Planning Board meeting to order. The first order of business, the
setting of the next Planning Board meeting. Board to set Monday,
July t0, 1995 at 7:30 p.m. at the Southold Town Hall, Main Rd.,
Southold, as the time and place for the next regular Planning Board
meeting. Is there a second?
Mr. Orlowski: So moved.

Public Hearings
Mr. Ward: John and Marqaret Guest -- This minor subdivision is for
3 lots on 13.7 acres located on the west side of Crescent Ave. on
Fishers Island. SCTM~ 1000-6-1-5. Is the agent or applicant here
this evening, that would llke to address the Board? If not, is
there anyone present that would like to address the Board on this
application. If not, all is in order to close the hearing.

Mr. Edwards: Mr. Chairman, I move that WHEREAS, John S. Guest and
Margaret H. Guest are the owners of the property known and
designated as SCTM~ 1000-6-1q-5 located on the west side of Crescent
Ave. on Fishers Island; and
WHEREAS, this proposed minor subdivision is for 3 lots on 13.7
acres; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared
itself lead agency and issued a Negative Declaration on October 19,
1992; and
WHEREAS, a final public hearing was closed on said subdivision
application at the Town Hall, Southold, New York on June 12, 1995;
and
WHEREAS, all the requirements of the Subdivision Regulations of the
Town of Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional
final approval on the surveys dated February 2, 1995, subject to
fulfillment of the following condition. The condition must be met
within six (6) months of the date of this resolution.
1. Six (6) final subdivision maps and two (2) mylars must be
submitted. All maps must contain a valid stamp of approval from
the Health Department.

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF
APPLICATIONS
Final Determinations:
Mr. Ward: Anna K. Plock (a.k.a. Plock Shellfisher Preserve) -- This
major subdivision is for 5 lots on 21.79 acres located on an
existing right-of~-way off North Bayview Rd., approximately 935 feet
east of Reydon Rd. in Southold. Four of the lots are between 1.7
acres and 2.2 acres in size. The fifth lot is a reserved area to
be conveyed to the Peconic Land Trust. SCTM~ 1000--79-5-20.2. Is
the applicant here or agent of the applicant?
Mary Lou Folts: Mary Lou Folts, of Lark and Folts, for the
applicant. I believe we've met all the conditions of your final
approval of December 12 and I just request that you sign the maps.
I'd just like to wait, if I may, for them.
Mr. Ward: Is there anybody else here this evening that would like to
address the Board on this particular application? If not, what's
the pleasure of the Board?
Mr. Latham: I move that the Southold Town Planning Board authorize
the Chairman to endorse the final surveys dated October 4, 1994
(received by Planning Board May 25, 1995) and the final road and
drainage plans dated October 10, 1994. Conditional final approval
was granted on December 12, 1994. Ail conditions have been
fulfilled.

Mr. Edwards: Mr. Chairman, I move to adopt the Engineering
Inspector's report dated May 17, 1995.

Mr. Ward: Southold Villas - Sections t & 2 -- This approved major
subdivision is for 33 lots on 18.025 acres located on the west side
of Main Road in Southold. The subdivision is located in the
Affordable Housing District. SCTM% 1000-70--1--6. What's the
pleasure of the Board?
Mr. Cremers: Mr. Chairman, I move that the Southold Town Planning
Board recommend that the Town Board release the Letter of Credit in
the amount of ~50,300.000 for the above mentioned subdivision. Ail
required improvements have been completed.

Site Plans Final Determinations:
Mr. Ward: Metro Service Station This site plan is to construct a
25 foot by 40 foot canopy containing fire suppression equipment
over existing gasoline pumps, in Cutchogue. SCTM~1000-102-5-26.
What's the pleasure of the Board?
Mr. 0rlowski: Mr. Chairman, I make a motion that WHEREAS, the
Southold Town Planning Board rescinds it's resolution of final
approval granted on April 10, 1995 on the final surveys dated
January 9, 1992; and
WHEREAS, the revised final surveys dated July 10, 1992 have been
presented to the Board for approval; be it therefore
RESOLVED, that the Southold Town Planning Board authorize the
Chairman to endorse the final surveys dated July 10, 1992, subject
to a one year review from date of building permit.

conversion of an existing agricultural building to a winery and
tasting room, located on a 30 acre parcel in Southold. SCTM~
1000--75--6--9.6 & 9.7. What's the pleasure of the Board?
Mr. Cremers: Mr. Chairman, I'd llke to make %he following motion
WHEREAS, Joel and Margaret Lauber are the owners of the property
known and designated as Corey Creek Vineyards, located at Main
Road, Southold, SCTM~ 1000-75--6-9.6 & 9.7; and
WHEREAS, a formal application for the approval of this site plan
was submitted on November 25, 1994; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared
itself lead agency and issued a Negative Declaration on January 9,
1995; and
WHEREAS, this site plan was certified by Thomas Fisher, Senior
Building Inspector, on June 12, 1995; and
WHEREAS, this approval is for the entire 29.973 acres comprising
SCTM~ 1000--75-9.6 & 9.7; and
WHEREAS, all the requirements of the Site Plan Regulations of the
Town of Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional
final approval on the surveys dated April 13, 1995, and authorize
the Chairman to endorse the final surveys subject to a one year
review from date of building permit, approval of elevation drawings
contained in the detailed construction plans, and fulfillment of
the following conditions. Ail conditions must be met within six
(6) months of the date of this resolution.
1. Curb cut permit from the New York State Department of
Transportation.
2. Applicant must comply with recommendation of Southold Fire
Department.

Southold Town Planning Boardf acting under the State Environmental
Quality Review Act, start the lead agency coordination process on
this unlisted action.

units in four new buildings. The project is located on Duc

pleasure of the Board?

Board deems the Draft Environmental Impact Statement of Ma~
to be incomplete, therefore unacceptable for the purpose of
coordinated review pursuant to the State Environmental Qua]

Further, there is no record in the Town's files of the issuance of
a permit for the concrete retaining wall that has teen placed on
the beach north of the motel. Our understanding is that both Town
Trustee and New York State Department of Environmental Conservation
permits were required for this work. It will be necessary for

these potential violations permit deficiencies to be discussed
w~thin the DEIS document before we can deem it complete. The site
plan that is part of the DEIS must be revised to show the new
renaining walls and the revised §round elevations between the
restaurant and motel buildings and shoreline.
Finally, the DEIS must address the concerns set forth in the staff
report of June 12, 1995.
