The proposed action involves the in-place, in-kind replacement of an existing bulkhead 6' x
100 floating dock; three 6' x 20' floating docks; a 4' x 12' floating dock; a 6' x 40' floating dock
and reset six existing pilings.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, the action is EXEMPT
pursuant to items A and B (below) of the Exempt Miuor Action list.
A. Maintenance or repair involving no substantial changes in an existing structure or
facility;
B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the
same site, including upgrading buildings to meet building or fire codes, except for
structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law
where structures may not be replaced, rehabilitated or reconstructed without a
permit;
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

All applicants for penruls* including Town of Southold agencies, shall cOlllpJ~te tllis CCAF for
proposed adions that are subj~ct tc the Town ofSoutllOld Waterfront Consistency Review Law. This
assessment is int~nded to supplem~nt other infonnation used by a Town of Southold agency in

Defore answering the questions in Section C, the prcpar~r of this fonn should rcvi~w the exempt
minor action list, policies and explanations of each policy contain~d ill the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse e/lects upon tllC coastal area (which includes aU of Southold Tov,ll).

achievement of the I ,WRP policy standards and conditions contain~d in the consistency review Jaw.
