Located: 170 Oak St., Cutchogue.

JAMES BROWN requests a Wetland Permit to remove the existing 3'X 64' dock and replace
with a 3'X 70' open pile dock in a new location with a 3'X 12' ramp and a 6'X 20' floating dock
with two (2) dolphin piles. The action is located in East or Eugene's Creek a listed New York
State Significant Fish and Wildlife Habitat and New York State Department of
Environmental Conservation Critical Environmental Area (Cutchogue Harbor Wetlands).
Currently the applicant enj oys access to the water via a 3' x 64':!: existing dock which is
proposed to be removed. The new dock is proposed to the south of the existing dock and not
within the footprint of the current dock location. All piles for the dock are proposed to be CCA.
The remaining materials are proposed to be cedar or fir.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review ofthe
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with Policy Standards 3.1 (E1), 5.1 (B3),5.3,
6.2, 6.3 (A, B3, C2 and C3, and 8.3 (A, B) and 9.3 (A and E) therefore is INCONSISTENT
with the LWRP.
Please consider conditions on any approvals that would make the proposed action further
consistent with the above listed Policy Standards or advise the applicant of the necessary
amendments to the proposed action to achieve greater consistency to the greatest extent practical.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

making a determination of consistency. · Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detail. Iistinl!: both supportinl!: and non-
sUJ}J}ortinl!: facts. If an action cannot be certified as consistent with the L WRP policy standards and
conditions, it shall not be undertaken.
