SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further steps under SEQRA.
PROPERTY FACTSIDESCRIPTION: The applicant's 10,000 sq. ft. non-conforming parcel with
100 feet along Waterview Drive and 100 feet along Cedar Road is improved with an existing
single-family dwelling as shown on survey prepared by Stanley J. Isaksen, Jr. dated 11/17/06.
BASIS OF APPLICATION: Request for Variances under Sections 280-122 and 280-124, based
on the Building Inspector's September 27,2007 Notice of Disapproval and Zoning Interpretation
ZBA #5039 (Walz) concerning a proposed second-story addition and alterations to the existing
dwelling, which increases the degree of nonconformity with rear yard and front yard setbacks at
less than 35 feet. Also proposed are additions at less than the code required 35 feet rear
setback and front setback (new nonconformities) under the code requirements.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on December 20, 2007
and January 24, 2008, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The relief requested is for new additions and
alterations to the existing dwelling, resulting in an increase in the degree of nonconformities at
34.3 feet from the front lot line along Waterview Drive and 22.5 feet from the rear lot line, as
shown on the 8/28/07 Site Plan (SP-l) prepared by Robert Stromski, Architect.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted
and personal inspections, the Board makes the following findings:

. 1. Town Law ~267-b(3)(b)(3)(l). Grant of the variance will produce an undesirable change in
the character of the neighborhood or a detriment to nearby properties. The existing home with
its nonconforming rear yard and front yard setbacks will be maintained at essentially the same
distance, with the proposed second-story. The existing foundation (four walls) will be utilized
without any removal or change in the dwelling footprint, except for the proposed enclosure of
the rear porch and small addition to the existing garage. Also, the concrete front porch will be
removed and replaced with a new wider covered porch with stone veneer.
2. Town Law ~267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some
method, feasible for the applicant to pursue, other than an area variance. The rear yard of the
applicant's property is 36% smaller than the code requires. The house has existed with
conformity in this residential district for the last 25 years (approximately).
3. Town Law ~267-b(3)(b)(3). The variance requested herein is not substantial and is
reasonable.
4. Town Law ~267-b(3)(b)(5). The difficulty has not been self created.
5. Town Law ~267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this
residential community will have an adverse impact on the physical or environmental conditions
in the neighborhood. The existing footprint of the home will be utilized with some
modifications (please refer to the demo plan D.I). The proposed second-story will be conforming
as to height, in a residential district with older homes and lots similar to the subject property
(10 lots on Waterview Drive compare to the subject property with similar dimensions and
square footage).
Grant of the relief requested is the mImmum action necessary and adequate to enable the
applicant to enjoy the benefit of his property, while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Weisman,
seconded by Member Oliva, and duly carried, to
GRANT the variances as applied for, as shown on the 10/9/07 Building Elevation Plans
A-7 and A-8, Demolition Plan DI, subject to the following Conditions:
I) A buffer of evergreen trees at a minimum height of 5 feet to 6 feet, placed 3 feet to 5
feet apart, for a distance of 44 feet in length from the southeasterly property line to
the end of the dwelling;
2) This buffer of evergreens must be continuously maintained along the rear property
line on the applicant's property.
The above conditions shall be written into the Building Inspector's Certificate of Occupancy,
when issued.

Any deviation from the variance given such as extensions, or demolitions which are not shown
on the applicant's diagrams or survey site maps, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any
current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in
this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.
Vote of the Board: Ayes: Members Oliva (vice Chairwoman), Dinizio, and Weisman.
Chairman Goehringer and Member Simon were absent. This Resolution was duly adopted (3-0).

As per our phone conversation attached please find four copies of the demolition plan for the Stepnoski Variance
Application. These documents are to be part of the previous submission, which contained a letter describing the
demolition process for the project. During the public hearing I submitted a copy of the demolition plan. but it did not
have my seal and signature. These documents have been sent so that you have signed and sealed drawings for your file.

Dear: Chairman,
This letter is to serve as an explanation of the demolition plan and response to a letter submitted by
an adjacent property owner. As discussed during the public hearing, we are looking to remove the
existing roof and ceiling beams to allow for the new second floor. The majority of the first floor
walls would remain. In fact the exterior walls are to be furred-out 2" to allow for additional
insulation to meet the new Energy Codes.
In response to the attached letter from Mr. and Mr. Abrams we response as follows;
1. The second-story addition as proposed is well w;th-in the character of the surrounding
neighborhood. My client respects that their neighbors are entitled to their privacy, however
their request for privacy should not preclude my client from having a second story because
the adjacent property is at a lower elevation.
2. Due to the fact that the Abrahms' property is directly west of the subject property there
would be limited shadows cast on their property during the later hours of the day.
3. Even though sanitary issues are not relevant to the application we offer this response to
their sanitary questions. Suffolk County Department of Health Services would regulate the
sanitary requirements for this project. Sanitary systems are regulated by bedrooms and not
bathrooms. Standard systems that meet current sanitary code requirements are designed to
a maximum of four bedrooms. I have not inspected the current system to see if it meets the
requirements. If in fact the sanitary system needs to be upgraded it will be reviewed and
approved by the SCDHS and will not in anyway affect neighboring systems.
4. The siding for the exterior of the house is proposed to be a vinyl siding that looks like
cedar shakes. Color has not been chosen by the owners to date.

5. To my knowledge they are no grade changes required for this project. The foundation for
the majority of the house will remain. The foundation for the existing covered porch in the
rear and the garage will need to be re-constructed.
6. The property is currendy a singJe-family residence and is proposed to remain a single-
family residence.
As stated in our application, we feel that this project has been designed with aesthetics in mind and
fits the character of the surrounding properties. If you have any questions or require any additional

Dear Mr. and Mrs. Abrams:
Supplementing our telephone message left last Friday, this will confirm
that the Board of Appeals acknowledged receipt of your December 20, 2007 letter.
The Board members noted that you have questions you would like to ask, and
time for a written submission was extended concerning the above-noted
application and proposed construction.
The Resolution adopted by the Board of Appeals allows an extension of
time for you to submit questions to the Board in writing, to be received not later
than January 3, 2008. Once your questions have been received, this Department
will forward your questions to the applicant's architect for a written reply to the
Board, and with a copy to you by mail (or if preferred when you are able to stop
by to pick up a copy on or before January 17th).
Please provide your questions in writing to our Department before
January 3, 2008. If you have any questions about the above, please call me.

f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new pennit shall be required.
