Jones, Secretary Absent: Valerie Scopaz, Town Planner RECORDING MACHINE MALFUNCTIONED. THE FOLLOWING IS A RECONSTRUCTION OF STAFF NOTES Mr. Ward: Good evening. The first order of business for this evening is the setting of the next Planning Board meeting. Board to set Monday, October 2, 1995 at 7:30 p.m., at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board meeting. Is there a second? MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF APPLICATIONS , Southold Town Planning L_~'d 2 'f"", September 11, 1995 Final Determinations: Mr. Ward: Gregory Simonelli - This minor subdivision is fOr 3 lots on 3.85 acres located on the soUth side of Grand Ave,; approximately 150 feet west of Greton Court, in Mattituck. SCTM# 1000-107-2-4. What's the pleasure of the Board? Mr. Cremers: Mr. Chairman, I make a motion that the Southold Town Planning Board authorize the Chairman to endorse the final surveys dated December 27, 1994. Conditional final approval was granted on April 10, 1995. All conditions have been fulfilled. Mr. Latham: Second. Mr. Ward: Motion seconded. All in favor? Mr. Edwards: Mr. Chairman, I make a motion that the Southold Town Planning Board authorize the Chairman to endorse the final surveys dated July 26, 1995. SCTM# 1000-33-3-19. What's the pleasure of the Board? Mr. Latham: Mr. Chairman, I move that the Southold Town Planning Board adopt the Engineering Inspector's report dated July 13, 1995. Mr. Latham: I make a further motion that the Southold Town Planning Board set Monday, October 2, 1995 at 7:30 p.m. for a preliminary public hearing on the maps dated June 8, 1995. Southold Town Plannin8 L.~d 4 September ! 1, 1995 Mr. Ward: The Fields at Mattituck - This major subdivision is for 27 lots on 60.4 acres located on the north side of Bergen Ave. in Mattituck. SCTM# 1000-113-2- 1.1. What's the pleasure of the Board? Mr. Edwards: Mr. Chairman, I make a motion that the Southold Town Planning Board set Monday, October 2, 1995, at 7:35 p.m. for a preliminary public hearing on the maps dated June 13, 1995. Bond: Release: Mr. Cremers: Mr. Chairman, I make a motion that the Southold Town Planning Board recommend that the Town Board release the Performance Bond Number 092179 for $120,000.00 for the above mentioned subdivision. Uncoordinated Reviews: Mr. Ward: Stanley & Sharon Swanson and Robert Hamilton - This lot line change is to subtract 8,129 square feet from a 35,389 square foot parcel and add it to a Mr. Ward: The Woods at Cutcho~ue - This approved clustered major subdivision is for 13 lots on 29.54 acres located in Cutchogue. Mr. Edwards: Mr. Chairman, I move that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, do an uncoordinated review of this unlisted action. The Planning Board establishes itself as lead agency, and as lead agency makes a determination of non-significance and grants a Negative Declaration. Mr. Latham: Second. Mr. Ward: Motion seconded. SITE PLANS Final Determinations: Mr. Ward: North Fork Sanitation- Transfer Station- This proposed site plan is for a transfer station located on Cox Lane in Cutchogue. SCTM# 1000-83-34.7. What's the pleasure of the Board? Mr. Cremers: Mr. Chairman, I move that WHEREAS, Roy A. Schelin and Joanne K. Schelin are the owners of the property known and designated as North Fork Sanitation, located at Cox Lane, Cutchogue, SCTM# 1000-83-3-4.7; and WHEREAS, a formal application for the approval of this site plan was submitted on February 27, 1995; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on April 10, 1995; and WHEREAS, this site plan was certified by Thomas Fisher, Senior Building Inspector, on August 7, 1995; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore Southold Town Planning Board September 11, 1995 RESOLVED that the Southold Town Planning Board grant conditional final approval on the surveys dated April 13, 1995, and authorize the Chairman to endorse the final surveys subject to a one year review from date of building permit. All conditions must be met within six (6) months of the date of this resolution. 1. Applicant must comply with recommendation of Cutchogue Fire Department. 2. Applicant must comply with recommendations of the Town Engineering Inspector as to drainage provisions. Applicant shall fence the property and install a sign at the entrance to indicate hours of operation and types of waste accepted and not accepted at the facility. Mr. Orlowski: Second. Mr. Orlowski: Mr. Chairman, I move that WHEREAS, Dr. & Mrs. Alex Boukas are the owners of the property known and designated as Dental Office for Dr. & Mrs. Alex Boukas, located at Main Road, Mattituck, SCTM# 1000-114-8-5; and WHEREAS, a formal application for the approval of this site plan was submitted on April 6, 1994; and WHEREAS:, the Southold Town Planning Board, pursuant to the State .Environmental Quality Review Act, (Article 8)~ Part 617, declared itself lead agency and issued a Negative Declaration on July 11, 1994; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore Southold Town Planning Board September 11, 1995 RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated July 19, 1995, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following conditions. All conditions must be met within six (6) months of the date of this resolution. 1. Curb cut permit from New York State Department of Transportation. 2. Review by Mattituck Fire District. 3. Ayes: Mr. Orlowski, Mr. Latham, Mr. Edwards, Mr. Cremers, Mr. Ward Southold Town Planning Board September 11, 1995 OTHER Mr. Ward: Whitey's Club Wave- This request for a site plan is to review adequacy of parking, traffic and other impacts due to a change in use and intensity of use at the property located on Rt. 25 in Southold. SCTM# 1000-56-6-7, 11.1, 11.2 & 10.1. What's the pleasure of the Board? Mr. Orlowski: Mr. Chairman, I move that WHEREAS, the Planning Board is the body charged by law with requiring, reviewing and approving site plans; and WHEREAS, Article XXV, Section 250 of the Southold Town Zoning Code grants the Planning Board the authority to require site plan approval when there is any change of use or intensity of use which will affect the characteristics of the site in terms of parking, access, drainage, open space or utilities; and WHEREAS, the Planning Board had adopted an as-built site plan on June 21, 1991, which showed two restaurants and two connected buildings With pre C.O.'s for residential use, one unoccupied and the other used for office and restaurant storage; and WHEREAS, Club Wave has initiated the rental of more than fifteen (15) watercraft such as wave runners, jet skis and banana boat rides in addition to its existing restaurant and bar business; and WHEREAS, a large trailer ~s now located on the site; and WHEREAS Club Wave has changed the use of the former chicken take-out restaurant to a water craft sales and rental office in addition to retail sales of marine supplies; and WHEREAS, this change in use and intensity of use represents a significant change in the nature of the prewous use, because the water craft rentals and boat sales have created an additional need for parking; and WHEREAS Club Wave has recently expanded its operation to an adjacent property by displaying and selling boats which will also result in the need for additional on- site parking; and WHEREAS, residential use has been introduced to one of the buildings. One of the restaurants, (the chicken take out), is now being used for watercraft rentars and sales in addition to retail sales of nautical supplies; be it therefore Southold Town ?lanning Board September 11, 1995 RESOLVED, that the Southold Town Planning Board has determined that boat sales, and rental of wave runners, jet skis and banana boat rides, the expanded operation to the adjacent property, the additional retail sales and the addition of the large storage trailer has resulted in a significant change in the nature and intensity of use from that shown on the as-built site plan that was approved in June of 1991; and BE IT FURTHER RESOLVED, that these changes trigger the need for a site plan review to consider the parking, traffic and other impacts which will be caused by the boat sales and rentals.
