SCTM#1000-90-2-26 LEWIS L. & GRACE R. EDSON requests a Wetland Permit to construct a single-family dwelling, attached rear deck, driveway, and sanitary system. The property also lies within the FEMA Flood Insurance Rate Map Zones X and AE e18; an Area of Special Flood Hazard, The parcel proposes to be served by public water. The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following standard best management practices and Policy directives are implemented. 1. Require erosion and sediment controls (haybales, silt fencing). 2. Require surface water quality protection measures for constructed areas generating runoff (gutters, downspouts, dry wells and pervious driveways). 3. To further the intent of policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to I,lleet federal flood insurance program standards. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAP for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of South old agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of South old Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the L WRP policy standards and conditions. If an action cannot be certified as consistent with the L WRP policy standards and conditions, it shall not be undertaken. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation criteria. [g] Yes 0 No 0 Not Applicable As indicated within Policy 1, 'Development that does not reinforce the traditional land use pattern of the Town of Southold would result in a loss of the community and landscape character of Southold. ", this proiect is a proposal to improve upon a vacant lot situated in a neighborhood consisting primarily of similarly-sized single-family dwellings within similarly-sized properties. The proposal, as designed, will not result in adverse effects to the surrounding environment in that the project has been designed in such a way as to maximize all required regulatory setbacks associated with improving on a lot situated in proximity to the surface waters situated contiguous to subject property. In addition, the surrounding neighborhood is comprised of older residential dwellings which have existed harmoniously within this area for years and have not resulted in any form of adverse effects to the surrounding environment. Accordingly, we believe that this project is consistent with this policy. Attach additional sheets if necessary Policy 2. Scenic resources, assumedly views of Midway Inlet to the south, are not at risk due to the property being currently heavily screened with vegetation and not offering any form of scenic resource for the property owners surrounding subject lot. Flood Zone X are areas having the potential for flooding once within 500 years on average, hence the potential for the proposed improvements being effected by flooding/erosion is very minimal.
