En-Consultants, Inc. on behalf of JAMES MURRAY & SUSAN SEGUR requests a Wetland
Permit to remove and replace (in-place) approx. 160 linear ft. of existing timber bulkhead
(including S' northerly return) with vinyl bulkhead (to be raised IS" higher than existing);
remove and replace (in-kind/in-place) existing 8'X 22' timber boat ramp; remove and replace
(and raise IS") existing 3'X9' wood walk, 3'X 14' wood walk, and 10'X IT fixed dock; and
dredge approx. 300 cy. of spoil from area up to 30' off bulkhead to a maximum depth of -3'
ALW, approx. 70 cy. of which will be used as backfill and approx. 230 cy. of which will be
trucked off-site to an approved upland source.
The reconstruction of the bulkhead, in-kind, is an exempt Minor Action and not subject to
LWRP review pursuant to Chapter 95 of the Town of South old Town Code. This review will
address the dredging of 300 c. y. of "spoil". The proposed action is within a listed NYSDEC
Critical Environmental Area.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following best management
practice is applied;
1. If feasible. durin!! re-construction of the structure. encircle the entire proiect area
with a floatin!! turbidity screen to minimize turbidity in the water column.

its written determination regarding the consistency of the proposed action.

2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its sismificant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detail. listine: both supportine: and non-
supportine: facts. If an action cannot be certified as consistent with the L WRP policy standards and
conditions, it shall not be undertaken.

Remove existing 8', 16',67',17', 14', and 38' sections of existing timber bulkhead and
construct (up to 2 feet farther landward and 18" higher) :t6', :t83', :t30', and:t38' sections of
vinyl bulkhead; remove and replace (in-kind/in-place) existing 8' x 22' timber boat ramp;
remove 3' x 9' wood walk; remove and replace (and raise 18") existing 3' x 14' wood walk and
10' x 17' fixed dock; remove existing 3' walkway along bulkhead and construct (up to 2 feet
father landward and 5" higher) 4' walkway along new bulkhead; and dredge approximately 335
cubic yards sand spoil from area up to 32 feet seaward of new bulkhead to a maximum depth of -
3'ALW, approximately 40 cubic yards of which will be used on-site as backfill and 295 cubic
yards of which will be trucked off-site to an approved upland source, all as depicted on the
project plan prepared by En-Consultants, Inc., last dated 9/6/05.

repair and maintenance of a marina facility that has operated at this site
