The first order of business is the setting of the next Planning Board meeting. Board to set Monday, March 13, 1995 at 7:30 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next Planning Board meeting. Is there a motion? Mr. 0rlowski: Motion. Public Hearings Mr. Ward: Conrad Baqensk~ - This minor subdivision is for 3 lots on 6.212 acres located on the north side of Main Road; 1332.92 feet east of Elijah's Lane in Cutchogue. SCTM~ 1000-108-3-9. Is the applicant, or agent for the applicant here? Charles Cuddy: I'm Charles Cuddy, I represent the Bagenski's. This application has been before the Board for a period of time. Southold Town Pl~ing Board 2 February 6, 1995 It's 3 lots, one of which already has a house on it; and two additional lots which are served by a right of way going out to the Main Road. We have approval from the Health Department and the Department of Transportation, and it must be good because it's taken us a long time to get to this point. Not because of the Board but because of all the other things we've had to do. And I ask the Board at this point, unless there are any questions, to approve this application. Mr. Ward: OK, thank you. Mr. McDonald: I'd like to make a further motion that WHEREAS, Conrad and Francis Bagenski are the owners of the property kno.wn and designated as SCTM~ 1000-108-3--9 located on the north side of Main Road; 1332 feet east of Elijah's Lane in Cutchogue; and WHEREAS, this proposed minor subdivision, to be known as minor subdivision for Conrad and Francis BagenSki is for 3 lots on 7.104 acres; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Conditional Negative Declaration on June 4, 1991; and WHEREAS, the conditions of the Conditional Negative Declaration have been mitigated by locating the building envelope for lot number 1 outside of the steep slope area; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on February 6, 1995; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold will be met upon fulfillment of the following conditions; be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated October 7, 1994 and the road and drainage plan dated March 9, 1993, subject to fulfillment of the following conditions. All conditions must be met within six (6) months of the date of this resolution. Southold Town Platting Board 3 February 6, 1995 Six (6) final subdivision maps, two (2) mylar maps must be sub- mitred. All maps must contain the following: A. A valid stamp of approval from the Health Department; B. A notation that a Declaration of Covenants and Restrictions was filed pertaining to the subdivision. The notation must include the liber and page number of the filed document. 2. Three (3) copies of the final road and drainage plan dated March 9, 1993 must be submitted. The Performance Guarantee in %he amount of $22,975.00 and the administration fee in the amount of $1,378.00 must be submitted in a form acceptable to the Town; or The improvements contained in the bond estimate dated Sept-- ember 29, 1994, must be completed prior to endorsement of the final map. (Please refer to the Board's letter of December 7, 1994, in regard to the street sign included in the bond estimate.) The administration fee in the amount of $1,378.00 must be paid prior to the start of any construction. The Declaration of Covenants and Restrictions required by the Planning Board must be recorded. A copy of the recorded document must be submitted. 5. The Park and Playground fee in the amount of $4,000.00 ($2,000.00 ~per vacant lot) mush be paid. Mr. Latham: Second the motion. Also, Mr. Krupski is here to answer any questions that the Board might have. The application is pretty self explanatory and I just ask that if your Board has any questions, Mr. Krupski is here to answer and I just move for it's approval. Mr. Orlowski: I also make ~ motion that WHEREAS, Andrew Krupsk~ is the owner of the property known and designated as SCTM~ 1000-64~-5--12 & ]3, located on the west side of Town Harbor Lane in Southold; and WHEREAS, this proposed minor subdivision, to be known as minor subdivision for Andrew Krupski, is for 2 lots on 30,799 square feet;and WHEREAS, a variance to the zoning ordinance was granted by the Zoning Board of Appeals on April 27, 1983; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on October 3, 1994; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York, on February 6, 1995; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been metl be it therefore RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final surveys dated Nobember 15, 1994. Mr. McDonald: Mr. Chairman, I'd like to make a further motion that WHEREAS, Frederick and Bernardine Bauser are the owners of the property known and designated as SCTM~ 1000--86--4--1.7, and Suffolk County is the owner of the property known and designated as SCTM~ 1000--86-4-1.9, located on the west side of Indian Neck Lane in Peconic; and WHEREAS, the proposed lot line change, to be known as lot line change for Frederick and Bernardine Bauser, is to merge a 24,720 square foot parcel designated as Park and Playground for the subdivision of Peconic Bay Cove, with an adjacent 51,150 square foot parcel located in Peconic; and WHEREAS, the Planning Board, at the request of Frederick and Bernardine Bauser, has agreed to remove the Park and Playground designation from the 24,720 square foot parcel (SCTM%1000--86--4--1.9) which the Bauser's intend to purchase from Suffolk County, with the condition that the parcel be redesignated as a Scenic Easement and that the parcel be merged with the Bauser's existing 51,150 square foot parcel (SCTM% 1000--86-4-1.7); and WHEREAS, since the Park and Playground area was designated as a Park and Playground area for the filed subdivision of Peconic Bay Cove and was not designed as a buildable lot, the Planning Board has required that restrictions be placed on the lot prohibiting further subdivision, prohibiting all structures, other than non-visually impeding fences (ie. stockade type) within the Scenic Easemen~ area, and limiting clearing and grading within the Scenic EasemenD area; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Delaration on January 9, 1995; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on February 6, 1995; and Southold Town Pla~nin§ Board February 6, 1995 WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold will be met upon fulfillment of the conditions of approval: be it therefore RESOLVED, that the Southold Town Planning Board grant conditional final approval on the surveys dated December 19, 1994, subject to fulfillment of the following conditions. Ail conditions must be met within six (6) months of the date of this resolution. o Six (6) final maps and two (2) mylars must be submitted. Ail maps must contain the following: A. A notation that a Declaration of Covenants and Restrictions was filed pertaining to the lot line change. The notation must include the liter and page number of the filed document. B. The maps must be drawn at a scale of 1 inch equals 100 feet as noted in the conditional sketch approval. The Declaration of Covenants and Restrictions required by the Planning Board must be recorded. Mr. Ward: John H. and James McNeil This lot line change is to change the lot lines of two existing parcels of 96,049 square feet and 0.299 acres into two parcels of 55,721 square feet and 55,631 square feet. SCTM~ 1000-103--13-16, 18.1, 19, 20, 21, 22. Is the applicant or the agent for the applicant here to address the Board? Abigail Wickham: Abigail Wickham for the McNeils. Gentlemen, I would like to make a somewhat unusual request tonight that you ho~d the hearing open for two reasons. Number one, although this property has been on the market for quite a wh~le, and has been before your Board for quite some time, they just over the past few days received an offer for purchase and the prospective purchaser may want to do something slightly different with the property. So, before we conclude this particular transaction we would like to have an opportunity to look at that and explore that further, both with you and with them. And the second reason, which just came up this afternoon is Mr. McNeil called me and raised a question about the title to one of the lots. Southold Town Planning' Board 7 ~bruary 6, 1995 I tried to contact the County Clerk's office and was told that because of lack of heat in the building, there was no one there. So, I was not able to get the answer to that. I realize you like to clear things off your calendar, but if you would indulge us... Mr. Ward: How long a period are you asking? Until the March meeting? Ms. Wickham: I think that would be a fair (inaudible). Mr. McDonald: There's a question about the title to one of the lots? Ms. Wickham: I'm not sure. (inaudible) Mr. McDonald: But it's conceivable that we're proceeding on a subdivision that there's not clear title to? Ms. Wickham: No, there's just a question of what the title is to a particular lot. I want to get the names straight. The primary reason is that we have a purchaser who asked us to hold up on it just until they have an opportunity to decide how they want to proceed. Mr. McDonald: They don't want a subdivision? Ms. Wickham: I think they do, but I'm not sure it would look like this. Mr. McDonald: I just want to say what I think about this. We're constantly berated because we don't move fast enough. We get to this point where we're ready to issue a final on it and the applicant doesn't want to withdraw their application. They merely want to drag it out. This concerns me for several reasons. One, because I'm sensitive to the comments that are made towards us and two, because this prolongs an application and keeps property, which will probably be subdivided in any case, off the tax roll, to the benefit of the applicant and the detriment of the Town. Despite the fact that it's clearly the intent to subdivide it eventually in any case. Ms. Wickham: I don't disagree with you about the delay. Unfortunately, I think if you look at the tax rolls on this property, the Town is amply compensated. But in respect to the delay, I do agree with you and I apologize. Major and Minor Subdivisions, Lot Line Changes and Set Off Applications Final Determinations: Mr. Ward: Conrad Bagenski, Andrew Krupski, Frederick and Bernardine Bauser and John H. and James McNeil, those have been accomplished. Luce, Jr~ - This proposal is to subtract .54~ of an acre from a 3.884 acre parcel and add it to a 1.00 acre parcel; and to subtract .102 of an acre from a 3.884 acre parcel and add it to a .384 acre parcel. February 6, 1995 Sketch Determinations Mr. Ward: Aliperti Estates -- This major subdivision is for 10 lots on 45.2155 acres located on the north side of Oregon Road, 877 feet west of Alvah's Lane in Mattituck. SCTM~ 1000-95--1--3. What's the pleasure of the Board? Mr. McDonald: Mr. Chairman, I'd like to make a motion that WHEREAS, B. Anthony Aliperti has applied to sub;divide a 45.2]55 acre parcel (SCTM~ 1000--95-1--3) into 10 residential lots; and WHEREAS, this proposed subdivision is not designed as a cluster subdivision, however, Lot Number 1 has been designed as a 800,000 square foot lot containing a 40,000 square foot building envelope and a 760,000 square foot Open Space Conservation Easement and Lots 2 through 10 have been designed as lots ranging in size from 113,000 square feet to 130,000 square feet; and WHEREAS, the layout described above has been presented with the condition that there shall be no further subdivision of any lot in perpetuity; and WHEREAS, a Variance to the Zoning Ordinance for approval of insufficient lot width of three proposed parcels shown on a proposed subdivision for Rial Realty Corp. (SCTM% 1000-95-1-3) which is now the subject property, was granted by the Zoning Board of Appeals in a decision rendered on October 10, 1986; and WHEREAS, on December 11, 1992 the Planning Board requested a determination by the Z.B.A. in regard to the validity of the October 10, 1986 decision in that the proposal before the Planning Board (map dated Dec. 3, 1992) for the soundfront lots was similar, but not exactly the same as that befor.e the Zoning Board of Appeals in 1986; and WHEREAS, in a memorandum dated December 31, 1992, the Zoning Board of Appeals Chairman advised the Planning Board that Z.B.A. determinations run with the land and that -there had not been any adverse changes in the configuration of the three lots under the lot width variance, and that the variance remains and a new application was not required; and be it therefore RESOLVED, that the Southold Town Planning Board start the lead agency coordination on this unlisted action; and BE IT FURTHER RESOLVED that the Southotd Town Planning Board grant sketch approval on the map dated October 6, 1994, with the following conditions: The location of the building envelopes staked in the field for the soundfront lots (Lots 8, 9 and 10) have not been accepted by the Planning Board and are subject to further review by the Planning Board during the SEQR process. Southold Town Planning Board 10 ~- February 6, 1995 o A major gully cuts across the proposed soundfront lots causing severe erosion and sedimentation problems. Stabilization of the gully and the effect of the gully on the location of building envelopes for the soundfront lots are subject to further review by the Planning Board during the SEQR process. The subdivision is to be designed so that the beach area, from the toe of the bluff north, shall be owned by a Homeowners Association. In addition, a common pedestrian accessway to the beach must be designed. Building envelopes must be shown for Lots 2--7. The building envelopes shall not be larger than 40,000 square feet in area. All structures, other than fences must be contained within the building envelope. This restriction must be noted in a Dec- laration of Covenants and Restrictions. The area outside the building envelope for Lot 1 must be labeled as an Open Space Conservation Easement. Ail structures other than fences must be contained within the buildinc envelope. Covenants and Restrictions will be required for the Open Space Conservation Easement. These will be determined upon completion of the environmental review. What's the pleasure of the Board? $outhold Town Planning Board 13 ~ February 6, 1995 Mr. Ortowski: I make a motion that WHEREAS, the Fishers Island Development Corp. is the owner of the property known and designated as Fishers Island Development Corp, SCTM% 1000-12-1--5.1, located on Fox Lane, Fishers Island; and WHEREAS, a formal application for the approval of this site plan was submitted on April 26, 1993; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on August 9, 1995; and WHEREAS, this site plan was certified by Thomas Fisher, Senior Building Inspector on February 6, 1995; and WHEREAS, all the requirements of the Site Plan Re§ulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final survey dated January 10, 1994 subject to a one year review from the date of building permit.
