This site plan is for new construction of a 100' monopole cellular communication tower with Cingular locating
antennas at 97'-Olt and 87'-0" internally mounted in the tower, the site includes an existing boat marina and
restaurant on 4.7 acres parcel in the MIl Zoning District located approximately 537' e/o Cedar Birch Lane on the
slslo New York State 25 in Orient. SCTM#(s) 1000-15-9-8
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of South old
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
information provided on the L WRP Consistency Assessment Form submitted to this department as well as the
records available to me, it is my determination that the proposed action is INCONSISTENT with the following
-.l} Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 3. Enhance visual qnality and protect scenic resources throughout the Town of Southold.
Policv Standards
3.1 Enhance visual quality and protect sccnic resources throughout the Town of Southold.
A. Minimize introduction of structural design components (including utility lines, lighting, signage
and fencing) which would be discordant with existing natural scenic components and character.
J. Protect visual quality associated with public lands, including public transportation routes, public
parks and public trust lands and waters.
2. Limit alteration of shoreline elements ,,'hich contribute to scenic quality.
The proposal also involves the new construction ofa 400 sq. ft. communication compound with a 100' flag
pole type monopole. A 12' chain link fence would enclose the communication compound. Twenty-two,
14' high, Juniperus virginiana are proposed to be installed to screen the compound. The oropertv is
located south of a desienated New Yark State Scenic Bvwav. The property is also located w/o and
adiacent to Orient Point State Park.

The flag type monopole cell tower will impact the scenic quality of the area, The height of the flagpole in
relation to surroundine: structures and the IInatural scenic comoonents" is discordant with the area.
Mitigation proposed by the applicant to reduce visual impacts include installing a flag pole type monopole,
painting the monopole white and the installation of twenty-two, 14' Juniperus virginiana. If the action is
approved by the reviewing Boards the following is recommended to further Policy 3.
I. Require that the communication compound and monopole be relocated north and adiacent to existing
buildings on site. The relocation of the compound would further cluster the development on the parcel
and use existing: development to screen oortions of the orooosed corrununication comoound and
monopole.
2. Require a five year survival requirement and a [enlacement orotocol for all olanted vee:etation used to
screen the communication comoound..
Policy 6. Protect and restore the quality and function of the Town of South old ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction.
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The proposed setback from the monopole to the bulkhead I south of the proposed monopole) is 65.10 feet; a
minimum setback of 100 feet is required pursuant to Chapter 275 of the Town of Southold Town Code. Please
require that the aoolicant amend the apolication to meet the above policy to the Ilreatest extent possible.
Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in
suitable locations.
Policv Standards
10.llaJ Protect existing water-dependent uses.
The term Water-dependent use means a business or other activity which can only be conducted in, on,
over, or adjacent to a water body because such activity requires direct access to that water body, and
which involves, as an integral part of such activity, the use of the water. Existing uses should be
maintained and enhanced where possible and appropriate.
10.1 (b) Improve the economic viability of water-dependent uses hy allowing for non-water
dependent accessory and mnltiple uses, particularly water enhanced and maritime support
services where sufficient upland exists.
The tenn water-enhanced use means a use or activity which does not require a location adjacent to
coastal waters, but whose location on the waterfront adds to the public use and enjoyment of the
water's edge. Water-enhanced uses are primarily recreational, cultural, retail, or entertaimnent in
nature. These uses may be necessary for the successful financial operation and viability of l'vater-
dependent uses.

INSTRUCTIONS
I. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town Of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before aosweriog the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or no" then the proposed action will
affect the achievem ent of the L W RP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detaillistinl!: both suooortinl!: and non-
supoortinl!: facts. If an action carmot be certified as consistent with the L WRP policy standards and
conditions, it shall not be undertaken.

The proposed action involves the constraction of a "flagpole" monopole, which would have the antennas of New Cingular
Wireless PCS, LLC concealed within. The proposed monopole would extend 10 a height of 100*-feet above grade level ("agl").
In addition, proposed ground-based equipment would he placed on an elevated steel platform and would extend to a height of
ll-feet-2-inches agl. This equipment would be surrounded by a six-foot agl chain link fence with a four-foot agllackable gate.

acre, which is part of a parcel of land that has already been developed to accomodate a restaurant and marina. Moreover, the design of
the proposed facility, such that the antennas would be concealed within a flagpole, would help mitigate any potential visual impacts.
Furthermore, review of all available data did not identify any historic resources proximate to the proposed facility location.
