Kassner, Site Plan Reviewer Martha Jones, Secretary Mr. Ward: Good evening. I'd like to call the January 9, 1995 meeting of the Southold Town Planning Board to order. The first order/of business is the setting of the~next Planning Board meeting. Board t9 set Monday,~ February 6, 1995 at 7:30 p.m. at Southold Town Hall, Main ROad, Southold as the time and place for the next Planning Board meeting. Is there a second? Mr. Edwards: Second. Public Hearings Mr. Ward: Michael Racz and Gall Dessimoz -- This lot line change is to subtract 56,156 square feet from a 142,017 square foot parcel and add it to a 71~889 square foot parcel. SCTM~ 1000-112--1-3 & 4. Is the applicant or a representative of the applicant here that would like to address the Board? Kenneth Abruzzo: Good evening. Kenny Abruzzo from Young and Young Land Surveyors. This application, w~have two parcels of land that are owned by husband and wife jointly. The eastern most parcel SCTM~ 1000-112-1-4 is owned jointly by Michael Racz and Gall Dessimoz. The parcel to the ~outhold Town Planning Board 2 ~ January 9, 1995 SCTM~ 1000--112-1--3 is owned by Gall Dessimoz, singularly. What the applicant would like to do, we have an existing lot on the east that's non-conforming both in ar~a and lot width. We would like to make that lot conform to both area and lot width and reduce the lot width on the westerly portion and yet increase the area so that both lots will now be conforming in area requirements. The lot width on the western lot will be 125 feet instead of the required, I believe it's 175. We have gone to the .Zoning Board of Appeals, and we have a Zoning Board of Appeals approval for the lot width alteration. At this point in time if there are any questions that I could answer, I'd be happy to. Mr. Ward:p Is there anyone else here that would like to address the Board on this particular public hearing. Mr. McDonald: I'd like to make a further motion that whereas Michael Racz and Ga~l Dessimoz are the owners of the property known and designated as SCTM~ 1000--112-1-3 & 4, located on the right of way north of Sound Ave., approximately 450 feet west of Aldrich Lane in Laurel; and WHEREAS, this lot line change, to be known as lot line change for Michael Racz and Gall Dessimoz Ss for a lot line change to subtract 56,156 square feet from a 142,017 square foot parcel and add it to a 71,889 square foot parcel; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on December 12, 1994; and WHEREAS, a final public hearing was closed on said lot line change application at Town Hall, $outhold , New York on January 9, 1995; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefors RESOLVED that the Southol~ Town Planning Board grant conditional final approval on the surveys dated December 9, 1991 and authorize the Chairman to endorse the final surveys subject to fulfillment of the following condition. This condition must be met within six (6) months of the date of this resolution. Mr. Ward: OK, what's the pleasure of the Board? Mr. McDonald: Mr. Chairman, whereas Raoul Witeveen is the owner of the property known and designated as SCTM~ 1000-22--34-15.1 & 18.3 located on the north side of Main Road; 1776 feet east of Stars Road in East Marion; and WHEREAS, this proposed clustered major subdivision, to be known as Cove Beach Estates, is for 34 lots on 98.2673 acres; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, adopted a Findings Statement on July 10, 1989 for the proposed subdivision; and WHEREAS, the final maps are in accordance with the mitigation measures contained in the Findings Statement; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York, on December 12, 1994; and WHEREAS, the Planning Board has reviewed the concerns raised at the December 12, 1994 final public hearing and decided that in order to minimize traffic impacts on pending development on State Rt. 25 that a single curb cut must be designed and a road tap must be provided to allow access to the adjacent property to the east; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold will be met upon fulfillment of the conditions of approval; be it therefore, SDuthold Town Planning~ Board 4 ~.~ January 9, 1995 RESOLVED, that the Southold Town Planning Board grant COnditional final approval on the subdivision maps dated June 23, 1994 and the road and drainage plans dated September 13, 1990. All conditions must be met within six (6) months of the date of this resolution. A road tap must be provided to allow for access to the adjacent property to the east of Main Road. The road tap must be located approximately 600 feet from the intersection of the proposed road (Cove Beach Drive) and the Main Road (State Rt. 25). o Six (6) final subdivision maps and two (2) mylar maps must be sub- mitred. Ail maps must contain the following: A. A valid stamp of Health Dept. approval. B. A notation that the Declaration of Covenants and Restrictions was filed pertaining to the subdivision. The notation must in- clude the liber and page number of the filed document. C. The firewell locations. D. The road tap as required in condition number one. The Declaration of Covenants and Restrictions required by the Planning Board must be recorded. A copy of the recorded document must be submitted. The Homeowners Association must be consistent with all Planning Board conditions and must be recorded for the roads, drainage areas, park and playground area and open space areas. A copy of the recorded document must be submitted. 5. The Performance Guarantee in the amount of $815,525.00 must be sub-- mitred in a form acceptable to the Town Board. 6. The administration fee in the amount of ~48,931.00 must be paid. Mr. Orlowski: I make ~ further motion that the Southold Town Planning Board grant sketch approval on the map dated December 7, 1994 with the following conditions: The fifty (50) foot wide right-of--way from Oregon Road is shown on the proposed subdivision as a separate parcel. The map must be re-- vised to include the right-of-way with at least one of the three pro- posed lots, or, if the area is to remain as a separate parcel, a Homeowners Association must be established. The building envelope for proposed Lot Number 1 must be revised to include the existing shed. Proposed Lot Number 2 includes a scenic easement area located on the north side of the cul-de--sac. Covenants and restrictions shall be placed on this lot prohibiting any further subdivision in perpetuity.
