party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and
other valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party
of the second part forever,

ALL that certain plot, piece or parcel of laad, with the buildings and improvements
thereon erected, situate, lying and being at Horton's Point, Town of Southold,
County of Suffolk and State of New York bounded and described as follows:
BEGINNING at an iron pipe set on the easterly line of a 20 foot right of way
known as Sunset Path, hercinaft, er described, distant North 22 degrees 30 minutes
West along said easterly line, 120.10 feet from its intersection with the boundary
line between land now or formerly of Margery D. Bums and land now or formerly
of Fischer, at a point on said boundary linc North 64 degrees 50 minutes West,
237.35 feet from land now or formerly of Jonathan Ovcrton, said point of beginning
being the southwesterly comer of land conveyed by Margery D. Burns to Peter
Squeri and Thea Squeri, his wife, dated December 31, 1955, and recorded January
20, 1956, in LIBER:4058 CP: 21 as confirmed by deed recorded in LIBER: 4069
CP: 148;
RUNNING THENCE along the land now or formerly of Squeri, North 85 degrees
08 minutes 40 seconds East, 165.28 feet to an iron pipe;
THENCE along land now or formerly of CarLsen, formerly of Margery D. Burns,
South 59 degrees 05 minutes 40 seconds East, 45 feet to other land now or formerly
of Carlson;
THENCE along said last mentioned land, South 66 degrees 12 minutes 10 seconds
West, 184.39 feet to the easterly line of said 20 foot right of way;
THENCE along the said easterly line of a 20 foot wide right of way North 22
degn:n~ 30 minutes West, 90.40 feet to the point of place of BEGINNING.
PARCEL Il

ALL that undivided one-fifth interest of, in and to all that certain tract, piece or
parcel of land, situate, lying and being in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a monument set on the easterly line of a 20 foot wide fight of way
known as Sunset Path, at the southeasterly comer of the herein described premises.
Said point of beginning being on the boundary line between land now or fom~erly of
Margery D. Burns and land now or formerly of Fischer, at a point on said boundary
line North 64 degrees 50 minutes West, 237.35 feet from land now or formerly of
Jonathan Ovenon;
RUNNING THENCE North 64 degrees 50 minutes West, along land now of
formerly of Witherspoon, 336.70 feet more or less to the high water mark of the
Long Island Sound;
THENCE North 34 degrees 15 minutes East, along the high water mark of the
Long Island Sound, 247.64 feet more or less to land now or formerly of Miller;
THENCE South 64 degrees 50 minutes East, along said last mentioned land, 172
feet more or less to the easterly line of the aforesaid 20 foot wide right of way
known as Sunset Path;
THENCE along the easterly line of said Sunset Path, the following two (2) courses
and distances:
South 25 degrees l0 minutes West, 130.10 feet;
South 22 degrees 30 minutes East, 170 feet to the point or place of
BEGINNING.
TOGETHER WITH AND SUBJECT TO A NON-EXCLUSIVE RECORD
RIGHT OF WAY over a 20 foot wide fight of way, known as Sunset Path, from
and to Horton Lane. The easterly line of said 20 foot wide fight of way is bounded
and described as follows:
BEGINNING at a point on the northeasterly line of Horton Lane distant 25 feet
southeasterly, when measured along said northeasterly line of Horton Lane, from the
point of beginning of the curve in said line as altered in 1941, which point of
beginning is also the point where the boundary line between land now or formerly
of Overton and land now or formerly of Foster intersects the northeasterly line of
Horton Lane;
RUNNING THENCE in a general northerly direction a distance of 39.27 feet
along the arc of a curve bearing to the left, having a radius of 25 feet, whose center
· is aforesaid point of besirming of the curve in the northeasterly line of Horton Lane
and which center is 25 feet westerly as measured along the northeasterly line of
H orton Lane from the point of beginning of the fight of way;,
THENCE in a general westerly direction, along the arc of a curve bering to the
left, having a radius of 225.88 feet, and eoncen~c with the northerly line of Horton
Lane and at all points distant 25 feet northerly therefrom, a distance of 87.54 feet;
THENCE North 14 degrees 59 minutes 20 seconds East, 181.95 feet;
THENCE North 22 degrees 30 minutes West, 170 feet;
THENCE North 25 degrees 10 minutes East, 130.10 feet to the northerly end of the
hereinabove described 20 foot wide right of way, known as Sunset Path.
PREMISES herein are the same as described in the deed to the grantors herein dated
6/15/95, recorded 6/26/95 in Liber 11730 cp. 587.
Said premises (Parcel 1) is known as 280 Sunset Path, Southold, New York.
TOGETHER with all right, title and interest, if any, of the party of the first part in and
to any streets and roads abutting the above described premises;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party oftbe fa-st pan has not done or
suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of the cost of the improvement before using any part of the
total of the sa.me for any other purpose.
The word "party' shall be construed as if it read 'parties' whenever the sense of this
indenture so requires.
