PATRICIA SCOTT & RICHARD TERRY request a Wetland Permit and
Coastal Erosion Permit to demolish the existing single-family dwelling and
rear deck/steps, and construct a new single-family dwelling, front
porch/entryway, rear porch, rear deck, swimming pool, and attendant sanitary
system and private well. Located: 925 Stephensons Rd., Orient. SCTM#17-1-
2.1
The proposed action has been reviewed to Chapter 95, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront
Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that
the proposed action is generally CONSISTENT with the Policy Standards
and therefore is CONSISTENT with the LWRP with the following conditions:
1. Placement of hay bales during construction.
2. Drywell for the pool backwash and drywells to contain roof runoff.
Pursuant to Chapter 95, the Board of Trustees shall consider this
recommendation in preparing its written determination regarding the consistency
of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM

INSTRUCTIONS
1. All applicants for permits. including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. · Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation
criteria.

As indicated within Policy 1, "Development that does not reinforce the traditional land use pattern of the Town of
Southold would result in a loss of the community and landscape character of Southold.", this project is a proposal to
remove the existing single family dwelling & appurtenances thereon, and construct a new single family dwelling &
appurtenances, which itself is situated in a neighborhood consisting primarily of similarly-sized single-family dwellings
within similarly-sized properties. The proposal, as designed, will not result in adverse effects to the surrounding
environment in that the proiect has been designed in such a way as to be situated beyond both the required regulatory
setbacks associated with improving on a lot burdened by wetlands, and further landward than the improvements
currently situated thereon. More importantly, the current dwelling within subiect property has existed thereon in a
harmonious manner for years, and has not resulted in any form of adverse effects to the surrounding environment.
Accordingly, we believe that this project is consistent with this policy.

Subject proposal will comply with Policy 5 in that the property will utilize a private well within subject property,
which is to replace the existinR private well within said property attendant to the existinR dwellinR thereon, which has
not resulted in any adverse effects to the water quality and supply of the Town of Southold. In addition, an updated,
and far superior sanitary system is to be installed to be utilized by the new dwellinR thereon, in order to replace the
older, less-efficient, septic system currently attendant to the existinR dwellinR thereon, and which will be compliant
with the requirements of the Suffolk County Department of Health Services. AccordinRly, no adverse impacts to either
the water quality and/or water supply of Southold Town are anticipated.
