Wetland Permit for Bradford Winston
SCTM# 89-2-8
BRADFORD WINSTON requests a Wetland Permit to construct an in-ground
swimming pool and wood deck, attached to the existing single-family dwelling.
Located: 485 Breezy Path, Southold. SCTM#89-2-8
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
L WRP provided that:
1. The applicant proposes a sub-surface pool drain (dry-well) from the maximum
distance from the wetland to prevent pool chemicals from entering the wetland in
the event that the pool should be drained.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

Policy 1
Foster a pattern of development in the Town of Southold that enhances com-
munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The construction of a deck and swimming pool to an existing waterfront dwelling
is consistent with the character of the waterfront community, and because the im-
mediate area is heavily developed it is felt that there is no adverse impact on the
desired preservation of open space, Infrastructure use is not a factor since the pro-
ject is for the modification of an existing structure while retaining the same use.
The project is certainly a beneficial use of the coastal location, and the incremental
increase in development in the area is insignificant.

Preserve historic resources of the Town of Southold,

There is no evidence to indicate that the immediate area of the project includes his-
toric features or resources.
Policy 3
Enhance visual quality and protect scenic resources throughout the Town of
Southold.

The structures proposed will be inconspicuous in the proposed location. Because of
their very low profile they will not adversely affect the dynamic landscape.ele-
ments (tidal fluctuations, seasonal vegetation changes, changing light) which might
contribute to ephemeral visual qualities.

Minimize loss of life, structures, and natural resources from flooding and ero-
sion.

The likelihood of the structure proposed contributing to increased hazards which
could result in the losses listed is minimal. Natural protective features will not be
adversely affected. The proposed structures are landward of the non-disturbance
buffer specified in previous permits.

Protect and improve water quality and supply in the Town of Southold.

During construction a line of hay bales or a silt fence will be in place to minimize
the chance of silt entering the creek. There will be no disturbance of the creek bot-
tom during construction. Adequate provision will be made to insure that backwash
effluent is retained on the site in the upland area.

Protect and restore the quality and function of the Town of Southold's ecosys-
tem.

The original development of the site was approved by the Town Trustees, the
NYSDEC and the SCDHS beginning in 1998. Steps will be taken to insure that silt
does not enter the creek during construction. The project is adjacent to, but not
within, a State-designated Significant Coastal Fish and Wildlife Habitat. All statu-
tory and regulatory requirements, at all levels of government, will be strictly com-
plied with. No dredging, excavating, or filling of the creek bottom is proposed.

Protect and improve air quality in the Town of South old.

The construction or use of the project as proposed will not result in significant
amounts of new air pollution.

Minimize environmental degradation in the Town of South old from solid
waste and hazardous substances and wastes.

It is expected that the project as proposed will not result in the generation of any
additional solid waste. If it did, it would be disposed of in accordance with the re-
quired or recommended practices of the Town and the SCDHS. The handling and
storage of petroleum products and/or fuel gases, if any, will be accomplished
through the use of approved containers and facilities, and approved methods of
handling and storage will be foliowed.

Provide for public access to, and recreational use of, coastal waters, public
lands, and public resources of the Town of South old.
