The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards.
The proposed action involves the fee title purchase of approximately 11.0 acres of land for open
space purposes owned by Carla A. Carroll.
The property is identified as SCTM #1000-53-3-2. The address is 1900 Pipes Neck Road,
Greenport, New York, and is located on the southwesterly side of Pipes Neck Road,
approximately 881 feet from the intersection of Pipes Neck Road and State Route 25 in
Greenport in an R-80 zoning district.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to
this department, the proposed action is CONSISTENT with the LWRP.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I. All applicants for pennits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a detennination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detail. listinl! both supportinl! and non-
supportinl! facts. If an action cannot be certified as consistent with the L WRP policy standards and
conditions, it shall not be undertaken.
A copy of the L WRP is available in the following places: online at the Town of South old's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

Resolution for fee title purchase of open space

WHEREAS, the Town Board of the Town of Southold held a public hearing on the
question of the purchase for open space purposes on property owned by Carla A. Carroll,
on the 25th day of April, 2006, pursuant to the provisions of Chapter 59 (Open Space
Preservation) and Chapter 6 (Community Preservation Fund) of the Town Code, at which
time all interested parties were given the opportunity to be heard; and
WHEREAS, said property is identified as SCTM #1000-53-3-2. The address is 1900
Pipes Neck Road, Greenport, New York, and is located on the southwesterly side of
Pipes Neck Road, approximately 881 feet from the intersection of Pipes Neck Road and
State Route 25 in Greenport in an R-80 zoning district; and
WHEREAS, the proposed acquisition is for open space purposes and comprises the
entire approximately 11.0 acres (subject to survey), and borders on Pipes Creek. The
exact area is subject to a Town-provided survey acceptable to the LlIl1d Preservation
Committee; and
WHEREAS, the purchase price is $637,500.00 (six hundred thirty-seven thousand five
hundred dollars) for fee title; and
WHEREAS, the property is listed on the Town's Community Preservation Project Plan
as property that should be preserved and falls under multiple purposes of the Community
Preser ation Project Plan, including, but not limited to, preservation and protection of
open spaces and scenic values, protetion of wetlands, and undeveloped shorelines, and
protection of unique and threatened ecological areas; and
WHEREAS, the subject property is within the Pipes Cove area. The Town has identified
the Pipes Cove area as a priority area for preservation as this area is one of the few
remaining undeveloped areas of critical wetlands in the Peconic Bay Estuary; and
WHEREAS, the purchase of this property is in conformance with the provisions of
Chapter 6 (Community Preservation Fund) and Chapter 59 (Open Space Preservation) of
the Town Code and the Town's funding is to be pursuant to the provisions of Chapter 6;
and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 95 of the Town
Code and Local Waterfront Revitalization Program (LWRP) and the LWRP Coordinator
has determined that this action is consistent with the L WRP; and/~
WHEREAS, as per Chapter 87 (Transfer of Development Rigths) of the Code of the
Town of Southold, Section 87-5, one (I) Sanitary Flow Credit is available from this
purchase; and
WHEREAS, the Land Preservation Committee has reviewed the application for the
acquisition, and recommends that the Town Board acquire the property; and
WHEREAS, the Town Board deems it in the best public interest that the Town of
Southold purchase fee title to the subject property for open space purposes; now,
therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby elects to purchase fee
title for open space purposes on property owned by Carla A. Carroll pursuant to the
provisions of Chapter 6 and Chapter 59 of the Code of the Town of Southold. Said
property is identified as SCTM #1000-53-3-2. The address is 1900 Pipes Neck Road,
Greenport, New York, and is located on the southwesterly side of Pipes Neck Road
approximately 881 feet from the intersection of Pipes Neck Road and State Route 25 in
Greenport in the R-80 zoning district. The proposed acquisition is for open space
