Remove and replace (in-place) approx. 226 linear ft. of existing timber bulkhead on the South Marina, with vinyl bulkhead and backfill with approx. 18 cy. sand spoil to be maintenance dredged from most southeasterly boat slip (to max. depth of -4' ALW). Remove and replace (inkind/inplace) existing floating docks attached to existing bulkhead and existing shed landward of bulkhead. Located: 555 Minnehaha Blvd. & 2360 Minnehaha Blvd., Southold. SCTM#87-3-2.1&60 The reconstruction of the bulkhead, in-kind, is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 95 of the Town of South old Town Code. This review will address the backfilling of the bulkhead with 65 c. y. and 18 c.y. of clean fill and the dredging of the 18 c.y. of fill from the most southeasterly boat slip. The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review ofthe Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the L WRP provided the following best management practice is applied; I. To further the intent of the L WRP and the policies. assess the proiect area for the use of a floatin!! turbidity screen siltlboom durin!! re-construction of the structure to minimize turbidity in the water column. . "North" and "South" Marinas Dear Mr. Terry: Attached please find an L WRP Consistency Assessment Form being submitted in association with an application for a Town Wetlands Permit, which was just filed with the Board of Trustees, to maintain existing bulkheads and one of the existing boat slips at the captioned marina properties. . I have indicated that all policies are "Not Applicable," because pursuant to ~95-5(A) and the corresponding definitions of "action" and "minor action" by ~95-3, the submission of a L WRP Consistency Assessment Form is not required for this application. Specifically, all of the proposed work-including the maintenance dredging of one of the boat slips, which was previously authorized and undertaken in 1999 pursuant to Town Wetlands Permit 4933- involves only the "maintenance or repair involving no substantial changes in an existing structure or facility." I had forwarded a similar letter directly to the Trustees office but was advised that the LWRP form must still be submitted and directed to your attention so that you may make the formal determination that the application is exempt as indicated above.
