D. CLAEYS BAHRENBURG requests a Wetland Permit and Coastal Erosion Permit to
construct a private docking facility consisting of a 4'X 79' fixed elevated catwalk, 3.5'X IS'
hinged ramp, and 6'X 20' floating dock. Located: 220 Bay Ave., Orient. SCTM#24-2-21
All timber proposed for the dock facility is described in the Project Description as "non-
treated Fir or Cedar. The New York State Department of Environmental Conservation
prohibits the use of wood treated with pentachlorophenol within tidal waters. A silt
boom/tnrbidity screen has not been proposed to control tnrbidity during construction.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the following L WRP Policy Standards;
3,3.1 (D and J) (K 3c), 5.3 (c), 6.1 (A.2, and A.3), 9.1(C.2, C.3 and E), 9.2 (A.l, A.2 and
B.2), 9.3 (A), 9.4 (A, B, E.l, E.2, E.3 and E.4), 9.5 (A), 10.3 (A and B), 10.4 (A and B),I1.1
and 11.2 therefore INCONSISTENT with the Local Waterfront Revitalization Plan.
The L WRP does not fully support the construction of docks or structures in Orient Harbor.
Correspondingly the L WRP recommends the use of "alternatives to long piers or docks include
use of dinghies to reach moored boats and mooring in nearby marinas".
Pnrsuant to Chapter 95, the BoardofTrustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfr onslstency Review Law. This
assessment is intended to supplement other information used by a Town of South old agency in
making a determination of consistency, .Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area,
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of South old Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town),
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law,
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.

Policy 1. Foster a pattern oCdevelopment in the Town oCSouthold that enhances community character,
preserves open space, makes effICient use oC inCrastructure, makes beneficial use oC a coastal location, and
minimizes adverse effects oC development. See L WRP Section III - Policies; Page 2 Cor evaluation
criteria.

Subiect proposal is consistent with the policy in that the silin!! and utilization of the proposed dock assembly will
maintain the character of the surroundin!! nei!!hborhood, which currently consists of many similarly-improved
residential lots and commerciallols with similar accessory structures (i.e, dock assemblies aloo!! Orient Harbor). In
addition, subject proposal will be in harmony with the' ...beneficial use of a coastallocadon,,,' in that the le!!ally
created residential waterfront (i,e, coastal) lot will be enhanced by the inclusion of the proposed dock assembly in
order to access the surface waters of Orient Harbor. Accordingly, we believe that this project is consistent with this
policy,

attendant marinas located immediately to the south of said property (i,e, Orient Yacht Club), Accordin!!ly, we believe
that this project is consistent with this policy,

Subiect proposal will not adversely impact the visual Quality of the surrounding area in that the surrounding area is
currently comprised of properties improved with similar appurtenances (i.e. dock assemblies) of equal, if not greater,
size and scope. Scenic resources, assumedly views of Orient Harbor to the south, are not at risk due to the proposed
dock assembly being typical of the character of this section of waterfront. Accordingly, this proposal will comply with
Policy 3.
