Located on the s/e intersection of Commerce Drive and Corporate Drive also known as 350
Commerce Drive in Cutchogue
SCTM#1000-96-1-1.2 Zone: LI, Light Industrial
This site plan proposes construction of a new 3,180 sq. ft bus terminal building with site build out
that includes 19 employee parking spaces and 16 bus parking spaces on a vacant 1.083 acre parcel in
the LI Zone located approximately 417' s/o Corporate Drive on the w/s/o Commerce Drive known
as 115 Commerce Drive in Cutchogue. SCTM# 1000-96.-1-1.2
The proposed action has been reviewed to Chapter 95, Waterfi:ont Consistency Review of the
Town of Southold Town Code and the Local Waterfi'ont Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department as well as the records available to me, it is my determination that
the proposed action is generally CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP provided that the following standard best management
practices are implemented.
To further the intent of Policy 5 and 5.1 "Prohibit direct or indirect discharges that would
cause or contribute to contravention of water quality standards". Require thc following
clauses in the Covenant and Restrictions:
The property is served by public water. The Suffolk County Water Authority has indicated that
water supply to the site is limited and that every effort should be made to limit water usage.
Waste will be disposed of via an existing, functioning on site sanitary waste system. It is
recommended that the Board require the following best management practices.
To further protect ground water quality and conserve water supply to the greatest extent possible
it is recommended that the Planning Board require the following best management practices to
further the conservation of water:
1. Require low flow toilets and fixtures to conserve water usage.
2. Require that surface- water runoff generated from any structures or impervious areas
be retained on-site and disposed of via sub-surface leaching pools (dry-wells).
3. Require that native and drought-tolerant plants be used in landscaping.
In addition, to further the intent of Policy 8.3 "Protect the environment from degradation due
to toxic pollutants and substances hazardous to the environment and public health"
specifically Sub-policies "D and E" outlined below; I recommend that the following clauses,(45
also be added to the Covenant and Restrictions. 3
D. Protect public health, public and private property, and fish and wildlife
from inappropriate use of pesticides.
1. Limit use of pesticides to effectively target actual pest populations_as
indicated through integrated pest management methods.
2. Minimize exposure of people, fish, and wildlife to pesticides.
E. Take appropriate action to correct all unregulated releases of substances
hazardous to the environment.
3. Prohibit the application and use of synthetic pesticides and fertilizers capable
of entering the potable water supply.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge
in one particular area may not be aware of the broader concerns affecting the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process
has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists
a reviewer in the analysis that takes place in Parts 2 end 3.
Part 2:
Part 3:
Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guid;,nce
as to whether an impact is likely to be considered small to moderate or whether it is a potentially-large impact. The
form also identifies whether an impact can be mitigated or reduced.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in
this application and determines that this review falls under the Unlisted Action category of the State's List of
Actions, without an adverse effect on the environment if the project is implemented as planned.
(with correction): The applicant's 47,166.6 square foot parcel is vacant

FACTS/DESCRIPTION
land with 48.56 feet along Commerce Drive in Cutchogue. The property is shown as Lot 2 on the Map of
North Fork Industrial Park filed January 27, 2005 with the Suffolk County Clerk.
BASIS OF APPLICATION: Zoning Code Section 100-141B(6), and Building Inspector's July 26, 2005 Notice
of Disapproval, stating that special exception approval from the Zoning Board of Appeals is required for a
proposed bus terminal business use, as well as site plan approval from the Town Planning Board.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time
written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of
the property and the area, and other evidence, the Zoning Board finds the following facts to be true and
relevant.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal
inspections, the Board makes the following findings:
1) The applicant seeks approval for a new school bus terminal facility on Lot 2, Map of North Fork
Industrial Park filed January 27, 2005, located in the Light Industrial Zone District. It is the determination of
this board that the operations as a bus facility will not in any way alter the character of the neighborhood or
industrial use district. The bus terminal in this location will enable the carrier to provide school bus service
to the Mattituck-Cutchogue School District without unduly burdening town roads.
2) A school bus terminal use is a permitted use under Zoning Code Section 100-141B(6).
3) School bus transportation is an essential service, and construction of a bus depot in a Light Industrial
District will have less impact on surrounding properties than it would at other locations.

4) In addition, the Board has reviewed the General Standards governing Special Exception uses set fodh in
Section 100-263 and finds:
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of
properties in adjacent use districts.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal

The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time
written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of
the property and the area, and other evidence, the Zoning Board finds the following facts to be true and
relevant.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal
inspections, the Board makes the following findings:
1) The applicant seeks approval for a new school bus terminal facility on Lot 2, Map of North Fork
Industrial Park filed January 27, 2005, located in the Light Industrial Zone District. It is the determination of
this board that the operations as a bus facility will not in any way alter the character of the neighborhood or
industrial use district. The bus terminal in this location will enable the carrier to provide school bus service
to the Mattituck-Cutchogue School District without unduly burdening town roads.
2) A school bus terminal use is a permitted use under Zoning Code Section 100-141B(6).
3) School bus transportation is an essential service, and construction of a bus depot in a Light Industrial
District will have less impact on surrounding properties than it would at other locations.
