'd like to call the Southold Town Planning Board meeting to order, for September 30, 1996. The first order of business is the setting of the next Planning Board meeting. Board to set Monday, October 21, 1996 at 7:30 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board meeting Mr. Cremers: So moved. PUBLIC HEARINGS Mr. Ward: 7:30 p.m. Peconic Development Corp. (Harvest Homes) - This proposed major subdivision is for 13 lots on 14.9 acres located on Southold Town Planning Board 2 September 30, 1996 here that would like to address the Board regarding this preliminary application? Abigail Wickham: Good evening. My name is Abigail Wickham and I'm here representing the owner of Peconic Development Corp. Mr. DuBrava is also here, if the Board has any questions. First, I'd just like to submit the affidavit of mailing, Although the Board is certainly familiar with the long history of this proposal, I would for the record like to just briefly reiterate some of the process by which we arrived at the preliminary plan and asking for your approval of it tonight. We originally started off trying to develop several different concepts for dividing this property. We attempted to utilize a center roadway, a greenbelt around the outside..We attempted to re-incorporate the lots around the outside with the center green area and ended up after much discussion with the Board with the current plan which provides for 13 lots, al over the requisite size for the zone n the area with considerable area for natural surroundings, particularly along Oaklawn Ave. and frontyard areas, so that there will be a nice presentation to the subdivision We've also done some extensive work in calculations and discussions with the Town Engineer in connection with the drainage calculations to make sure that there's not a further aggravation of the wells road drainage area problems that have been experienced in the past, in both the location on the northerly corner of the property and around the bend. I would be happy to try and answer any questions that the Board or anyone else might have. I have nothing further at this time. Mr. Ward: The office would appreciate if you could give us the certified receipts on the mailing. Ms. Wickham: Yes, I have them. Mr. Ward: s there anyone else in attendance that would wish to address the Board on this subdivision? Ron Yedloutschnick: was wondering what the date of this recent plan is? Ms. Wlckham: The preliminary map that we have presented is dated August 3, 1996. I think those dates reflect primarily some technical amendments to the map with respect to drainage and some of the other requirements of the Board August 3rd is the latest date. Southold Town Planning Board September $0, 1996 Henry Wassmer: I live on a plot of ground adjacent to this Harvest Homes properW. I think can speak for most of the homeowners, maybe all of the homeowners that own property in that area We really don't seem to have any objection to the one acre building plots that are going to be situated on that 14.9 acres. However, there is just one little thing I want to ask about here. I had stopped by the Greenport Utility, there was a problem with extension of the water mains in that area. The water main is dead-ended on Wells Ave. and Jernick Lane at the end of a fire hydrant there. There is no further main down on that'side that goes up Wells And it also dead-ends down on Oaklawn and I believe around Jockey Creek. Now, I just checked with the Greenport Utility, like said, last week and they gave me, I have a paper here, indicating that there is a moratorium on any water main extension in that area, at present. Now I don't know whether that's changed or not. Are these people, if it is going to be built on, are they going to be allowed to get water in there or what's the story with that? Mr. Ward: Our letter from the Village is that it is in effect until January, 1997. Mr. Wassmer: January, 19977 Again, like say, the last time we were here, they were talking about with the TDR program and everything, they were talking about the possible subdivision down to quarter acre zoning, which we were adamantly against. But now, with the one acre zoning, well if that's the way it's going to be, I think most of us will go along with it. Mr. Ward: Anyone else ike to address the Board? Jean Yedloutschnick: I live at 440 Jernick Lane. Originally on the map there is a 50 foot area that is between my home and a home across from us. When we moved there 26 years ago we were told that there was going to be a road going through that section. And I'd like to know, because looked at the map, it isn't really too clear. I didn't have much time to look at it. What is actually happening with that 50 foot, and perhaps someone can just explain it to me. Mr. Ward: It will be part of one of the lots; it will not be an access point. Ms. Yedloutschnick: So it will never be a road in other words. Mr. Ward: It wil not be a road, it will not be a driveway. The access will be from Wells. It will be off the Main Road. Ms. Yedloutschnick: OK, thank you very much. Southold Town Planning Board 4 September 30, 1996 IRon Yedloutschnick: You say it will not be a road. Is that set in concrete or can the people use that as a roadway to enter that particular lot? Ms. Spiro: We're asking the applicant in a Declaration of Covenants and Restrictions not to put the driveway over there and that the driveway access shall be from Wells Ave. only. So that will be in a Declaration of Covenants and Restrictions. Mr. Yedloutschnick: That will be in the declaration? Ms. Spiro: Yes. Mr. Ward: Anyone else like to address the Board this evening? Again, this is a preliminary map. From this, after a closing of this nearing, we then also have a final hearing. If not, at this time, all ~s in order to close the preliminary .hearing. SCTM# 1000-122-6-29.2. Is the applicant here that would like to address the Board? Dr. Capello: Good evening. I'm Dr. Capello. I'm one of the principles of Mattituck Realty, L.L.C. and I have my affidavit of posting and receipts for the Board. Mr. Ward: I think our records indicate that we're waiting for a pending curb cut permit, is that where we're at? Dr. Capello: I have the curb cut permit and the ink is barely dry. Mr. Kassner: We have another resolution of approva but since we hadn't gotten the curb cut we were going to keep the hearing open. But we do have a resolution of approval, I don't have it with me, it's 13ack in the office. Ms. Spiro: We could hold this and do something else. Mr. Kassner: I could go back and get it and we could read it into the record. Mr. Ward: Let us do a little review and tonight if everything is cleared up then maybe we can get rid of it tonight. Tim Caufield: Good evening my name is Tim Caufield with Peconic Land Trust and I'm here on behalf of the owner of the property, Thornton Smith. Thornton is here as well if the Board [qas any questions. I believe everything is in order. We were waiting for Health Department today and we got that into the office, and I have the affidavit of mailing. Mr. Orlowski: Mr. Chairman, also 'd like to make a motion that whereas, the applicant has presented the final plat for the subdivision of Thornton Smith, Section 2; and WHEREAS, as per Section 106-24 (E) of the Subdivision Regulations, if at such time that the fina plat is submitted, if it is in substantial agreement with the preliminary plat, the Planning Board may waive the requirements for a final public hearing; and WHEREAS, the fina plat dated September 11, 1996, is in agreement with the preliminary plat and the Planning Board has decided to waive the final public hearing requirements; and WHEREAS, Thornton Smith is the owner of the property known and Southold Town Planning Board 8 September 30, 1996 designated as SCTM# 1000-113-7-19.20 and 1000-121-1-1.1; and WHEREAS, this proposed subdivision is for Section 2 of the Thornton Smith subdivision which is for 6 lots on 33.29 acres; and WHEREAS, Section I was approved on March 18, 1996; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself cad agency and issued a Negative Declaration on February 26, 1996; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the public hearing notification provisions; and WHEREAS, upon fulfillment of the conditions of approval, all requirements of the Subdivision Regulations of the Town of Southold will have been met.; be it therefore RESOLVED that the Southold Town Planning Board grant conditional final approval on the surveys dated September 1 I, 1996, and authorize the Chairman to endorse the final surveys subject to fulfillment of the following conditions All conditions must be met within six (6) months,of the date of this resolution. The Performance Guarantee in the amount of S189,675.00 must be submitted to the Planning Board and accepted by the Planning Board and Town Board or, the improvements contained in the bond estimate must be completed prior to any endorsement of the final map. An administration fee equal to Sl t,380.50 must ~)e submitted with the performance guarantee, or prior to the start of work on the ~mprovements The draft Road Management Agreement which was submitted on September 25, 1996, must be reviewed and approved by the Planning Board and the Town Attorney. A Grading and Drainage Easement is located on Lot 4 and on Lot 5. A draft of the Drainage Easement must be submitted for the Planning Board's review prior to execution. In addition, the deeds for Lots 4 and 5 must refer to the Drainage Easement. The deeds must be filed when the final plat is recorded. WHEREAS, Dr. Richard Coppello is the owner of the property Known and designated as Mattituck Realty, L.L.C., located at Main Rd., Mattituck, SCTM# 1000-122-6-29.2; and WHEREAS, a forma application for the approval of this site plan was submitted on May 28, 1996; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review act, (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on July 8, 1996; and WHEREAS, this site plan was certified by Thomas Fisher, Senior Building Inspector on September 30, 1996; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on Southold Town Planning Board 10 September $0, 1996 the surveys dated May 16, 1996 and August 20, 1996 and authorize the Chairman to endorse the final surveys subject to a one year review from date of building permit. Troy Oustavson: Mr. Ward, could just ask a question? My wife and I own the property immediately to the west When we put our building there, there was some discussion about the curb cuts and whether eventually if all four of those Sunbow parcels were developed whether there would be a problem with four consecutive driveways. Was any thought given to that issue do you know. I'm just curious mostly. Mr. Kassner: One of the Sunbow Associates members was in to see me, I've forgotten his name. Mr. Gustavson: Paul Stuart? Mr. Kassner: I guess it was Paul Stuart, yes. And he reviewed the plans that Mr. Denis had drawn, and the site plan and seemed to think that the building was in keeping with the area and that the site plan was adequate for his purposes. So he didn't make any comment. Mr. Oustavson: I'm just curious if the two properties to the east of that are developed we're going to have...and including the Mattituck Auto lot and the office complex with Dr. Capello is now, you're just going to have a series of driveways 75 feet apart there, right across from one of the busiest businesses in town, the McDonalds. Mr. Kassner: The DOT apparently didn't bring it to our attention or feel it was a problem. I suspect it is too late even to raise the question now, but I was just mostly curious. One of the things I've seen done is an interior access road that severa properties share. We would have no objection to that if it could be worked out. Maybe with the two buildings there it's not going to be a problem, but if you get a third and a fourth, with the kind of traffic usage that I anticipate, I think you're going to have a real bottle neck there. Is that sometlaing that would require Planning Board approval? Mr. Ward: I think we'd want to see it. I don't believe it would require a site plan approval, but we'd like to see what's being done. Nineteen lots are proposed in Section 2 and eight lots are proposed in Section 3. Be it resolved Southold Town Planning Board 14 September 50, 1996 that the Southold Town Planning Board grant a ninety (90) day extension of conditional fina approval. Conditional fina approval was granted on March 18, 1996. The 90 day extension wil expire on December 18, 1996 unless all conditions of approval have been fulfilled. Mr. Latham: Second the motion. Conditional final approval was granted on April 8, 1996. The extension will expire on April 8, 1997 unless all conditions of approval have been fulfilled Mr. Edwards: Second.
