WITNESSETH, that the party of thc fu'st part, in consideration of 'fen Dollars ($10) and other
valuable consideration paid by the party of the second pan, does hereby grant and release unto
thc party of the second part, the heirs or successors and assigns of the party of the second part

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, as more particularly described on Schedule "A" attached hereto and made a pan hereof.
BEING thc same premises as were conveyed to the party of the first part by deed dated
December 5, 2002 from Mark R. Jan'ell and Darlene C. Jarrell and recorded January. 6, 2003 in
Liber D00012228 Page 737 in the Office of the Suffolk County Clerk.
SUBJECT to the encumbrances on title described on Schedule "B" attached hereto and made a
pan hereof.
TOGETI-IER with all right, title and interest, if any, of the party of thc first part in and to any
streets and roads abutting the above described premises to the cenler lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of
. the second part, the heirs or successors and assigns of the party of the second part lbrever.
AND thc party of thc first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive thc consideration tbr this conveyahce and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying thc
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part oftbe total ofthe same for any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of
the said premises in fee simple, and has good right to convey the same; that the party of the
second part shall quietly enjoy said premises; that the said premises are free from encumbrances,
except as aforesaid; that the party of thc firsl parl will execute or procure any further necessary
assurance of the title to said premises; and that said party of the lirst pan will tbrever warrant the
title to said premises.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.

Survey prepared by Robert Van Tugl, P.C. dated Oc~.ober 31, 1989 shows a 1'/2 story
frame dwelling within lines and the Ibllowing:
a) Bluestone drive extends onto 50 foot fight ot' way.
b) Brick walk added from entrance of dwelling to northerly record line.
c) Wood fences added on or near northerly and weslerly record lines, not located.
d) Frame shed added in southwesterly comer of premises, not located.
