ROY R. WARD II requests a Wetland Permit to replace the existing +/-105'
retaining wall in-place with C-Loc vinyl sheathing, and install +/-8' of retaining
wall return along the north property line. Located: 4075 Stillwater Ave.,
Cutchogue. SCTM#137 -1-8.1
The proposed action has been reviewed to Chapter 95, Waterfront Consistency
Review of the Town of South old Town Code and the Local Waterfront
Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that
the proposed action is generally CONSISTENT with the Policy Standards
and therefore is CONSISTENT with the LWRP with the following conditions:
1. No treated CCA lumber will be used.
Pursuant to Chapter 95, the Board of Trustees shall consider this
recommendation in preparing its written determination regarding the consistency
of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete his CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency view Law. This
assessment is intended to supplement other information used by a Town 0 outhold agency in
making a determination of consistency. *Except minor exempt actions in ding Building Permits
and other ministerial permits not located within the Coastal Erosion Haz 'd Area.
2. Before answering the questions in Section C, the preparer of thi form should review the exempt
minor action list, policiel\ and explanations of each policy cont 'ned in the Town of Southold Local
Waterfront Revitalization Program. A proposed action 11 be evaluated as to its significant
beneficial and adverse effects upon the coastal area (whic . cludes all of Southold Town).
3. If any question in Section C on this form is answer "yes", then the proposed action may affect the
achievement of the L WRP policy standards and nditions contained in the consistency review law.
Thus, the action should be analyzed in more etail and, if n\lcessary, modified prior to making a
determination that it is consistent to the aximum extent practicable with the LWRP policy
standards and conditions. If an acti~n ot be certified as consistent with the LWRP policy
standards and conditions, it shall not be dertaken. .
