This site plan is for new construction of a 1 DO' monopole cellular communication tower with Cingular locating
antennas at 97'-0" and 87'_011 internally mounted in the tower, the site includes an existing boat marina and
restaurant on 4.7 acres parcel in the MIl Zoning District located approximately 537' e/o Cedar Birch Lane on the
s/s/o New York State 25 in Orient. SCTM#(s) 1000-15-9-8
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Towu of Southold
Towu Code and the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based upon the
information provided on the L WRP Consistency Assessment Form submitted to this department as well as the
records available to me, it is my determination that the proposed action is INCONSISTENT with the following
Policy Standards and therefore is INCONSISTENT with the L WRP.
Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold.
Policv Standards
3.1 Enhance visual quality and protect scenic resources throughout the Town of Southold.
A. Minimize introduction of structural design components (including utility lines, lighting, signage
and fencing) which would be discordant with existing natural scenic components and character.
J. Protect visual quality associated with public lands, including public transportation routes, public
parks and public trust lands and waters.
2. Limit alteration of shoreline elements which contribute to scenic quality.
The proposal also involves the new construction of a 400 sq. ft. communication compound with a 100' flag
pole type monopole. A 12' chain link fence would enclose the communication compound. Twenty-two,
14' high, Juniperus virginiana are proposed to be installed to screen the compound. The orooertv is
located south of a designated New York State Scenic Bvwav. The orooertv is also located w/o and
adiacent to Orient Point State Park.
The flag type monopole cell tower will impact the scenic quality of the area. The height of the flagpole in
relation to surrounding structures and the "natural scenic comoonents" is discordant with the area.
Mitigation proposed by the applicant to reduce visual impacts include installing a flag pole type monopole,
painting the monopole white and the installation of twenty-two, 14' Juniperus virginiana. If the action is
approved by the reviewing Boards the following is recommended to further Policy 3.
1. Reauire that the conununication compound and monopole be relocated north and adlacent to existiml
buildings on site. The relocation of the compound would further cluster the development on the parcel
and use existing develooment to screen portions of the oroposed communication comoound and
monopole.
2. Require a five year survival requirement and a renlacement orotocol for all planted vegetation used to
screen the communication comoound..
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southo/d Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction.
1. Comply with Trustee regulations and recommendations as set forth in Trustee pennit
conditions.
The proposed setback from the monopole to the bulkhead (south of the proposed monopole) is 65.10 feet: a
minimum setback of 100 feet is required pursuant to Chapter 275 of the Town of Southold Town Code. Please
require that the applicant amend the application to meet the above policv to the greatest extent possible.
Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in
suitable locations.
Policv Standards
10.1 (a) Protect existing water-dependent uses.
The term Water-dependent use means a business or other activity which can only be conducted in, on,
over, or adjacent to a water body because such activity requires direct access to that water body, and
which involves, as an integral part of such activity, the use of the water. Existing uses should be
maintained and enhanced where possible and appropriate.
10.1 (b) Improve the economic viability of water-dependent uses by allowing for non-water
dependent accessory and multiple uses, particularly water enhanced and maritime support
services where sufficient upland exists.
The term water-enhanced use means a use or activity which does not require a location adjacent to
coastal waters, but whose location on the waterfront adds to the public use and enjoyment of the
water's edge. Water-enhanced uses are primarily recreational, cultural, retail, or entertainment in
nature. These uses may be necessary for the successful financial operation and viability of water-
dependent uses.
The proposal located in the Marine II zoning district. The proposed use is neither a water dependent
use or a water enhanced use and therefore is inconsistent with the above Policv 10 and Sub-Dolicies.

Nature and extent of action:
The proposed action involves the construction ora "flagpole" monopole, which would have the antennas of New Cingular
Wireless PCS, LLC concealed wilhin. The proposed monopole would extend to a height of IOOolo-feet above grade level ("agt").
In addition, proposed ground-based equipment would be placed on an elevated steel platform and would extend to a height of
Il-feet-2-inches agl. This equipment would be surrounded by a six-foot agl chain link fence with a four-foot agllockable gate.

Although the subject property is located in Jfchaeologically sensitive zone, the proposed " _ m consists of the disturbance of 0,009"
acre, which is part of a parcel of land that has already been developed to accomodate a restaurant and marina. Moreover, the design of
the proposed facility, such that the antennas would be concealed within a flagpole, would help mitigate any potential visual impacts.
Furthermore, review of all available data did not identify any historic resources proximate to the proposed facility location.

The proposed action involves the construction of a "flagpole" monopole, which would have Cingular Wireless antennas concealed within, and the
placement of ground-based equipment proximate to the base of the monopole. The proposed flagpole would extend to a height of lO~-feet above
grade level ("agl"). The proposed ground-based equipment would be placed on an elevated steel platfonn within a 400 square foot (O.OO9=-acre)
area, and would extend to a height of II-feet-2-inches agl. It should be noted that as the equipment would be placed on an elevated steel platfonn,

The following is a description of the methodology used in preparing the visual analysis study and photo realistic
renderings of a post-construction, New Cingular Wireless PCS, LLC. proposed public utility wireless telecommunications
facility ("Facility") located at 40200 Main Road, Orient Point, New York. The proposed Facility will consist of a
100' AGL (Above Ground Level) tall monopole and ground equipment as depicted on the site plans prepared by William
F. Collins AlA, the applicant's consultants. Creative Visuals, Inc. has prepared an accurate visual study of the completed
128' tall Facility.
A two-man team made an on-site visit to obtain familiarity with the terrain and its surrounding area. Nine view
points within close proximity of the site were selected for analysis as areas of potential visual impact, from which five
were selected for photo representation of the completed monopole. The following view points are presented for analysis:

Lany Heimel took analog photographs of1he site from each of1he view points under study, shooting Fuji
Professional NPC160 print film. Two Nikon F-5 cameras were used, each wi1h a fixed 50mm lens. Two cameras were
used to provide an "insurance" shot. The photos were taken on May 17,2006 between 1:10 and 4:00 P.M.; conditions
were sunny skies. These photos presented a reference point for calculation of1he structure's placement, using red flags
attached to a crane. The flags were set at 100' above the approximate location of1he proposed site, which represents 1he
top of1he Facility.
The negatives were scanned at 2700 dpi (dots per inch) and then digitized as high-resolution files. The site and
each view point were 1hen located on a digitized DOT contour map. AutoCAD was used to create a model of1he actual
proposed Facility using measurements taken in 1he field and 1he dimensions and drawings furnished by William F.
Collins, AlA.
The 3D software photorealistically rendered the proposed Facility as seen from each of1he photo simulation view
points, maintaining the perspective of a 50mm lens. This resulted by exporting 1he location of1he view points into 1he 3D
program from AutoCAD. The 3D software utilized 1his imported file to reference 1he Facility and view point locations,
thus maintaining their relative X, Y and Z distances. The Facility was generated with its actual dimensions as a vectorized
3D model. Each view point including 1he site was elevated to its relative AMSL. The 3D program cameras were set at
each view point's X, Y and Z location and photographed the model wi1h a 50mm lens (correlating to our analog 50mm
photos). The X, Y and Z coordinates allowed the 3D camera to render the Facility to its correct scale, rotation and angle
from each view point. The Facility was assigned "photorealistic" materials in the 3D software. 3D software simulated
sunlight on the 3D model, taking into account the site latitude, date and time of day of1he view point photographs. Adobe
Photoshop software was used in the process of overlaying 1he 3D model onto the corresponding visible references used
during photography. The crane was digitally removed from 1he view point photographs and 1he photorea1istica1ly-rendered
3D model was inserted and merged into the digitized site photos.
Conclusion
Based upon our over eleven years' experience in visual analysis, as well as analyzing over 600 public utility

6. SUBCONTRACTOR SHALL BE RESPONSIBLE FOR OBTAINING ALL PERMITS AND INSPECTJONS REQUIRED FOR CCNSTRUCTION.
7. SUBCONTRACTOR SHALL BE RESPONSIBLE FOR REPAIRING ANY DAMAGE CAUSED BY THE CONSTRUCTION OPERATION.
