineering Inspector's report dated October 13,
1995.
Be it resolved to adopt the bond estimate dated September 20, 1995, and to
recommend same to the Town Board. The bond estimate is in the amount of
$288,700.00, with an administration fee in the amount of $17,322.00.

Mr. Ward: Bayberry Estates - This major subdivision is for 18 lots on 50.0171
acres located on the west side of Laurel Ave.; 140 feet south of Yennecott
Drive in Southold. SCTM# 1000-55-6-35 & 36 and 1000-56-1-1. What's the
pleasure of the Board?
Mr. Edwards: Mr. Chairman, I move to adopt the bond estimate dated July 21,
1995,and to recommend same to the Town Board. The bond estimate is in the
amount of $345,425.00, with an administration fee in the amount of $20,725.50.
Mr. Cremers: Second.
Mr. Ward: Motion seconded. All in favor?.
Ayes: Mr. Latham, Mr. Edwards, Mr. Cremers, Mr. Ward.

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF
APPLICATIONS - STATE ENVIRONMENTAL QUALITY REVIEW ACT
Draft Environmental Impact Statement:
Mr. Ward: Indian Shores - This major subdivision is for 17 lots on 105.6 acres
located on the south side of Main Rd. and the north side of New Suffolk Ave.,
in Cutchogue. The 37.47 acre 17th lot is proposed to be sold to the Town as a
Town Park. SCTM# 1000-116-1-3. What's the pleasure of the Board?
Mr. Latham: Mr. Chairman, I make a motion that the Southold Town Planning
Board deem the August 1995 Draft Environmental Impact Statement incomplete
with respect to its scope, content and adequacy for the purpose of commencing
public rewew.
Mr. Cremers: Second.
Mr. Ward: Motion seconded. All in favor?.

Final Determinations:
Mr. Ward: The Oast House Brew Pub. We've done that. There is no further
business on our agenda. We are going to be going into a work session
immediately following this which is the time we had asked the group of you to
come in, but if there is anything anybody here would like to put on the record,
they may do so now, but we will be adjourning into a work session. If not,
motion in order to close.
Mr. Latham: Move it.
