The proposed action is located within REACH 1. The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the L WRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following outstanding items are submitted and standard best management practices are implemented to further the intent of the LWRP Policies 5, 6, 10 and 11. 1. To further the intent of L WRP Policies 5, 6, and 8 and to protect water quality and the health of marine organisms no CCA treated wood. oil based preservatives containiD1! creosote (CRT) or pentachlorophenol (PCP). applied to the surface of wood materials shall be permitted in the construction materials of the bulkhead. walkwav. dock or ramp. The applicant shall use a decav resistant alternative. 2. The proposed detailed construction practices and materials have not been identified and should be outlined in writin!! to the Board. 3. Althou!!h the application states that the disturbed areas will be restored. a restoration plan outlinin!! species. timin!! and specifications has not been submitted to the Board. Snch a plan should be submitted to the Board. ., . . 4. Durin!! construction of the structure, reQuire the encirclement of the entire proiect area with a floatin!! turbidity screen to remain in place a sufficient number of days to allow the settIin!! of the suspended solids. Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
